I am w�ting this letter in response to your letter to WSDOT, dated August 11, 2004, regarding the Syd Locke development at 110 Pine Street. In 1995 Mr. Locke constructed a garage on the subject property with associated driveway and drainage improvements. The location of this development is in the southeast corner of the SR 104/Pine Street intersection, in the City of Edmonds. The City of Edmonds approved plans and permitted the development in 1995, with a condition that the approval of WSDOT is needed for any work done in the limitted access area fronting the subject property along Pine Street. Regarding WSDOT approval for the drainage improvements, we concur with the email sent from WSDOT to the property owner (Mr. Syd Locke), dated February 14, 2000 that no permit is needed from WSDOT to convey stormwater runoff from the subject development to the existing SR 104 roadside ditch and culvert by extending the existing 18 inch culvert pipe. The review by WSDOT of this development's drainage system shows no significant impact due to stormwater runoff from thegarage and driveway development. No sto-r.m. rater detention system is needed for this development. Regarding the westerly asphalt driveway, constructed for the garage to access Pine Street, WSDOT does not require the property owner to remove this driveway and does not require a new curb, gutter and sidewalk to be constructed along Pine Street at this location. However, we do require the fence bordering the limited access property line fronting Pine Street be replaced as originally erected by the State. An ornamental type fence proposed by the property owner is not acceptable to WSDOT and we require the fence be replaced with a chain link fence "Type 3" (see attached fence guidelines). Mr. Locke must use what space is available to him on his own property for a vehicle turn -around area for access to the garage constructed on his property. I have repeated your numbered questions and provided answers below. 1) Does the state have objections to Mr. Locke directly connecting his storm sewer system into the state's storm system? According to our records, the last time we reviewed any information from Mr. Locke concerning his storm sewer system was in 2002. In order for us to make a determination, we will need to see Mr. Locke's current plans and hydraulic calculations for this system to make sure that all current regulations and standards are met. After reviewing this information, a decision on Mr. Locke's ability to hook up to our facilities can be made. 2) Rather than removing the driveway, would the state be willing to accept a barrier over the driveway instead? Or would the state be willing to accept a temporary lease with Mr. Locke that would stay in effect only until planned improvements at SR 104 and Pine Street take place? Mr. Locke cannot continue to use the driveway in question. In 1970, WSDOT purchased the necessary right-of-way from Marian Locke and Lillian Kelly for the construction of SR104. When the state purchased this land, it also purchased the access rights along SR104 and along a section of Pine street. A barrier should be installed to stop the use of the encroachment and the driveway will need to be removed. WSDOT cannot grant a temporary lease for the same reasons a permanent access cannot be permitted. Mr. Dave Orvis March 23, 2004 Page 2 3) Could the State waive the requirement for replacing the fence? The fence must be replaced. The fence provides a deterrent to random crossings of SR104 and defines the limits of the state owned right-of-way. It also serves to deter illegal breaks in access control as well as stop private use of public right of way. Waiving the replacement of the fence would also be an illegal gift of public funds. You also asked an additional question "How could he (Mr. Locke) have know about an agreement between the city and the state?". It would not be necessary for him to know about any agreements between the city and the state. When WSDOT purchased the access rights, the restrictions were recorded on the property deed and are a permanent encumbrance on the property. The property owner was compensated for the 6,930 square feet of land that was acquired and for the loss of access rights. I hope this information will be useful to you as you consider this issue. The following is the history behind the cabinet location. In 1969 WSDOT began purchasing Right of Way for the new SR 104 limited access highway to connect to the Edmonds ferry terminal. In 1970 WSDOT purchased 715 sq. feet from Marian Locke's 0.36 acre property at the corner of 2nd Avenue and Pine Street. At the same time 6,930 sq. feet were purchased from Lillian Kelly's 0.27 acre property at the corner of I' Avenue and Pine Street. WSDOT also purchased the access rights extending approximately 275 feet from the centerline of the new SR 104 east along Pine Street. Lillian Kelly's property was now very small (4,800 sq. feet) and land -locked due to the purchased access rights, so at some point the land was sold to Ms. Locke and the Kelly house was removed. On July 7, 1970 WSDOT granted Marian Locke an additional access, at Pine Street Station 14+70 in the limits of WSDOT access control. The access is as far away from the intersection as possible and is permitted as a Type `A' approach, 14 feet wide, for the sole purpose of serving a single family residence. Marian Locke now had a 0.46 acre parcel with one house at the corner of Pine Street and 2„ d Avenue. During the construction of SR 104 WSDOT installed an electrical service cabinet on Pine Street within the property WSDOT had purchased. The cabinet was located where traffic would least likely hit it, and away from any homes or structures. The cabinet's location also took into account the possibility that the intersection of Pine Street and SR 104 could someday be improved to a major intersection with additional turn lanes. The cabinet would not need to be relocated. On January 5, 1978 WSDOT relinquished the purchased property along Pine Street to the City of Edmonds, including a statement regarding that the city is to maintain the access control where indicated on the Right of Way Plans. WSDOT has maintained this cabinet since it's installment, it services the illumination on SR104. Since this portion of SR 104 is access controlled WSDOT has the maintenance responsibilities of this highway, instead of the city. In the early 1990s Mr. Sid Locke (son of Marian) built a second home on the property and subdivided the property, taking residence in the new home. The new home utilizes the access granted by WSDOT on Pine Street at Station 14+70. The new home was built right behind the service cabinet, removing all existing trees and shrubs around the cabinet. In 1994 the older home on the corner of Pine Street and 2°d Avenue was sold to the Freimark family. At some point Mr. Locke applied to the city for an additional access on Pine Street which the city errantly granted in the access control area. Mr. Locke built an additional residence and garage on his property. Mr. Locke also installed a picket fence and landscaping on the property purchased by the state, encroaching on public property. This year WSDOT is designing a project to install cameras on SR 104, to which power and data cables will come from the existing electrical service cabinet on Pine Street. During the design process it was noticed that WSDOT technically does not have an easement from the city to work on this cabinet so a "Permanent Easement" request was submitted to the city to clear up this issue. On March 13, 2001 the Edmonds City Council decided to grant WSDOT a temporary easement, to expire April 2, 2002. The Council stated that they would like WSDOT to assess the likelihood of moving the service cabinet away from Mr. Sid Locke's home since it does not look attractive in the "front yard" of his home. WSDOT cannot justify this relocation as a reasonable expenditure of public transportation funds since it is for aesthetic purposes only. Current estimates place the relocation costs (design plus construction) at approximately $100,000. If Mr. Locke or the city would like to fund the cabinet relocation WSDOT would consider the relocation. The proposal to create a new multi -modal transit center at the UNOCAL Pier project would likely require the redesign of the SR 104 / Pine Street intersection. Perhaps including this cabinets relocation as part of that project would be a minimally incremental cost, however that project is not yet approved and could be five to ten years from construction. We ask that the city grant WSDOT's original request of a permanent easement to the service cabinet and that the access on Pine Street that the city errantly granted to Mr. Locke be removed. Mr. Locke's easterly driveway onto Pine Street is located appropriately and was previously approved by WSDOT. The driveway to the west was constructed by Mr. Locke and in doing so he admits to tearing down a chain link fence erected by the State. The westerly driveway was constructed without an access permit from WSDOT and must be removed and the fence restored whether or not Mr. Locke gets a permit from the City of Edmonds for this project (see the enclosed letter from WSDOT dated February 27, 2002). I asked what the turn around time would be and whether it could be expedited. He said depending on the type of work being done, he would route the application to all applicable departments but cannot control review time. He did say they have 21 days to do the initial review. Later today I contacted Sandra Kortum, WSDOT Development Services (206-440-4911), explained what I was interested in and asked if they prefer the developer or us to submit the drawings and traffic control plan for review. The following is the history behind the cabinet location. Dq lkx In 1969 WSDOT began purchasing Right of Way for the new SR 104 limited access highway to Po !j connect to the Edmonds ferry terminal. In 1970 WSDOT purchased 715 sq. feet from Marian Locke's 0.36 acre property at the corner of 2nd Avenue and Pine Street. At the same time 6,930 sq. feet were purchased from Lillian Kelly's 0.27 acre property at the corner of 1'` Avenue and Pine Street. WSDOT also purchased the access rights extending approximately 275 feet from the centerline of the new SR 104 east along Pine Street. Lillian Kelly's property was now very small (4,800 sq. feet) and land -locked due to the purchased access rights, so at some point the land was sold to Ms. Locke and the Kelly house was removed. On July 7, 1970 WSDOT granted Marian Locke an additional access, at Pine Street Station 14+70 in the limits of WSDOT access control. The access is as far away from the intersection as possible and is permitted as a Type `A' approach, 14 feet wide, for the sole purpose of serving a single family residence. Marian Locke now had a 0.46 acre parcel with one house at the corner of Pine Street and 2nd Avenue. During the construction of SR 104 WSDOT installed an electrical service cabinet on Pine Street within the property WSDOT had purchased. The cabinet was located where traffic would least likely hit it, and away from any homes or structures. The cabinet's location also took into account the possibility that the intersection of Pine Street and SR 104 could someday be improved to a major intersection with additional turn lanes. The cabinet would not need to be relocated. On January 5, 1978 WSDOT relinquished the purchased property along Pine Street to the City of Edmonds, including a statement regarding that the city is to maintain the access control where indicated on the Right of Way Plans. WSDOT has maintained this cabinet since it's installment, it services the illumination on SR104. Since this portion of SR 104 is access controlled WSDOT has the maintenance responsibilities of this highway, instead of the city. In the early 1990s Mr. Sid Locke (son of Marian) built a second home on the property and subdivided the property, taking residence in the new home. The new home utilizes the access granted by WSDOT on Pine Street at Station 14+70. The new home was built right behind the service cabinet, removing all existing trees and shrubs around the cabinet. In 1994 the older home on the corner of Pine Street and 2nd Avenue was sold to the Freimark family. At some point Mr. Locke applied to the city for an additional access on Pine Street which the city errantly granted in the access control area. Mr. Locke built an additional residence and garage on his property. Mr. Locke also installed a picket fence and landscaping on the property purchased by the state, encroaching on public property. This year WSDOT is designing a project to install cameras on SR 104, to which power and data cables will come from the existing electrical service cabinet on Pine Street. During the design process it was noticed that WSDOT technically does not have an easement from the city to work on this cabinet so a "Permanent Easement" request was submitted to the city to clear up this issue. On March 13, 2001 the Edmonds City Council decided to grant WSDOT a temporary easement, to expire April 2, 2002. The Council stated that they would like WSDOT to assess the likelihood of moving the service cabinet away from Mr. Sid Locke's home since it does not look attractive in the "front yard" of his home. WSDOT cannot justify this relocation as a reasonable expenditure of public transportation funds since it is for aesthetic purposes only. Current estimates place the relocation costs (design plus construction) at approximately $100,000. If Mr. Locke or the city would like to fund the cabinet relocation WSDOT would consider the relocation. The proposal to create a new multi -modal transit center at the UNOCAL Pier project would likely require the redesign of the SR 104 / Pine Street intersection. Perhaps including this cabinets relocation as part of that project would be a minimally incremental cost, however that project is not yet approved and could be five to ten years from construction. We ask that the city grant WSDOT's original request of a permanent easement to the service cabinet and that the access on Pine Street that the city errantly granted to Mr. Locke be removed. In that agreement, the City of Edmonds agreed to control RI MICHAEL K. MURRAY, RE rights of access to SR 104 as indicated by the hatch marks on the planning maps attached to the HAROLU E. SNOW, JR. Agreement. The City of Edmonds further agreed to relieve the State of Washington from all responsibility in the operation of these roadways. In return, the State of Washington agreed to give the City of Edmonds instruments of title for the right of way of the roads located in their right of way plans. A copy of the Right of Way Agreement is attached hereto as Exhibit A. On January 5, 1978, the State of Washington Quit Claimed the aforementioned property to the City of Edmonds pursuant to the Right of Way Agreement. On November 19, 1986, the City of Edmonds approved a Short Subdivision for lot 2 at 126 Pine Street, Edmonds, Washington, creating the property now known as 110 Pine Street, Edmonds, Washington, the subject of this letter. On January 20, 1989, the City of Edmonds gave a construction permit application approval for the construction of a driveway and residence. at 110 Pine Street. Included in that construction permit application were drawings and plans for the location of driveways and curbs accessing 110 Pine Street. Based on the approval of the City of Edmonds, the Lockes proceeded with the construction of .the driveway and residence as indicated in the approved plans and drawings. WSDOT instructed Mr. Locke that the driveway for 110 Pine Street is improperly placed and that it encroaches on the access controlled area belonging to WSDOT, and that this encroachment must be removed, and that access may only be permitted at station 14+70, along Pine Street. As a result of WSDOT's planned action, Mr. Locke will suffer irreparable damage to the property at 110 Pine Street. As it stands, the only allowable driveway entrance per WSDOT is through an access point located at 126 Pine Street. The driveway through this property will run directly across the front yard of that property. Furthermore, the required safety fencing around the electrical service cabinet will damage the value of the property and prevent access to the existing garage previously approved by the City of Edmonds. The solution to the predicament caused by the City of Edmond's approval of building plans within an area that the City was responsible for protecting on behalf of WSDOT, is to install a cul de sac at the end of Pine Street intersecting SR 104. By installing the cul de sac, the City of Edmonds will resolve the access issues. This solution is also consistent with the desire of WSDOT to have the City of Edmonds close Pine Street to traffic that uses that route to access SR 104. Should the City of Edmonds fail to close Pine Street, Mr. Locke is left with no alternative but to bring legal action for inverse condemnation against the City of Edmonds based on WSDOT's position in this matter. Should Mr. Locke be forced to bring an inverse condemnation action, the City of Edmonds will face responsibility for damages, attorneys fees and costs incurred not only by Mr. Locke, but also by WSDOT based on the 1970 indemnification statement made by the City in the Right of Way Agreement with the State of Washington. Locke and signed for by Sydney F. Locke on March 24, 1990. This permit was issued for sewer, driveway, sidewalk, and storm drainage work in the City right-of-way. The individual accountability for fulfilling the requirements of this permit is Sydney F. Locke. The City has tried to work with you in having the improvements installed correctly. The City has not stopped you or your contractor from completing the work. The sewer pipeline was not installed according to plan and was installed without an inspection, as required by the permit. As the permit holder, it is your responsibility to notify the City of the work schedule, request changes and approvals, and to assure us that the work can be inspected. This was not done, therefore, a delay resulted. This was not the City's fault. As I now understand it, the present situation is that the City will accept the sewer work conditional that an as -built construction drawing be provided because of the change, the pipeline pass the pressure test, and existing record pictures be provided. Mr. Locke had told us no gasket was installed in the clean -out. Goldiggers Construction was contacted by you to complete this job. On April 4, 1991 Goldiggers dug up the force main at the manhole on the north side of Pine Street where Sidney Locke had tied into with his grinder pump line. Goldiggers found fittings on the force main loose at the connections where they had tied into a 6" line and no gasket on the 6" plug cap. They cut out the bad fittings and pressure tested the two force mains and found that they held the 5 P.S.I. test with no problem. They reconnected these two lines and eliminated the clean -out on the end of the line. All this time, a City crew member was monitoring the job to make sure it was all legal and acceptable before burial. Because of the agreement that was reached between Sidney Locke and the City of Edmonds, Everett Akau signed off the permit as this was the only requirement that was needed to be completed. Upon arrival there was no one home. We proceeded to check the pressure line to see if a proper test was already on line. What we found was a, pressure gauge on the force line from the pump that registered 2.5 P.S.I. on the line. We then went to the manhole where the line dumps out to see if a plug had been installed in the outflow. We found no plug indicating there was no hydrostatic or pressure test done as per Section 17.17.3 paragraph 4 indicating that a 3 to 4 P.S.I. would be required on gravity sewer lines. This means the whole line and not just the head pressure on a gauge on the downhill side of the line. There was no permit on site for the side sewer inspection to sign therefore, his request was turned down until Mr. Locke fulfills his requirements. When I checked into this request, I found that a partial inspection had been completed up to the property line of 110 Pine Street. Beyond this point there has been no inspection of the installation. Korey asked what he needed in order to solve this problem. I stated that in order to be finalized, the installation would have to be installed when an inspector was present. The installation was done incorrectly according to the original agreement, which means digging up the line to see actual pipe installation. We negotiated to get this resolved. I stated that if photos of the installation were submitted, along with an acceptable drawing, and a 5 P.S.I. pressure test, we would accept this and be glad to sign off the permit. This letter was sent on October 18, 1990 to Mr. Sidney Locke. Goldiggers (contractor) was contacted by Korey Berg to perform a pressure test on this line. Upon several attempts, he could not get the pressure to hold at 5 P.S.I. Goldigger's recommendation was to dig up the line at the property line and test at this point to verify where leakage was occurring. On December 26, 1990, I received a letter from Mr. Locke stating that he had submitted all photos from the job, along with drawings and had static pressure on the line at 2.5 P.S.I's. He asked that we accept this as an acceptable test. STREET Fit., , 110 Pine Street Page 2 On January 3, 1991, I sent another letter to Mr. Locke stating that our original agreement still stands. I stated that I had the drawings but no photos. A 2.5 P.S.I. static head of pressure on a test gauge at the bottom side of the line was not an accurate test and that he was only sensing head pressure of water in the line. I stated again a 5 P.S.I. test will still have to be performed to verify the line integrity before the City can assume responsibility for the line. On February 22, 1991, I contacted Mr. Locke and left a message on his answering machine to return my call to try to settle this matter, but as of February 26, 1991, I have not heard from him. I feel it time to inform the occupant that according to Sec. 307 of the Uniform Building Code, we have the power to evict anyone that is in violation of illegal occupancy. The 2.5 p.s.i. you say is on your line is only as a result of the water head that is putting pressure on your test gauge. This test will not suffice as an adequate method for testing. I'm sure there is more then 6 feet of head from where your force line starts out to were it flows to gravity. A standard test on the force main is as follows: The total head a pump will pump and then you double this to obtain a test pressure. I feel that a 5 p.s.i. test will be more then fair with our original term for passing this side sewer permit. I feel that 150 p.s.i. against this cap on the gravity does not require blocking as the ground should have been back filled and tamped properly enough to stand such a force I have been informed by Dan from Goldiggers that a pressure test could not be obtained on numerous attempts from him. Draining of the line should not be necessary as pressure should come to 5 p.s.i. sooner or later even with water in the line. In order to be sure the line is in tact and we have no possibility of leakage before releasing you of this responsibility in the City right of way. A full 5 p.s.i. must be obtained. To accomplish this, the system must be shut down and drained and the upper end at the manhole be dug up. ( See Dwg of MH ) We did not block the cap on the gravity sewer stub at the manhole because it is not a common thing to do. If a 5 psi. test were to be placed on the line without blocking the cap, a force in excess of 150 lbs would be exerted on the cap and would cause it to dislodge. We have a static water test on the line with a 2.5 psi. reading. This translates into a 6 ft. head. I ask that the sewer inspector check our gauge at the house and accept the line. The system has been in service for 6 months and is not leaking or otherwise causing problems. Please let us know if this is an acceptable alternative, as this is the only holdup to the City's acceptance of our building. The site plan approved showed a lot of 7,420 sq. ft. A setback adjustment had been approved for the house on the lot (A-13-88). The deck on the northwest corner of the site was shown on the site plan as intruding into the setback. A new site plan was subsequently submitted on July 20, 1989. This site plan showed a larger lot. Apparently, Mr. Locke picked up the property to the west of his, formerly owned by Jed Whitley. The lot configuration is shown on the Vicinity Map, attached. The new site plan depicts the house further south on the lot. The deck no longer projects into the setback. In addition, the future garage and asphalt driveway are shown west of the house, extending onto the adjoining lot. A note in the paperwork with the building permit . material dated August 2, 1989 from Rich Schipanski states that a lot aggregation or a lot line adjustment would be necessary. The additional property west of the original property is less than 6,000 sq. ft., which is the minimum lot size for the property. Section 17.40.040(C) of the Edmonds Community Development Code calls for substandard lots which come into common ownership to automatically merge. I checked with Duane Bowman, who said a lot aggregation or lot line adjustment will not be necessary. The revised lot as shown on the new plot plan is legal. There is some confusion, however, because the information,provided by the Planning Division on the face of the building permit is based on an entirely different plot plan. I don't know how you want to handle this; however, there may be further confusion in the future for your archives. A secnond item to note is that the lot is now a corner lot. A side sewer permit is required whenever side sewers are installed in the City of Edmonds. Side sewers which require sewer pumps are subject to engineering approval in all cases and shall require Building Division approval if the sewer pump fails within the confines of the structure. 2. A site plan, including locations of structures, sewer pump and right-of-way, shall be required. Sewer pump data, including design capacity and a performance curve must be approved by the City Engineer prior to the issuance of any side sewer permit. Sump size and other data shall be submitted to the Engineering Division for approval prior to permit issuance. 3. When it becomes necessary to enter City right-of-way to connect to a sewer main, a plan and profile of each installation must be pre -approved by the Engineering Division prior to permit issuance. A separate right-of-way permit must be secured for all work in City right-of-way. All sanitary side sewer line installations in City right-of-way must be constructed of 6" or larger PVC, concrete, or cast iron pipe. Any deviation from these rules and regulations must receive the prior approval of the City Engineer. 4. Drainage piping serving fixtures that are located below the level of the main sewer shall discharge into an approved watertight sump or receiving tank so located as to receive the sewage or wastes by gravity. From such sump or receiving tank, the sewage or other liquid wastes shall be lifted and discharged into the sewer by approved pumps or other equally efficient mechanical devices. 5. The minimum diameter of any pump discharge pipe from a sump having a toilet connected to it shall be 2 inches. All discharge pipes should be located within private property and connect to a side sewer cleanout at the street right-of-way. 6. The sewer pump discharge line shall be provided with an accessible backwater valve and gate valve. If the gravity drainage line to which such discharge line connects is horizontal, or nearly horizontal, the method of connection shall be from the top through a "wye" branch fitting. Provide cleanouts at all bends and at a maximum of 400 feet. 7. Building sewers receiving discharge from any pump or other mechanical device shall be adequately sized to prevent overloading. Sumps and receiving tanks shall be watertight and shall be constructed of fiberglass concrete, or other approved materials. Minimum tank capacity is 165 gallons. 9. Sumps and receiving tanks shall be provided with substantial covers having a bolt and gasket -type manhole or equivalent opening to permit access for inspection, repairs, pump removal, and cleaning. Provide a vent pipe to extend back to the dwelling and terminate through the roof. 11. Provide alarms for high wet well and pump failure. Provide an audible, as well as a visual, alarm panel located inside the residence. A battery operated back-up power supply for the alarm system is required. The high wet well alarm should activate when more than 2/3 of the wet well tank depth is exceeded. 12. No down spouts, footing drains or floor drains shall be connected to any sanitary sewer line either through a gravity or forced sewer line. 13.
