Binding Effect - Duration. This Agreement shall be recorded with the -Snohomish County Auditor, shall constitute a covenant running with the land described on Exhibit.A, and shall be binding upon the owners, their heirs, successors in interest and assigns, provided, that this Agreement shall be valid only for a period of ten (10) years from the date it is signed by the owners, after which it shall expire and become null and void. 6. Specific Enforcement. In addition to any other remedy provided by law or -this Agreement, the terms of this Agreement may be specifically enforced by the City of Edmonds. 7. Attorney's Fees. In any suit or action brought by the City of Edmonds to enforce any provision of this Agreement or to redress any breach, the owners covenant that the City shall be entitled to. reasonable attorney's fees and costs in addition to any other remedy. We have received a complaint that vegetation along your property line is making it difficult for drivers to see southbound traffic while looking north as they attempt to enter the roadway from 1030 Third Avenue South. City of Edmonds staff has investigated the matter and determined that the vegetation in question does, in fact, create a line -of -sight hazard per Edmonds Community Development Code (ECDC), Street Obstructions, Chapter'9.25 (copy enclosed). In order to reduce the hazard and enhance public safety, the City of Edmonds is requesting that you trim this vegetation back so it does not create a line -of -sight hazard. We require you to trim the pine tree bush next to the mail -boxes along the sidewalk down one foot and to trim the evergreen tree up two feet. Both vegetations should be trimmed back five feet from the property line. Please complete the trimming by August 6, 2004. Your cooperation in bringing your vegetation into compliance is appreciated.
