The extracts you had received from me are recommended standards for use of portable propane appliances. Propane is a safe cooking fuel when used by manufacturer's prescribed standards. There has been only one propane emergency incident this year for all the hundreds of propane appliances in Edmonds and perhaps thousands of seasonal uses. This is not an epidemic but should be a reminder to check your own safe barbecuing habits. The fire department does not regulate barbecue usage. I do not require you to remove your barbecue from the balcony, or your neighbor's, or their neighbor's. I recommended the safest action (removal), provided an option (barbecue area), and made a suggestion to approach your Association in that regard. It is my opinion that the Fire Department is not "libel' for your appliance. If you feel differently you may make your damage claim with the City Clerk (#771-0206). If you and your neighbors choose to use your barbecues on attached balconies, our only desire is that you follow manufacturer's instructions for their prescribed safe and listed storage and use. I am writing this letter in response to the discussion I have had with you and the Fire Marshall regarding the storage/use of propane BBQ's in condos and apartments within the city limits of Edmonds. My initial inquiries were prompted by concerned homeowners to the recent incident of the BBQ propane tank explosion in Edmonds. Both you and the Fire Marshall have been very helpful in answering my questions, explaining the regulations regarding this matter and of sending me a copy of the statute. However, there is one question you were not able to answer and that was the effective date of this regulation. I would like to know this date as I have many concerns regarding how thorough our safety inspections are by your department and how this is going to impact me as a propane BBQ owner living in a condo. As the President of the Richmar Condo here in Edmonds I know that we have yearly safety inspections by the Fire Marshall and that we depend on your department to inform us of the rules and regulations that provide a safe living environment for all the condo residents. We have always taken our safety inspections seriously and have always followed every regulation given us. Many homeowners in our building, and apartment/condo buildings all over town, have had propane BBQ's on their decks for years and this has never been brought to attention as a problem. I am assuming that this regulation must be fairly new or it would have been included in our safety inspection last fall. I feel, however, we still should have received a notice from your department regarding this regulation, since in talking with you on the phone you stated that having propane BBQ's on apartment decks was a violation of the code. On the phone you also stated that your inspections are for the common areas, and do not include entering any private areas and, therefore, would not be able to monitor who L has propane BBQ's or not. Not only does give me grave concern regarding the quality of your insepctions, but it just does not make sense, because; 1. Decks are usually considered a type of common area, are an outside attachment, and they and their contents are clearly visible from an outside inspection, and; 2. Anything that is a safety hazard, or safety regulation is the responsibility of the inspector to bring to the attention of the apartment owner or Condo association, even if it is not readily visible. It almost sounds like this is a regulation that is treated very loosely and if some complexes find out about the regulation and comply by banning the use of propane BBQ's, fine, and if others don't, fine. How fair or safe does this seem to you? My next concern is as a private citizen. Since the condo I live in has had propane BBQ's on it's decks for the 4 1/2 years I have lived here and since the issue of propane BBQ's has never come up at the yearly inspections, there was no reason for us to assume we could not have a propane BBQ like everyone else. My husband and I purchased a very expensive BBQ just 1 1/2 months ago and will now have to get rid of it. There is no way we would have made this purchase had we been informed of this regulation, and as responsible homeowners, there is no way we would even think of not complying with the regulation. This is another reason why the regulation date is of importance to me. I feel that if this regulation has been in force and your department has been remiss or lax in it's inspection, that you are libel for the cost of our BBQ. It is brand new, very costly, and there is no way we could ever recover our money by selling it. We had planned to have it for many years to come and so it was worth the investment to us but if we had been informed of the regulation we would never have purchased it and have looked at something totally different. If this regulation has just been passed and there has been no time for notifying residents or including it in the safety inspections, then this letter is of no consequence to your department, but, if, however that is not true, then I will be glad to meet with you, bring the bill for my BBQ, and discuss the issue with you. AGENDA BA=4-82 Variance to Ordinance 2290, removing the requirements of fire horns to be installed in the back bedrooms at 1070 5th Avenue S., Maplevine Condominiums (continued from November 15, 1982 meeting). Mr. Nolan read the motion from the last meeting on this item and briefly reviewed the situation to bring the new members up to date. Mr. Sparzani explained the reason for this request is because of a difference in interpretation of the ordinance that set the requirement for fire alarms. Since the initial request for the variance, the City has passed a new ordinance to more clearly define the decibel requirements for fire alarms. He stated the Maplevine homeowners felt they met the decibel requirements in the old ordinance but they know they do not meet the minimum 60 decibels that is required in the new ordinance. He also stated that the homeowners felt they were not subject to the old ordinance because it did not specifically state condominiums. He informed the board that although he is president of the homeowner's association, he does not want to be responsible for the whole condominium complex. He stated he can speak for himself but not for the other 26 owners. Mr. Nolan asked the representatives from the Maplevine if they tested each unit and proposed an alternate method to the Fire Chief. Mr. Sparzani stated that.the Fire Marshal was present when the fire alarm company was there to do the testing and the results showed that the units did not meet the 60 decibels. Bill Gallagher from the Maplevine, argued that this building is private home ownership and should not be considered under public safety. Mr. McNerney stated that in every widely recognized code a condominium is considered a multiple occupancy building. Mr. Nolan stated that when this building was built four years ago it meet all the code requirements. When the new ordinance became effective twenty-two buildings were affected, six did not meet the requirements and five of those six have either completed their updating or are in the process. The Maplevine is the only one that hasn't at this point. The area of issue with Page 2 Board of Appeals February 22, 1983 ' the Maplevine owners is the wording of the code, they felt it did not apply to them. Since they submitted their request to the board the City has adopted a revised ordinance changing the wording to more clearly spell out the requirements. The Maplevine Condominium must now meet the minimum 60 decibel reading. The representatives from the Maplevine showed the board members a bell system that can be installed near the bedroom doors and when tested it has a reading of 65 decibels. They stated the Fire Plarshal had observed the testing of these bells and approved of this system. Mr. Sparzani stated that since the City has adopted the new ordinance the Maplevine does not have an appeal. He also stated that there is not 100% approval from, the 27 homeowners of the bell installation and he requested that the Fire Department go to each homeowner to get compliance. He is not responsible for the other homeowners. City Attorney Jim Murphy then explained the function of the Appeals Board and cited the criteria they need to follow when making code modifications. To be audible within the meaning of this section, the required sound level, when measured in each room of any dwelling unit or in every portion of a common area, shall be at 15 decibles above the ambient noise level and in no event less than 60 decibles. WHITELEY MOVED, SECONDED BY MR. PAYNE TO APPROVE THE MARCH 15, 1982 MEETING MINUTES. MOTION CARRIED. AGENDA BA-4-82 Variance to Ordinance 2290, removing the requirement of fire horns to be installed in the back bedrooms at 1070 5th Avenue S., Maplevine Condominiums. Mr. Reeves stated that as far as the building code. is concerned the alarm system met code requirements when the building was completed. The current building code states that the use can be continued if it met the code at the time it was built and the continued use does not impose a hazard to the occupants. This requirement could conflict with Ordinance 2290 which was recently adopted by the City Council. Mr. Eames stated that Ordinance 2290 adopts a number of different codes and Section 3 spells- out specific require- ments': He said it was the Council's intention that this ordinance apply to all multi -family buildings existing as well as under construction. He stated that the reason for this hearing is to determine if this ordinance applies to the Maplevine Condominiums differently than other multi -family buildings and if a certain circumstance is found, this board would have the control to grant a variance. Mr. Olsen reported that recent findings show that the audibility level in older systems does notwake people. When he tested the Maplevine Condominiums it was found to be under 40 dba and the minimum is set at 60 dba. There was some discussion on the interpretation of what the minimum reading would be; 60 dba, or 15 dba above the ambient reading, and also what the ambient reading would be. Mr. Olsen stated that normal coversation or an alarm clock is 45 dba. When the unit was tested, the meter was placed on the bed with the bedroom door and the hall door closed and the reading did not register on.the meter (40 dba is the lowest reading on the meter). The fire department's recommendation is to place a fire horn outside the bedroom door which would get a reading of 60 dba. When this ordinance became effective there were 22 multi -family buildings that were affected by it, only six of them did not meet the requirements and five of those six are in the process of updating their systems. Frank Taylor, a tenant at the Maplevine, stated there are smoke detectors in each unit, fire horns in the hallways that are either activated by a pull station or by heat, there is emergency lighting in the stairways, heat BOARD OF APPEALS. MINUTES NOVEMBER 15, 1982 PAGE TWO detectors in the garage and one in each storage room, and fire extinguishers placed throughout the building. Several of the tenants where in attendance at this hearing and all of them felt the Maplevine Condominiums have an adequate fire protection system. Many letters were also received from tenants objecting to this fire horn requirement. One tenant stated that a fire horn placed outside the bedroom door would be too loud and the conduit running from the front door to the bedroom door would be very unattractive. Mr. S.parzani, President of the Homeowner's Association, presented the board members with a prepared statement from the homeowner's association outlining the fire protection systems existing in the building and expressing their opinion that these systems are more than adequate for the life safety of the tenants. One tenant stated that he was told the system at the Maplevine was better than 90% of other multi -family buildings in Edmonds. Mr. Olsen stated the Maplevine has some features in their system that are not required by code, however this does not waive them from those features that are required. Mr. Whiteley asked if all the units did not meet the 60 dba reading or if it was only a few and Mr. Olsen replied that only one unit was tested so it was hard to say if any of the other units meet the requirement. It was suggested that the homeowners could get someone from an alarm company to come out and test each unit. The board members felt they could not find a special circumstance in this case and would have to abide by the ordinance that specifically stated these readings should be 60 dba. Jack Wallace, a tenant at the Maplevine, stated he works nights and when these horns were being tested during the day, they woke him up. Mr. Sparzani stated that this should be dealt with on an individual unit basis. The additional fire horn requirement should only be placed on those units that do not meet'the 60 dba reading. John Barrett, also a tenant of the Maplevine, stated that when he bought his unit it complied with the fire code, now a new ordinance is adopted which means the fire protection system has to be upgraded to 60 dba and asked what will happen if the City decides to up the dba reading in another year or so. He felt these units are individually owned by the tenants and it would be up to the owner on the fire protection system. MR. PAYNE MOVED, SECONDED BY MR. WHITELEY TO CONTINUE THIS. MEETING TO THE THIRD MONDAY IN DECEMBER, DECEMBER 20,.1982, IN ORDER TO SUBSTANTIATE MORE INFORMATION ON BA-4-82. Mr. Reeves commented that further than testing each unit, the homeowner's association with help from an alarm contractor, should propose an alternate method to the Fire Chief. If the proposal is not acceptable to the Fire Chief then prehaps the alternate would be something for the board to consider if necessary. MR. There are 2 fire alarm bells on each floor in addition to fire alarm bells in the passageways and entrance halls; 14 i-: total. This..alarm system is an approved type with a battery —operated backup. According to the Life Safety Code, page 101-70, paragraph 7-6.3.3.3., these bells must "be effectively heard above the ambient -noise level obtained under nor;al conditions of occupancy". The ambient noise level of the Mapleaine is extremely low. It is located on a residential street and is bounded on one side by a very quiet dead end street. On several occasions when the alarm system has been sounded, it was clearly heard by all, in, around and nearby the build— ing and even cars passing in the street have stopped to offer help. We also have fire extinguishers placed throughout tt.e building. The condominium owners have been polled and it is the.general opinion of the individual owners that the current safeguards are more than adequate for life safety. In place is a loud alarm system actuated by smoke and heat detectors. It is so loud that a police car cruising on 5th Avenue heard the alarm when it actuated one day. The officers called the Fire Department. Each unit has a heat -smoke detector; and fire extinquishers are placed strategically throughout the building. Recently, emergency lights, battery operated, have been placed in all areas deemed adequate by the Homeowners Association. I have heard of no citation or requests by the Fire Department in the last.four years. I believe the new ordinance poses too many problems for established condominiums that have installed systems which were adequate systems up to now. This matter has been brought to my attention because your buildings are still not in compliance with this law in. the following respects: Emergency lighting and the fire alarm system has not been up -graded. I.am sure that I don't need to elaborate upon the need for compliance with the -Uniform Fire Code. It is a matter of insuring the safety of the occupants of your building. The City of Edmonds is charged with the duty of protecting its, citizens from fire hazards and cannot ignore non-compliance with its fire code. Failure to comply with the Uniform Fire Code of the City of Edmonds is a misdemeanor, punishable by up to $500 and/or ninety days in jail. Furthermore, each day that a violation exists constitutes a separate violation subject to these penalties. If within ten days of the date of this letter you have not corrected this violation of the fire code and notified the Edmonds Fire Marshall of your compliance, I will have no choice but to file a criminal citation in South District Court to seek redress of this situation. Option 3: Buildings provided with automatic sprinkler protection in selected areas; Option 4: Buildings protected throughout by an approved automatic sprinkler,'. system. Paragraph 19-1.1.2 identifies four different ways of arranging apartment buildings for life safety that are acceptable to the Code. These four systems are: 1. Buildings without fire suppression or detection systems; 2. Buildings with an automatic fire detection system; 3. Buildings provided with an automatic sprinkler system in corridors only; and 4. Buildings protected by a total automatic sprinkler system. In the'1976 Edition of the Code, Section 11-3 covered both new and existing apartment buildings, with 11-3.1 to 11-3.4 providing general requirements for all apartment buildings, and I1=3.5 through 11-3.8 each covering one of the four options. In that edition, every apartment building was required to meet 11-3.1 through 11-3.4, and any one of 11-3.5 through 11-3.8. This arrangement resulted in a considerable amount of cross-referencing — not only in Section 11-3. but also in Sections 11-1, 11-2, and Chapter 6 — and a sometimes very confusing text resulted. Since the 1981 Edition was undergoing extensive editorial revision to provide separate chapters for new and existing buildings and also to split up the residential chapter, it was decided to reorganize the apartment chapters to make them easier to use and eliminate cross-referencing where possible. As a result of this restructuring, all sections of Chapter 19 apply to all existing apartment buildings. There are various paragraphs and parts of paragraphs that apply to different options, or only to housing for the elderly."•Every apartment building, whether or not it -contains apartments for the elderly, must meet one of the four options. The best approach in using this portion of the Code is to base a design on Code Table 19-1 or 19-2 and, when necessary, to refer to the appropriate paragraph to verify specific details. Either Table 19-1' or 19-2 provides almost all the design information needed to meet this portion of the Code and both may be found at the end of this chapter. The committee, recognizing the equivalency provisions found in Section 1-5 of the Code, saw a need to establish in advance, four equivalent Code -acceptable schemes to provide a high degree of design flexibility. The equivalencies developed were based on the committee's professional judgment, the results of full-scale fire tests conducted st the National Bureau of Standards, and a review of the most recent fire exneriences. EXISTING APARTMENT BUILDINGS 583 These designs are considered to be equivalent to each other in providing a minimum level of life safety for apartments. Because some systems have additional protective capability (detectors, automatic sprinklers, etc.), higher building heights and larger building areas were permitted. Where the design provided only the minimum level of safety called for in the Code, lower building heights and smaller building areas were specified. This overall approach provides_ one of the first "system" design attempts to be codified. Whereas a total system would have many design approaches, this is a more limited, or bounded, system in that only four different approaches are available. Yet, a designer can identify an appropriate design from the four approaches uased on the building's size, height, and arrangement. This provides the designer an opportunity to put together a safety approach that best fits the building, rather than fitting a building to a single codified design criterion. However, this system works only when the designer and the authority having jurisidiction agree on the plan selected at the earliest design phase. 19-1.1.3 Existing apartments for the elderly as defined in 19-1.3.1 shall meet the requirements for existing apartment houses as provided in this section unless otherwise noted. As given in 19-1.3.1, apartments for the elderly are apartment buildings specifically designed for housing elderly people; however, these people must be capable of self-preservation. If the occupants are not capable of self-preservation, the building must comply with health care occupancy requirements. Apartments for the elderly must comply with all the requirements for apartment buildings, using one of the four options, in addition to special provisions for apartments for the elderly which are given where appropriate throughout the chapter. 19-1.1.4 Every individual living unit covered by this section shall at least comply with the minimum provisions for windows of Chapter 22, One- and Two -Family Dwellings. Exception: The requirement of Section 22-2 for a second means of escape may be waived for buildings over six stories provided that adequate means for smoke ventilation are employed. 19-1.2 Mixed Occupancies. 19-1.2.1 Where another type of occupancy occurs in the same building as a residential occupancy, the requirements of 1-4.4 of this Code shall be applicable. 19-1.2.2 For requirements on mixed mercantile and residential occupancies, see 25-1.2. 19-1.3 Definitions. 19-1.3.1 Terms applicable to this chapter are defined in Chapter 3 of this Code; where necessary, other terms will be defined in the text as they may occur. SECTION 19-3 PROTECTION .19-3.1 Protection of Vertical Openings. 19-3.1.1 Every stairway, elevator shaft and other vertical opening shall be enclosed or protected in accordance with 6-2.2 or provide means of satisfying the requirements of Section 2-9. :'Exception No. 1: Unprotected vertical openings connecting not more than three floors may be permitted in accordance with the conditions of 6-2.2.3.1, Exception No. Since 6-2.2.3.1, Exception No. I requires total automatic sprinkler protection, the exception could only be used in buildings using Option 4. Exception No. 3: Stairway enclosures shall not be required where a one-story stair connects two levels within a single dwelling unit, guest room or suite located above the level of exit discharge. See also 19-2.11.1 and 19-2.11.4. Exception No. 4: An atrium may be utilized in accordance with 6-2.2.3.1, Exception No. 2. Proper and Improper Location of an Alarm Box. 7-6.2.5 Each manual fire alarm station on a system must be accessible, unobstructed, visible, and of the same general type. 7-6.2.6 Where a sprinkler system provides automatic detection and alarm system initiation it shall be provided with an approved alarm initiation device that will operate when the flow of water is equal to or greater than that from a single automatic sprinkler. 7-6.3 Signal Notification. 7-6.3.1 As required in Chapters 8 through 30, actuation of the system shall provide signal notification of fire or other emergency as required by the authority having jurisdiction. (a) Alert occupants (b) Notify local fire brigade (c) Notify fire departments. Acceptable means of transmitting an alarm to the fire department are: (a) A connection of the building alarm to the municipal fire system. (b) A connection of the building alarm to an approved central station. (c) An approved remote station connection to a municipal or other alarm headquarters which is manned 24 hours a day. Fire alarm equipment installed for the notification of occupants of a building, localities under the protection of a regularly organized fire department or private fire';; brigade, can be arranged to give automatic transmission of alarms (either directly or through an approved central office) to the fire department or brigade upon operation of an alarm -sending station or system. When no such connection is provided, a fire , alarm box arranged to signal the fire department could be installed either at the main' entrance to the building, at the telephone switchboard, or somewhere outside the ; building plainly visible day or night and conveniently accessible from the main' entrance. (Note that while this arrangement is desirable, it is not required by 7-6.3.1 unless the occupancy chapter specifically requires this feature.) 7.6.3.2 Signal notification shall be a presignal or general audible alarm -type system as required by the authority having jurisdiction. When permitted by the authority having jurisdiction, notification may also be by visual signals or permanently recorded printout. Exception: Presignal systems are not permitted where prohibited by Chapters 8 through 30. 7-6.3.3 Notification of Occupants. 7-6.3.3.1 Notification signals for occupants to evacuate shall be by audible signals and, where deemed necessary by the authority having jurisdiction, shall also be by visual signals. Visible alarm devices, in addition to the audible alarms, are desirable in buildings _ occupied by deaf persons. 7=6.3.3.2 The general evacuation alarm signal shall operate throughout the entire building., _Exception No. 1: Where a building is divided by: (1) 2-hour fire barriers into separate fire compartments, or (2) by other means with adequate safeguards against the spread of fire or smoke from one compartment to another, each compartment may "be considered a separate building. Exception No. 2: When total evacuation of occupants is not practical due to 'building configuration, only the occupants in the affected zones shall be initially ­hotified. Provisions shall be made to selectively notify occupants in other zones to efford orderly evacuation of the entire building. Exception No. 2 to 7-6.3.3.2 normally applies to high-rise buildings. It makes irovisions for zoned s,�ged evacuation. Fire alarm systems (automatic, manual) re- quired by this section shall be installed in all buildings specified by the Uniform Fire Code, whether existing or new, by July 1, . 1982. 3. Smoke detectors required by 212-10 WAC shall be installed by July 1, 1982. 4. Installation shall be in accordance with the current city adopted edition of the Uniform Building Code, Uniform Fire Code, applicable National Fire Code. 5. Audible sounding devices will be placed on each floor in sufficient numbers to insure audibility in all areas of the building. 6. Minimum readings on the DBA scale shall be 60 or 15 DBA above ambient readings. 7. In apartment type buildings, audible devices shall be installed in each unit, unless an acceptable alternate is approved by the Fire Chief. -3- Section 4. Section 19.75.175(B) of the Community Development Code is hereby amended to read as follows: B. Commercial Buildings Commercial buildings shall comply with the re- quirements outlined in the Life Safety Code and Uniform Fire Code, as adopted by reference by this chapter. Section 5. LIFE SAFETY CODE HANDBOOK EXISTING APARTMENT BUILDINGS 593 19-3.4.2 Alarms. 19-3.4.2.1 Every apartment building of four or more stories in height or 12 or more apartment units shall have a manual fire alarm system in accordance with Section 1-6. 19-3.4.2.2 In apartments for the elderly, buildings of two or more stories in height or 12 or more living units shall have a manual fire alarm -system in accordance with Section 7-6. Exception: Where all units in a one-story building have direct access to outside at grade. 19-3.4.2.3 Buildings seven or more stories in height shall have an annunciator panel connected with the alarm system to visually indicate the floor of fire involvement. The location of the annunciator panel at an accessible location shall be approved by the authority having jurisdiction. 19-3.4.3 In apartments for the elderly using Option I or 3, in buildings seven or more stories in height, in addition to a manual fire alarm system, an approved means of voice communication between an accessible central point approved by the authority having jurisdiction and the corridors, elevators, elevator lobbies and exits shall be provided. The purpose of the voice communication system is to provide a means for the fire department to contact the building occupants. The system can be used by the building management during nonemergency periods and can consist of speakers at the designated locations. The system can also be used as part of the alarm system if it can provide more than 85 db at the speakers. 19-3.4.4 In buildings using Option 2, four stories or more in height, or with 12 or more units, the alarm system shall be initiated by the automatic fire or smoke detection system, as well as being capable of manual initiation. 594 LIFE SAFETY CODE HANDBOOK 19-3.4.5 In buildings using Option 3, the audible alarm shall be activated upon operation of the sprinkler system as well as manually. 19-3.4.6 In buildings using Option 4, four stories or more in height, or with 12 or more units, the alarm system shall be activated upon operation of the automatic sprinkler system as well as being capable of manual initiation. 19-3.4.7 In apartments for the elderly located in buildings four or more stories in height the fire alarm system shall be arranged to transmit an alarm automatically to the fire department legally committed to serve the area in which the building is located by the most direct and reliable method approved by local regulations in accordance with 7-6.3.4. Where automatic transmission of alarms to the fire department legally committed to serve the facility is not permitted, arrangements should be made for the prompt notification of the fire department or such other assistance as may be available in the case of fire or other emergency. Acceptable means of transmitting an alarm are, in order of preference: (a) .A direct connection of the building alarm to the municipal fire alarm system (b) A direct connection of the building alarm to an approved central station (c) .A telephone connection to a municipal or other alarm headquarters which is manned 24 hours a day. 19-3.5 Extinguishment Requirements. 19-3.5.1 In buildings using Option 3, automatic sprinklers shall be installed in corridors along the corridor ceiling, and one sprinkler head shall be opposite the center of and inside any living unit door opening into the corridor. Exception: The sprinkler head inside living units may be omitted if the door to the living unit has 10 minutes or greater fire resistance and is self -closing. 19-3.5.2 The sprinkler installation required in 19-3.5.1 shall meet the requirements of Section 7-7 and Standard for the Installation of Sprinkler Systems, NFPA 13, in terms of workmanship and materials. 19-3.5.3 The installation of the corridor sprinklers required in 19-3.5.1 shall not exceed the maximum spacing and protection area requirements of Standard for the Installation of Sprinkler Systems, NFPA 13. 19-3.5.4 Buildings using Option 4 shall be protected throughout by an approved automatic sprinkler system. I changed one battery which had been corroded by either salt air or charge circuit voltage. As I began inspecting the Fire alarm panel I determined that the bell circuit supervision function had been defeated by means of the end of line resistor being placed directly across the bell output terminal. Noticing this lack of supervision I went ahead and checked field wiring and found that inadequate type of wire (16 A.1�J.G. type T.F.) was used in place of 105 degree centigrade -fire wire that is required by N.F.P.A. article # 760-16 (a) and (b). Also upon inspection of wiring methods I found that circuits had been "T-Tapped" which will also defeat the supervision function. After completing inspection of wiring methods I discussed the problem with the owner, Frank Taylor, and was advised to return the system to the way it was when I first began working on it, I did so. L POSITION STATEMENT TO: City of Edmonds Board of Appeals FROM: Edmonds Fire Department DATE: February 14, 1978 SUBJECT: BA-1-78 JABIL DEVELOPMENT CORPORATION Appeal against access easement and standpipe' requirements. ACCESS EASEMENT: Because of the configuration of the proposed building and the proximity of the property lines to the building, the Fire Department was unable to obtain sufficient fire access easement. The developer (Mr. Taylor) agreed that if the Fire Department would compromise and accept easement at the northwest corner which is only suitable for manual access, he would grant from an adjoining piece of property which he also owns an EMERGENCY fire access easement parallel with the south wall of the building. The purpose of the easement is to allow the placement of the Fire Department's elevated platform (Snorkel) in order that fire- fighting and rescue equipment could reach the roof, windows, and lanais. After awarding the Fire Department the easement, Mr. Taylor submitted plans to put parking and planting areas directly on the easement. The Fire Department denied these plans because they would defeat the purpose of the easement. STANDPIPE REQUIREMENTS: The Uniform Fire Code states that the Fire Chief shall designate the type and number of fire appliances to be installed upon all buildings. Division III INSTALLATION AND MAINTENANCE OF FIRE PROTECTION SYSTEMS AND APPLIANCES Installation See. 13.301. (a) The Chief shall designate the type and number of fire appliances to be installed and maintained in and upon all buildings and premises in the jurisdiction other than private dwellings. 'Phis shall be done according to the relative severity of. probable fire, including the rapidity with which it may spread. Such appliances shall be of a type suitable for the probable class of fire associated with such build- ing or premises and shall have approval of the Chief. (b) In occupancies of an especially hazardous nature, or where special hazards exist in addition to the normal hazard of the occu- pancy, or where access for fire apparatus is unduly difficult, additional safeguards may be required consisting of additional fire ap liance units, more than one type of appliance, or special systems suitable for the protection of the hazard involved. Such devices or appliances may consist of automatic fire alarm systems, automatic sprinkler or water spray systems, standpipe and hose, fixed or portable fire extinguishers, suitable asbestos blankets, breathing apparatus, manual or automatic covers, or carbon dioxide, foam or other special fire -extinguishing sys- tems. Wet Standpipes Sec. 3804. (a) General. Wet standpipes shall comply with the re- quirements of this Section. (b) Where Required. Wet standpipes extending from the cellar or basement into the topmost story shall be provided in Groups A and R, Divisions 1 and 2, Occupancies with an occupant load exceeding 1000; in Groups C, D, E, F, G, and H Occupancies four or more stories in height; and in Groups E and F Occupancies having a floor area exceed- ing 20,000 square feet per floor. EXCEPTION: 1. Wet standpipes are not required in buildings equipped throughout with an automatic fire -extinguishing system. 514 The Fire Chief required wet standpipes after considering the following facts: 1. Al Albers, arriving later, asked that his statement be amended from "...a hydrant has to be installed within 300 feet of the property" to read that "the fire hydrant requirement within a residential development has to be within every 1000 feet." The appeal ,was against access easement and standpipe requirements. The property is located at 1070 5th South and 1115 4th Avenue South. The variance request is for removal or modification of easement and removal of standpipe requirement of the Fire Depart- ment. The owner felt this was a hardship and the building is a three-story building which does,:not require standpipes. Frank Taylor, President of the Jabil Development stated he didn't know about the standpipe requirement until they picked up their permit which showed the standpipe at two std-irwells. They were under the understanding that under the Building Code, this was a three-story building. They checked with the Building Depart- ment, and the architects and it was confirmed that a three-story building did not need standpipes. Don Council, an employee of Donald R. Westlin, Architects, stated that the classification of this particular building was three-story with the use of a concrete floor system above the parking level. This is a three- hour separation and there were three stories above. He believed this was also classified by the City as a three-story building. Because of this being classified as a three-story building, they felt the standpipe should not be an issue. We do have the three- hour separation. Mr. Taylor included that this building has a basement that is almost entirely enclosed except for the openings I for the garages. Harry Whitcutt stated that the Building Division rated it accord- ing to Sec. 1102,UBC as three stories plus basement. At this time, Einer Johnson was asked to give the Fire Department summary. BOARD OF APPEALS MINUTES February 21, 1978 Page 1 of 4 Einer Johnson stated that he didn't think that the three-hour separation has anything to do with a three-story building. If ACV the Building Department deemed this as a three-story building r then we will go along with this. I would like to point out in ,s our position statement, we have considered asking for standpipes. ' Because of the problems in gaining access to the court area.with a fire engine or an elevated platform that was one of our consid- erations for calling for a standpipe. The U.F.C. Sec. 13.301 states that the Chief will designate the type and number of fire appliances to be installed to maintain the impact of all buildings and residences within the premises in a jurisdiction other than private dwellings. I feel that this is a key part. This section of the Code was then quoted further. Our only con- sideration was not that it was just a three-story building but the fire access problem. This is for a wet standpipe. U.F.C. stated that having 20,000 square feet shall provide a we-t stand- pipe.. There is 12,664 sq.ft. in basement, the floors themselves are 15,470 sq.ft. When reading the section of the Building Code I wasn't trying to say that the Fire Department said that the building has 20,000 sq.ft. I was trying to say that the Fire Chief is requiring wet standpipes because there is building on four levels. It counts close to the 20,000 sq.ft. Coupled with the fact of the restricted access easement to get the right kind of equipment into the court, those are the reasons the Chief made these decisions. In my opinion, that apartment certainly does have special hazards any time you start parking autos under an apartment house. John Stanford explained that when F.1 exceeds 20,000 sq. ft. this does require wet standpipes. Both issues were considered now. Frank Taylor submitted a letter (attached). This explained the situation as Mr. Taylor saw it. Initially when they first got comments back from the Fire Departmen.t they wanted access to the Larson property. This property has access to our•.courtyard. We asked Mr. Larson to write the Fire Department to allow access. This wasn't good enough because they wanted an easement. It was decided that the 22 foot strip at the northeast corner would be paved with asphalt so a truck could get back into this. It was also a condition of the Building Department. We gave 25 foot easement on the north side of the south property for access. We would like that rescinded or abated. Carl Larson owner of the property north of the Taylor property stated that Mr. Harry Nelson, his architect, asked him for an easement but he wouldn't give an easement because of it being a burden on his property. There was discussion on access for fire truck and snorkel. Plans were shown.to all members of the board. After much discussion on access and easements, A MOTION WAS MADE BY JACK STANSFIELD, SECONDED BY AL ALBERS THAT THE STANDPIPE REQUIREMENT BE WAIVED. MOTION CARRIED. A MOTION WAS MADE -BY C.E. The variance requested is t be excused from placing fire sprinkler heads in down direction on along front 16 feet of 10 raquetball courts. All other por 'ons of the building shall be fully fire sprinklered in conf mance with the Code. The specific provision of the Code in vol d is UBC Sec. 3802(d) requiring fire sprinklered buildings. The re ons for this request are (1) Sprinklers in this area are acts ated by balls striking fusible lines, (2) There is very little c bustible material in the courts, (3) The sprinklers interfere ith the game. Mr. Goldberg showed a preliminary sketch of the building. This is a court fo. the game of racquetball. Under the Code requirements he said we mus sprinkle the whole building. In this game, the balls are hit w th great force, approximately 70 - 140 m.p.h. The impact of th e balls many times will set off the mechanism. This is also a hir erance to the game itself. The floors will be hardwood, the w is will be covered with a non-combustible material.
