After reviewing all the information provided in the address file and the Architectural Design Review Files, staff has concluded that the city accepted the deficiency on November 14, 1983, via a Compliance Agreement for Permit No. 790124. Attached to the agreement is an as -built drawing illustrating the parking lot as it was constructed with 9 parking stalls instead of 10. In reaching this settlement it was necessary to obtain the approval of the property owners, Dr. and Mrs. Bennett. The understanding between all parties is that the following improvements.will be made to the property to the. extent $8,500.00 is sufficient to cover the costs of such improvements: 1. Reduce the grade of the driveway from 24 percent to a grade acceptable to the'city. 2. Install the catch basin adjacent to Fifth Avenue in accordance with city standards. 3. Modify the parking lot in the rear to provide'an additional blacktop sufficient to nerm.i.t the instal.lati,on of ten parking spaces, five of which are to be designated for compact cars. (Dr. Bennett has indicated that he would be willing to remove the large rhododendron bush if you determine that it is necessary to do so.) 4. Remove and reconstruct the curb on either side and in front of the driveway's entrance onto Fifth Avenue South. 5. Install wheelstops for the parking spaces as required by the original city approved plans. Dr. Bennett has been told that the work would progress at the city's convenience and, therefore, no set time table has been established. At any rate, we should wait at least until the check from the insurance company has cleared. FILE /067 �- ple. s COMPLIANCE AGREEMENT FOR PERMIT NO. 790124 WHEREAS, the City of Edmonds issued Permit No. 790124 in 1979 for the construction of improvements for property located at 1067 Fifth Avenue South, and WHEREAS, a performance bond in the amount of $8,500 was obtained for the benefit of the City of Edmonds to ensure the full and proper construction of such improvements, and WHEREAS, the certain improvements authorized by said permit were not constructed according to the requirements of the Edmonds Architectural Design Board and the construction company to which the permit had been issued failed to correct such discrepancies, and WHEREAS, the City of Edmonds, through litigation, obtained the amount of said performance bond which has been deposited with the City of Edmonds for the sole purpose of bringing the site improvements into substantial compliance with the requirements of such permit and the Edmonds City Code, and WHEREAS, Dr. Patrick Bennett and Anna Bennett, husband and wife, are the current owners of the subject property and desire, as independent contractors, to facilitate the design, engineering and construction of improvements at 1067 Fifth Avenue South in conformance with Permit No. 790124, now, therefore, In consideration of mutual benefits exchanged as set forth by this Agreement, the parties agree as follows: 1. The Bennetts warrant that they are the legal owners of property located at 1067 Fifth Avenue South and legally described as set forth on Exhibit A attached hereto and incorporated herein in full by this reference. 2. That the Bennetts will submit an engineered plan for approval by the City Engineer that will correct the deficiencies in the site improvements on the subject property in substantial compliance with Permit No. 790124. 3. That the Bennetts will apply for any necessary building permit and pay any required fees. 4. The Bennetts will cause the improvements authorized by the approved engineering plan to be constructed according to City standards subject to inspections by the City building department and/or engineering department as required by the City. 5. The City agrees to pay the sum of $8,500 to the Bennetts upon acceptance of the completed project and proof sufficient to the City that all labor and materialmen's claims have been paid and that there are no unsatisfied liens against the project. Payment of a proportion of such sum may be made, at the discretion of the City, upon completion of .any reasonably defined phase of the project, provided that such partial payment does not exceed the actual cost of such completed phase, and provided further that in no event shall - 2 - more than 70% of such sum be paid prior to completion of the project and proof of satisfaction of all claims on liens. The City shall not be liable for any costs of such project in excess of the principle sum of $8,500. 6. The Bennetts agree to indemnify and hold the City harmless from any liability for damages of any nature or kind whatsoever from and against claims filed against the City as a result of any actions performed pursuant to this Agreement, and shall defend the City whenever the City is named in a lawsuit in which this Agreement is at issue covering all costs of such defense including but not limited to attorney's fees and expert witness fees. 7. The Bennetts grant their permission to the public officials and staff of the City of Edmonds to enter the subject property for the purposes of inspection and administration of this Agreement. In connection with this duty I am required to, on a regular basis, estimate the cost of all improvements whether con- structed by contract or by city forces. 3. On January 6, 1983, I inspected the site on which the five unit apartment building is built at,1067 Fifth Avenue South to determine the conformance of various site improvements with -'city construction standards and to estimate the cost of bringing those site improvements into conformance with the city.construction standards and.into confor mance with the plans for such site improvements approved by the City's Architectural Design Board. 4. The most serious nonconformance, in my opinion, is the slope of the driveway from Fifth Avenue South along the south side'of the apartment building to the parking lot in the rear of the building. That driveway was required to be a six -percent slope by the plans approved by the Architectural Design Board, however the slope of the driveway as built is well in excess of six -percent, approaching 20- percent. This condition presents a serious safety hazard in freezing weather creating the strong likelihood that cars using this driveway may slide uncontrollably onto Fifth Avenue South which is a busy arte- rial street in our city. 5. The storm water catch basin located in the driveway referred to above, does not meet the standards set forth in section 64 of the "Standard Specifications for Municipal Public Works Construction" as adopted by the City of Edmonds in Ordinance No. 1911. The catch basir has risen above the grade of the surrounding pavement preventing water from running into such catch basin and therefore rendering it entirely nonfunctional. The .curbs on the other side of the curb cut for the drive- way of this apartment building where it enters Fifth Avenue South is poorly constructed and structurally unsound and therefore does not meet the requirements of section 40-3.01 of the same standard discussed above and must be removed and reconstructed in order to meet such city standards 7. In reviewing the parking lot at the rear.of the apartment building in question, it appears that it has not been constructed according to the plan approved by the City's Architectural Design Board in that the parking spaces which were built are several feet from the east property line rather than directly adjacent to.that property line as required by the plans. One of the two parking spaces for compact cars has not been constructed as required by the plans. The trash receptical enclosure has not been constructed in the location indicated by the plans. Wheel stops for each of the parking spaces have not been installed as required by the approved plans. 8. I have estimated the cost of correcting the site improve- ments and bringing them into conformance with the plans approved by the Architectural Design Board and with the City's standards for construction and have prepared an Exhibit B, attached to this affidavit, which de- tails my estimate of these costs. Aft 4r AGENDA ADB-12-79 GORDON GEGAX - Review of sign for print shop at 311 Edmonds St. (RMH) Ms. Luster displayed a colored drawing of the proposed sign, noting that it met the Code requirements as to size. However, the proposal was for a freestanding sign which the Code discourages in the RML zone. The print shop building sets back from 3rd Ave. but faces on Edmonds St. The applicant wished to place a freestanding sign at the corner of 3rd Ave. and Edmonds St. The colors of the sign were to be brown, off-white, and gold. The Staff recommended approval of the sign if it were placed on the building, rather than being a freestanding sign. MR. LaFON MOVED TO APPROVE ADB-12-79 IF THE SIGN IS LOCATED ON THE BUILDING. The applicant said the sign would not be visible to south - bound traffic until they passed the building. He said the building has housed a print shop for 18 years and always had a freestanding sign, but it was knocked down by a truck and they presently had no sign. Ms. Luster said the Code does not speak to replacement of a destroyed sign but it does state any changes to the sign constitute a new sign and it will be so reviewed. She stressed that the applicant must justify to the Board the need for a freestanding sign before they can approve it. Mr. Kinderfather explained to the applicant the reasons for the new Sign Code and what it is hoped to accomplish. His opinion was that what the applicant proposed was a vast improvement over what had been there. Mr. Spanfelner felt the freestanding sign was warranted because of the location of the building on the corner. He felt a sign was needed and that a freestanding sign was warranted at the location requested. Ms. Luster reminded the Board that the Sign Code requires landscaping under freestanding signs, in the event they approved such. MR. KINDERFATHER SECONDED THE IiOTION ON THE FLOOR. The applicant again stated that a sign attached to the building would not be effective. He said they are not yet in the telephone book and were anxious to get a sign in place which would give their telephone number. Mr. Selvidge advised him that when he was in business for a while he would discover that his business was not being generated by his sign. A VOTE WAS TAKEN ON THE MOTION, WITH MR. LaFON AND MR. SELVIDGE VOTING YES, AND MR. MATTSON, MR. SPANFELNER, AND MR. KINDERFATHER VOTING NO. THE MOTION FAILED. MR. SPANFELNER THEN MOVED THAT ADB-12-79 BE APPROVED AS A FREESTANDING SIGN WITH 32 SQ. FT. -OF LANDSCAPING BELOW AND AROUND IT. MR. MATTSON SECONDED THE MOTION FOR DISCUSSION. The applicant was asked how high the sign would be, and he responded that it would be a maximum of 3' high. MR. SPANFELNER THEN AMENDED HIS MOTION, SECONDED BY MR. MATTSON, THAT ADB-12-79 BE APPROVED AS A FREESTANDING SIGN A MAXIMUM OF 36" HIGH, WITH 32 SQ. FT. OF LANDSCAPING AROUND THE BASE OF THE SIGN, CONSISTING OF LOW GROWING EVERGREENS, PLANTS TO BE OF 12"- 15" SPREAD AND PLANTED WITH 30" SPACING. THE MOTION THEN CARRIED, WITH MR. LaFON VOTING NO. ADB-13-79 BOWHALL CONSTRUCTION - Review of site, landscape, elevations, and sign for five -unit townhouse at 1067 5th Ave. S. (RMH) Ms. Luster said this will be a fairly low profile building for this location. There are the required ten parking spaces but two are marginal and the Staff felt they should be marked with specific instructions, i.e., the parking stall on the north property line should remain the same size but be marked for compact cars only because of the lack of turnaround area, and the stall on the east side of the building should be marked "back in only" because of a sight hazard when leaving that stall. The trash area was shown to be screened but no detail of the screening was shown, and the utility meters were not shown. Ms. Luster noted that the shrubs along 5th Ave. will be removed ARCHITECTURAL DESIGN BOARD Page 3 - February 1, 1979 0. in order to install a sidewalk and also there will be no landscaped area between the ingress/egress and the building as it will be paved right up to the building. She said there had been a change of 4' in the elevations and the Board may want to see the elevations drawn to scale. The building will be 4' narrower than indicated in the plans. Ben Johnson, architect for the project, said the elevations for each unit had been reduced by 1'4" for a total of 4'. He said it may not be necessary to put a fence on the site as there is a portion of an existing fence to the south. He said they will provide a screen on 5th Ave. if the existing landscaping cannot be retained as they will want to provide privacy, especially for the units on the lower level. He said the stucco will be beige and the trim Olympic Stain 916 (a sample of the trim color was submitted at this time). He added that wood sash windows were replacing the greenhouse windows because of the change in the width of each unit. The stacks for the chimneys will be stuccoed,with wood trim. Mr. LaFon was concerned with the lack of landscaping on the south elevation, and Chairman Wight suggested Boston ivy on that side, saying six plants in gallon containers would be adequate. Mr. Johnson said the electric meters would be in cases near the front doors of each unit, on the east elevation, and there will be lights at the walks to the stairways, at the doors, and in some of the landscaping. A light fixture sample was not submitted. Mr. LaFon expressed the concern that they were squeezing too many units onto the site. He noted there will be no protection for the wall adjacent to the drive. He felt everything was too minimal, that there was too much compromising to squeeze the proposal on the site. Mr. Selvidge noted that 5th Ave. already is crowded and he did not feel this proposal would be a problem. Mr. Johnson noted that if they had put all the parking in front there would be no problem with the parking, and Mrs. Luster added that the Staff encourages that parking be placed in the rear. MR. (RML) Ms. Luster noted that the drainage plan showed access onto 196th St. but that was incorrect as that the access would be onto Maplewood Rd. The applicants had applied for a Conditional Use Permit to have a law office in this existing home. Much of the vegetation on the site was in poor condition and was to be replaced. Several large cedar trees and a row of apple trees would be saved. The Staff recommended additional landscaping. The sign will be at 84th and Maplewood Rd. and the Staff recommended the entire area at that portion of the property be landscaped with bark. They also recommended landscaping around a large existing holly tree. A shed was removed from the site and the carport also was to be removed. Ms. Luster indicated that what was proposed should improve this corner very much. She noted that existing fencing was chain link and she recommended it be slatted with wood to soften the overall impact. The fence is 4' high and is installed on the perimeter of the property and also from the house to Maplewood Rd. A landscape plan had not been submitted but it was agreed it could go on a Consent Agenda. Mr. LaFon suggested to the applicants that they look at their landscaping from the stand- point of maintenance and also from initial cost. Howevrr, the proposal was for a freestanding sign which the Code discourages in the RML zone. The print shop building sets back from 3rd Ave. but faces on Edmonds St. The applicant wished to place a freestanding sign at the corner of 3rd Ave. and Edmonds St. The colors of the sign were to be brown, off-white, and gold. The Staff recommended approval of the s;gn if it were placed on the building, rather than being, a freestanding sign: MR. LaFON MOVED TO APPROVE ADB-12-79 IF THE SIGN'IS LOCATED ON 11iE BUILDING. The applicant said the sign would not be visible to sauth- bound traffic until they passed the building. He said the building has housed a print shop for 18 years and always had a freestanding sign, but it was knocked down by a truck and they presently had no sign. 14s. Luster said the Code does not speak to replacement of a destroyed sign but it does state any .changes to the sign constitute a new sign and it will be so reviewed. She stressed that the applicant must justify to the Board the need for a freestanding sign before they can approve it. Mr. Kinderfather explained to the applicant the reasons for the new Sign Code and what it is hoped to accomplish. His opinion was that what. the applicant proposed was a vast improvement over what had been there. Mr. Spanfelner felt the freestanding sign was warranted because of the location of the building on the corner. He felt a sign was needed and that a freestanding sign was warranted at the location requested. Ms. Luster reminded the Board that the Sign Code requires landscaping under freestanding signs, in the event they approved such. MR. KINDERFATHER SECONDED THE MOTION ON THE FL(,AR. The applicant again stated that a sign attached to the ouilding would not be effective. He said they are not yet in the telephone book and were anxious to get a sign in place which would give their telephone number. Mr. Selvidge advised him that when he was in business for a while he would discover that his business was not being generated by his sign. A VOTE WAS TAKEN ON THE MOTION, WITH MR. L,,FON AND MR. SELVIDGE VOTING YES, AND MR. MATTSON, MR. SPANFELNER, AND MR. KINDERFATHER VOTING NO. THE MOTION FAILED. MR. SPANFELNER THEN MOVED THAT ADB-12-79 BE APPROVED AS A FREESTANDING SIGN WITH 32 SQ. FT. ADB-13-79 ' BOUHALL CONSTRUCTION - Review of site, landscape, elevations, and sign or five -unit townhouse at 1067 5th Ave. S. (RMH) Ms. Luster said this will be a fairly low profile building for this location. There are the required ten parking spaces but two are marginal and the Staff felt they should be marked with specific instructions. i.e., the parking stall on the north property line should remain the same sire but be marked for compact cars only because of the lack of turnaround area, and the stall on the east side of the building should be marked uack in only" because of a sight hazard when leaving that stall. The trash area was shown to be screened but no detail of the screening was shown; and the utility meters were not shcwn. Ms. Luster noted that the shrubs along Sth Ave. will be removed ARCHITECTURAL DESIGN BOARD Page 3 - February 7, 1979 it ,rder to install a sidewalk and also there will be nc landscaped ar between the ingress/egress and the building as it will be paved up to the building. She said there had been a change of 4' ir, )e elevations and the Board may want to see the elevations drawn to scale. The building will be 4' narrower than indicated in the olans. Ben Johnsen, architect for the project, said the elevations for each unit had been reduced by 1'4" for a total of 4'. He said it may riot be necessary to put a fence on the site as there is a portion of an existing fence to the south. He said they will provide a screen on 5th Ave. if the existing landscaping cannot be retained as they will want to provide privacy, especially for the units on the lower level. He said the stucco will be beige and the trim Olympic Stain 916 (a sample of the trim color was submitted at this time). He added that wood sash windows were replacing the greenhouse windows because of the change in the width of each unit. The stacks for the, chimneys will be stuccoed,with wood trim. Mr. LaFon was concerned with the lack of landscaping on the south elevation, and Chairman Wight suggested Boston ivy on that side, saying six plants in gallon containers would be adequate. Mr. Johnson said the electric meters would be in cases near the front doors of each unit, on the east elevation, and there will be lights at the walks to the stairways, at the doors, and in some of the landscaping. A light fixture sample was not submitted. Mr. LaFon expressed the concern that they were squeezing too many units onto the site. He noted there will be no protection for the wall adjacent to the drive. He felt everything was too minimal, that there was too much compromising to squeeze the proposal on the site. Mr. Selvidge noted that Sth Ave. already is crowded and he did not feel this proposal would be a problem. Mr. J^_•hnson noted that if they had put all the parking in front there would bP no problem with the parking, and Mrs. Luster added that the Stzff.encourages that parking be placed in the rear. MR. The applicants had applied for a Conditional Use Permit to have a law office in this existing home. Much of the vegetation on the site was in poor condition and was to be replaced. Several large cedar trees and a row of apple trees would be saved. The Staff recommended additional landscaping. The sign will be at 84th and Maplewood Rd. and the Staff recommended the entire area at that portion of the property be landscaped with bark. They also recommended landscaping around a large existing holly tree. A shed was removed from the site and the carport also was to be removed. Ms. Luster indicated that what was proposed should improve this corner very much. She noted that existing fencing was chain link and she recommended it be slatted with wood to soften the overall impact.
