There is no parking requirement for commercial floor area in the BD2 zone, so unless you have other (residential) uses in the building, you do not have to retain the parking space. Nonetheless, reducing the width and retaining the space is a good idea, and you should discuss with Jeanie McConnell in our Engineering Division regarding whether your proposal will work (parking space size, configuration, etc.). I've copied Jeanie on this email. From Planning's standpoint, we will review the proposal as part of the building permit. The only design aspect we will be looking for is that the equipment is properly screened or painted a 'flat' color so it isn't reflective as seen by pedestrian passers-by (since the proposed location is adjacent to the street). I am also more than happy to meet with you and your representatives in order to resolve this matter and I am available any day during the week of September 15th during City business hours. The original building plans on file with the City identifies the construction type --which by all indications is III-1 Hour construction. Protection of the buildings' steel frame members was required of the original construction in 1973 and is still required today for this type of construction. Regarding the validity of the statement "life -safety violation", unprotected steel members which are required to be protected is most certainly a "life - safety violation", and that is why we attempted to notify you as soon as the violation was confirmed. The plans submitted for the cell project on 12/11/96 do not specifically show the building frame unprotected in the garage area since the majority of this work is within a shaft and on the roof. However, when the mechanical permit application was submitted and indicated the equipment would be located within the building framework, I dispatched the City Inspector to make a site inspection for code related issues. It is not the City's intent to postpone informing any applicant of code requirements associated to a project --even when the news is unfavorable. The mechanical permit was received on 8/7/97, the site inspection was conducted on 8/8/97 and my first letter of notification was sent on 8/12/97 after I had researched the plans and applicable codes. For clarification, it has not been ascertained that the installation of the mechanical equipment in the parking garage creates any greater fire threat due to it's location to the unprotected steel members as you state in your letter. But please be advised, Section 102 of the 1994 Uniform Building Code requires that when life -safety violations are brought to the Building Officials' attention they must be resolved. Furthermore, I have not used the term "life threatening" as you highlighted in quotations in your letter however, it is my determination that a life -safety violation exists and as building owner(s) it is your responsibility to resolve. It is understandable that receiving news about a building that you have purposefully improved must be a shock but I assure you my research was without malice and the conclusion (that a violation exists) is sound. However, if you have specific information that demonstrates the building construction type is not as shown on the approved plans or if other fire protection means have been installed which would negate the requirement for framing member fire protection, please provide that information to me for review. Or if my letters have satisfactorily explained the situation you may apply for the required building permit to install the one hour fire protection, at 121 5th Avenue North, Second Floor, Monday through Friday, 9:OOam to 5:OOpm. The circuit breakers are required by Code to be "trip free", for them to perform as they are intended to. As such, today I removed tape from two separate breakers. As with the shield, tape on the electrical breakers will not allow a "trip free" condition. We cannot allow any type of binding for the breakers in your panel. If there is a concern to avoid unwanted manual throwing of a circuit breaker, there are acceptable ways to avoid a needless crash of electrical power without tape or shields. For computer terminals, in order to keep volatile memory from being lost in an outage, an appliance may be purchased along the order of $100. This appliance is called an uninterrupted power supply and plugs into the wall which will in turn accept your data equipment power cord. This provides backup electricity in an outage to maintain your volatile memory until you can save it. An option at the panel is a breaker "handle lock -off", which will not prevent manual throw of a circuit but make that action a difficult thing to. do. These allow "trip free" operation. An electrical distributor may carry these items on the shelf. Their cost may be a few dollars, however the type of lock -off must be specified by the particular model and size of circuit breakers installed in your building. As of yet, no such action has been commenced. The building is now ready for occupancy. It is urged that except for the question of compliance with the height restriction, the referenced building is in compliance with all applicable fire and building.regulations and a temporary cer- tificate of occupancy should now issue. The minutes of the Council Meeting of January:15, 1974, indicate that there is uncertainty concerning the Harbor Building compliance with the 35-foot height limitation. "City Planner, Joe Wallis, explained that property interpretation is needed, especially when the sidewalk position isnot specified in the Code for measuring height." Thus, at present, there has been -no proper decision as to whether or not the Harbor Building exceeds the height limitation. Thereforei it is fully completed at the present time pursuant to a presumably valid building permit. A property owner has a vested right to use his property under the terms of.the zoning ordinance applicable thereto. State ex rel Hardy v. Superior Court, 155 Wash. 244, 284 Pac. 93. A building or use permit must issue as a matter of right upon compliance with the ordinance. State ex rel Ogden v. Bellevue, 45 Wn2d. 492. I • . • March 18, 1974 Page 2 The Building Department of the City has no discretion to refuse a permit save to ascertain if the composed struc- ture complies with the zoning regulations. Once that is done and the appropriate fee tendered by the applicant, the Building Department must issue the building permit. State ex rel Craven v. Tacoma, 63 Wn2d. 23. Even were the City of Edmonds not legally obliged to issue the occupancy permit requested herein, it is submitted. that to'do so would be the fair and wise thing to do under the circumstances for the following reasons: (a) The purpose of an occupancy permit is to assure occupants that the subject building is safely in compliance with all applicable regulations. Even were it to be finally decided that the Harbor Building is too tall, there is no suggestion that it is unsafe for occupancy. The only other basis for withholding the occupancy permit would be the working of a•sanction on the owner or builder for failing to comply with the Ordinance. Since non-compliance is not yet clearly shown, such a sanction would be,inappropriate. Moreover, were non-compliance to be shown, the appropriate remedy would be injunctive action as heretofore authorized by the Council. Furthermore, the above -quoted Council authorization specifically refrains from the use of any stop work order or application for temporary injunction, apparently suggesting that it is the spirit of the Council to ascertain the existence of a.violation before infringing on the rights of citizens. Assuming that the Harbor Building is too tall and the City successfully sued for injunctive relief, it is quite clear that restrictions on occupancy would not be included in any relief.accorded. In Steele v. 'Queen C. Broadcast Co., 54 Wn2d. 402, the Washington Supreme Court found ample support for the conclusion that a certain television transmission tower was unlawful under the zoning code. The Trial Court had refused a mandatory injunction against the tower and the Supreme Court, in affirming, although expressing significant question about the good faith of the defendant, employed a relative hardship test. Similarly in Arnold v. Malloney, 75 Wn2d. 143, the. Supreme Court approved the withhold g of a mandatory injunction to compel the removal of.an encroaching structure as oppressive: "a mandatory injunction can be withheld as oppressive when, as here, it appears, and we particularly stress, that (1) the encroacher did not simply take a calculated risk, act in March 18, 1974 Page 3 bad faith or negligently, wilfully or indifferently locate the encroaching structure;:(2),-the damage to the land- owner was slight and the benefit of removal equally small; (3) there was ample remaining room for a structure suitable for. the area, no real limita- tion on the property's future use; (4) it is impractical to move;the'* structure as built; and (5) there is an -,enormous disparity in resulting hardships." Supra at 152. Clearly, the builders of the Harbor Building acted in the utmost good faith, as evidenced by repeated consultation with the Edmonds Building Department at all stages of•construc- tion and including specific instructions concerning the inter- pretation of the height requirement. (b) The damage, if any, caused by such a slight. excess heightas alleged in this case, is clearly diminutive; and the cost of removing the.structure would be over- whelming. Since it is apparent from.the above -cited cases that the building will not be abated under any circumstances, there is no reason to prohibit occupancy of the building. Furthermore, it is submitted that the building is not above the height limit imposed by the Edmonds Zoning Code. Building height is defined by the Code as "the height of a building is the vertical distance from the mean ground level to the highest point of the coping of a flat roof.. Mean ground level is defined as "the average of the finished ground level at the center of all exposed walls of the building. Where the walls are parallel to and within five feet of the sidewalk, the side- walk shall be considered the mean ground level.". The builder of the building in question consulted with the Edmonds Building Department and was advised that the above -quoted language was interpreted in a certain fashion and the point of reference was indicated to the builder. It is conceded that a building permit issued in violation of law or under a mistake of fact confers no rights. Steele v.. Queen C. Broadcast Co., supra. at 408. However, it is submitted that in the instant case, there was not a violation of law or mistake of fact, but rather a good faith reliance upon an interpretation by the property authorities. Thus, the building in question is in compliance whether the interpretation rendered is later ruled to be erroneous or not. In summary, we urge that (1) the Harbor Building is fully in compliance with all applicable ordinances, and the law now requires the issuance of a certificate of occupancy; (2) if the building .is not in compliance with the height restriction, an occupancy permit ought nevertheless be issued pending the outcome of litigation. This is a widely used practice and is sanctioned by the Uniform Mechanical Code (1970 & 1973) paragraph 1205 and chapter 10. This practice offers several advantages from an air conditioning sense, namely, more uniform temperature in the conditioned space and reduced temperatures above the ceiling. W,analysis of the penetrations through the ceiling indicates the following (using the second floor of the building as typical): there are 76 fluorescent lights having a vent area of 21 square inches each, or 1596 square inches total there are 28 rgcessed down lights having cross -sectional area of 50 in. each, or 1407 square inches total • the building is 60 feet wide by 100 feet long. Allowing for the two stairwells, mechanical shaft and elevator, the net floor space is approximately 5580 square feet. • per UBC 4303 b6, the ceiling can have 5580 in-2 of penetration. However, based on the above, it will have only 3002 square inches of penetration, or 53.8% of allowable. Immediate steps are being taken to remove the wood blocking from around the fire dampers located in the mechanical shaft. These will be re- placed by steel and a steel collar will be placed around the fire damp- er so as to provide a collar on both sides of the fire damper housing. Steps have also been taken to secure UL labels for the doors and jambs in the stairwells. The supplier and manufacturer have been con- tacted and this problem will be resolved':today (3/15/74). It appears Page two that the door and jamb are rated but the supplier did not provide the necessary labels. In the event that they are not rated, steps will be taken to secure the rating or rated assemblies will be in- stalled. I believe this covers the items we talked about yesterday. Such use, as outlined.in 706(b),.is allowed. Your analysis of the ceiling penetrations appears to be correct. with one.exeeption; it did not mention the supply duct penetrations that are present throughout each floor. This, then,.would again require information and certification that the openings allowed in Section 4303(b)6. of the Uniform Building Code, have not been exceeded: On -site inspections March.18, 1974, indicated that wood.in the vertical shafts not allowed 3n table 17-A of the Uniform Building Code, is being removed and proper- nei:a?, collars are being placed as required in U.B.C. Standard 43-7. The,BuildinaMaterials List published by Underwriters Labratories, Inc. requires that any and all proper fire separation assemblies bear a,listing label for field identification.
