Construction of sidewalks adjacent to the subject property would also not comply with ADA standards without significant re -grading of the right-of-way and construction of retaining walls. The City agrees that it would be economically unfeasible for this development to incur such costs. Furthermore, two other short plat developments constructed within the last 3 years and located within the vicinity of this project were granted waivers from the requirement of sidewalk construction. The first, located north of the subject development at 509 9th Ave N, received a sidewalk construction waiver for that portion of the property fronting 8th Ave N. As portions of 8th Ave N have been vacated between the subject property and the closest sidewalks on 8th Ave N no link would be provided to other existing sidewalks on 8th Ave N.
