When we arrived at the site we found both signs mentioned in my letter to be in place. The owner Mr. Freymuth was not in the tavern. I left a message with a female employee,, for Mr. Freymuth to call. Later that day Mr. Freymuth called.• I asked if he had received my certified letter order him to remove the sign. He stated he was not aware of any letter. I told him I sent a certified letter to his home. He then remembered receiving a notice of a letter but had not picked the letter up. I told him the contents of the letter and said the sign had to be removed or a permit taken out. He stated he had renew his • insurance as required. I told him we had not received any notice of insurance or did we have a current street use permit for the sign. He promised to come down to the office that day. Mr. Engal 's came into the office on June 27th and talked to Jeannine Graf stating he didn't have proof of the insurance but had paid for a $300,000 policy. He was to return with proof and take out the necessary permit. On July 3, 1990 the signs are still in place and I have not received the required permits, also the illegal banner is still in place. We have had no less than twelve separate contacts with you, and the previous owners, in an attempt to legalize your tavern sign. On March 3, 1990 you agreed to remove the sign from your building, thus resolving the problem. At your request, we canceled your street use permit. Feeling the matter was resolved we closed the • file . Not long after we closed the file the sign was reinstalled without the necessary permits. I visited you last month and requested that you come to the planning office to resolve the problem. Since then an additional sign has been installed. To date no approval or permit has been issued for either sign. Therefore; 1. Acting as a designee of the Public Works Director, I order the immediate removal of the unauthorized sign on your structure that is projecting over a public way. The Engels Pub sign at your new place of business qualifies for a street use permit under the guidelines of the ECDC. As owner, you are responsible to obtain the required permit. In order to obtain the permit, you must complete a street use application, pay the $25.00 fee and submit the required certificate of insurance. The other alternative would be to remove the sign from its present location and relocate it on the face of the building so that it does not encroach over the City sidewalk. In order to do this, you must obtain approval from Leigh Francis in the City Planning Department. Since you have previously been notified by City letter (dated 6/22/89) of requirements, you are now advised that you must resolve this matter by August 18, 1989. Failure to respond will result in removal procedures of the sign as allowed in Section 18.70.050 of the ECDC. Please be advised, zoning code violations are subject to Section 19.00.080 of the ECDC under penalties, whereby violators can be fined up to $5, 000 per day the violation existed and is punishable by misdemeanor. The City of Edmonds Development Code requires that all objects located on private property which invade City right-of-way obtain a Street Use Permit. The sign at this property overhangs the City sidewalk therefore a permit is required. As the new owner of the property you are responsible to obtain the permit. The fee for this permit is $25.00 and must be renewed annually at a cost of $10.00. A certificate of insurance is required to be posted that indicates the City as an additional insured party. On the face of the insurance a hold harmless agreement must be indicated. The permit application is enclosed; please complete and return to the building division by July 7, 1989. NAUGHTEN MAYOR PETER E HAHN DIRECTOR As a followup to our phone call today regarding the overhanging sign at 113 5th Avenue South; the Edmonds Community Development Code requires that owners of businesses obtain street use permits for any structure that is in, on, or over City owned right-of-way. The previous owner of Engles Pub had obtained a street use permit to hang the sign over the City sidewalk. As the new owner you are now responsible for the sign. • In order to have.an approved street use permit you must do the following: 1) complete the attached permit application, 2) obtain a certificate of insurance from your insurance company, (sample enclosed) 3) pay the $10.00 renewal fee for the permit. Another alternative would be to remove the sign from its present location and relocate it on the face of your building. In order to do this you must have approval from the City's Architectural Design Board, (ADB). The ADB is a design review board that approves any and all exterior changes to commerical buildings in the City. The next meeting is April 5th. If you choose to relocate the sign contact Leigh Francis in the Planning Department for more information. As we agreed you must make a decision you will get the street use permit or sign. I spoke with Jeane Ford, the bartender on duty. Many repeat violations were noted on the inspection form. These violations included: 1) Walk-in Cooler The entire walk-in is in a condition that is unacceptable. The floor is filthy and the existing pallet boards are broken. Floor to wall junctures are not coved and sealed. The walls in the walk-in are separating at the corners, there are cracks to the outside around the compressor unit. The ceiling has uncleanable patches, rust spots, and gaps and cracks between the metal panels. Condensate from the compressor unit is not drained properly ---liquid is spilling all over the floor. The inside door handle is broken, there is inadequate lighting in the walk-in, and the existing light is missing a protective cover. The wood shelves in the walk-in must be painted, or better yet, the wood shelves should be replaced with easily cleanable metal shelves. 2) The glasswashing sink at the bar is drained directly to the sewer. It should be drained via a floor sink or funnel drain. 3) The compressor in the bar reachin is draining into a bucket. It should drain into a trapped floor drain. 4) A can under the men's urinal indicates a plumbing leak. The entire men's room has a strong odor of urine. There is inadequate lighting in the toilet area of the men's room, and the ventilation fan exhausts to the back storage room and not to the outside as required. .; A Daniel Shultz/Ye Old Irish Pub July 24, 1985 Page 2 5) Floor repair is needed throughout the establishment. The floor behind the bar has holes, tears, and bulges. The floor covering does not extend to the wall under the bar sink. The floor covering by the men's room toilet is coming up. Many of these violations were mentioned on the previous inspection report of March 19, 1985. When you purchased the tavern, the liquor license transfer was approved by the Snohomish Health District with the understanding that corrections would be made. It appears that little or no effort has been made to bring this establishment into compliance with the current health codes. Therefore, we are asking you to respond to this department in writing with a tentative compliance schedule stating a realistic time frame for correcting the above demerit items. This schedule should reach our office on or before Monday, August 5, 1985. At that time, we can then discuss specific corrective actions that can be taken to bring your establishment up to minimum health code standards.
