INTRODUCTION Diamond Parking,*3161 Elliott Avenue, Seattle, Washington, 98121, and hereinafter referred to as Applicant, has requested approval of a conditional use permit to allow a temporary commercial parking lot to be located at 109 Main Street, Edmonds, Washington. The subject property is more particularly described as: Lots l & 2, Block 12, Plat of Edmonds, Snohomish County. The owner of the property is the estate of Fred Eve, 400 Dayton Street, Edmonds, Washington, 98020. A hearing on the request was held before the Hearing Examiner of the City of Edmondson January 16, 1986. At the hearing the following presented testimony and evidence: Duane Bowman Planning Dept. The application is for the approval of a conditional use permit to allow a temporary commercial parking lot at 109 Main Street, Edmonds, Washington. (Staff report.) 2. The subject property is an undeveloped 14,400 square foot parcel of land that is located on the northwest corner of Main Street and Second Avenue North in downtown Edmonds. The site is level and is currently -undeveloped. (Staff report.) 3. Section 17.50.090(A) of the Edmonds Community Development Code (ECDC) grants the Hearing Examiner authority to issue a condi- tional use permit for a temporary parking lot in a B- and C- zone. The permit shall be valid for one year with the right to request in writing for an extension of an additional year. (ECDC.) 4. The subject property is zoned BC (Community Business) and is _subject to the interpretation of Section 17.50.090 of the ECDC. (Bowman testimony.) 5. In order for a c.onditional use permit to be granted within the City of Edmonds the criteria as set forth in Section 20.05.010 of the ECDC must be met. These criteria include: A. The proposed use must be consistent with the Comprehen- sive Plan of the City of Edmonds; B. The proposed use in its location must be consistent with the purposes of the zoning ordinance in which the pro- perty is located; C. The proposed use must not be significantly detrimental to the public health, safety or welfare, nor injurious to nearby private properties or improvements; and, D. The Hearing Examiner shall determine wheuher the condi- tional use permit shall run with the land or shall be personal. (ECDC.) G. The subject property is west of the U.S. Post Office in down- town Edmonds. Other properties in the area are primarily commercial with some single-family development to the north. (Bowman testimony.) 7. The Comprehensive Policy Plan Map of the City of Edmonds designates the subject property as Commercial/Business. (Staff report.) Access to -the lot will be off an alley between 2nd Avenue and Sunset Avenue. The traffic within the parking lot will be one way and will exit at the northern por- tion of the lot and into the alley between 2nd Avenue and Sunset Avenue. There will also be an entrance and exit to the lot off 2nd Avenue North. (Bowman testimony.) 9. There will be no curb cuts made for the parking lot off Main Street. There will be one curb cut for the lot off 2nd Avenue North. The curb cut off 2nd Avenue North existed prior to the development of the lot as a temporary parking lot. (Bowman testimony.) 10. The Architectural Design Board has reviewed the proposed park- ing lot and has recommended approval of the project. (Staff report.) 11. The Planning Department of the City of Edmonds recommended approval of the conditional use permit subject to the following conditions: 1. Comply with 'all Architectural Design Board requirements. 2. The conditional use permit should be good for a period of one year, with the right to one year extension. If after two years, the Applicant seeks to make the parking lot permanent, a new application for a conditional use permit must be submitted. 3. The permit should not be transferable. 12. No opposition testimony was received in this matter. CONCLUSIONS 1. The application is for the approval of a conditional use permit to allow a temporary commercial parking lot at 109 Main Street, Edmonds, Washington. 2. Because the proposed parking lot is going to be temporary a conditional use permit is required per Section 17.50.090 of the ECDC. 3. The criteria for the granting of a conditional use permit are set forth in Section 20.05.010 of the ECDC. The appli- cation satisfies these requirements. 4. The requested conditional use permit is consistent with the zoning ordinances of the City of Edmonds and in particular the Community Business (BC) zone. 0 Findings and DecisiGii of the Hearing Examiner of the City of Edmonds Re: CU-57-85 Page 4 5. The requested conditional use permit is consistent with the Comprehensive Plan of the City of Edmonds and the Commercial/ Business designation and in particular Section 15.20.010 of the ECDC. 6. The requested use will not be detrimental to the public or to nearby private properties or improvements. 7. The Planning Department of the City of Edmonds has recommended approval of the conditional use permit. DECISION Based upon the preceding Findings of Fact and Conclusions; the testimony and evidence submitted at a public hearing; and, upon the impressions of the Hearing Examiner at a site view, it is hereby ordered that the requested conditional use permit for the allowance of a temporary commercial parking lot at 109 Main Street, Edmonds, Washington, should be granted subject to the following conditions: 1. The Applicant is to comply with all Architectural Design Board requirements. 2. The conditional use permit is valid for one year. The Appli- cant may request in writing for an extension of the permit for an additional year after the original one year expires. 3. If the Applicant seeks to make the parking lot permanent a new application for a conditional use permit must be sub- mitted and processed. 4. The conditional use permit is not transferable. 5. The Applicant shall be responsible for the upkeep of the lot. Included in this responsibility will be providing receptacles for garbage. Further, the Applicant shall be responsible for policing the lot to remove any garbage on site. The approved landscaping has not been installed per plan and the planting areas are in need of weeding. On February 25, 1988, the Applicant filed a request for an one year extension for the parking lot. V. CONFORMANCE TO REVIEW CRITERIA OF CHAPTER 20.05 Comprehensive Plan As conditioned, the proposed use does not appear conflict with the Comprehensive Plan. Zoning Ordinance As conditioned, the proposed use is consistent with the purposes of the zoning ordinance and the BC zone district. Transferability The permit shall not be transferable. VI. STAFF DECISION: Staff finds that, with proper conditions, the proposed temporary parking lot should be allowed one one year extension. The requested extension for conditional use permit #CU-57-86 is hereby granted, subject to the following condition: 1. The Applicant shall clean up all planting beds to conform to the original planting plan approved by the Edmonds Architectural Design Board. This work must be done within two weeks of the final decision date of this extension. Failure to comply with this condition shall void this extension approval. 2. The extension is good for one year, until May 31, 1989. This extension request is granted subject to the authority granted the Planning Staff as outlined in Chapter 17.50.090 of the ECDC. The Conditional Use Permit was approved with the condition that all Architectural Design Board requirements be met. The Architectural Design Board, under file ADB-110-85, approved the project with the condition that landscaping be installed and maintained. On May 16, 1988 the Hearing Examiner approved a one year extension of the Conditional Use Permit, with the condition that the applicant shall clean all planting beds and install plantings to conform with the original landscape plan approved by the Architectural Design Board. As of this date, the required landscape improvements have not been completed. Please note that the Conditional Use Permit can be revoked if the conditions are not met.
