PARTIES OF RECORD Shirle DeWitte 1323 11th Place North Edmonds, WA 98020 Sterling and Velma Gruenwald 1312 Olympic Avenue Edmonds, WA 98020 After due consideration of the evidence presented by the Applicant, evidence elicited at the public hearing; and as a result of personal inspection of the subject property and the surrounding area by the Planning staff, the following findings of fact and conclusions constitute the basis of the decision of the Planning staff. FINDINGS OF FACT 1, The Applicant has requested a Conditional Use permit for a home day care on property located at 1323 11th Place North, Edmonds, WA. 2. Zoning on the property is RS -12 as established in the Edmonds Community Development Code. 3. The Comprehensive Policy Plan map designation for the above described property is low density residential. 4. The subject property is developed with a single family residence. 5. The Applicant testified that she intends to care for six or fewer children. 6. The Applicant testified that she is undertaking the process of obtaining a state license for the proposed daycare facility. 7. The applicant testified that her husband is erecting a fence to enclose the play area for the children. d r 'i File #CU -15-82 Findings and Decision of the Planning Staff, City of Edmonds, WA Page 2 8. The Applicant testified that the daycare facility would operate from six a.m, to six - seven p.m. 9. The Applicant testified that outdoor play, depending on weather, would be at approximately 9:30 a.m, to 11 a.m, and 2:00 p.m. to 3:30 p.m. 10. Testimony was given by Mr. Gruenwald expressing concern that the approval of the requested action could set a precedent to change the nature of the neighborhood. CONCLUSIONS 1. The application is for the approval of a Conditional Use permit for a home daycare at 1323 11th Place North, Edmonds, WA. 2. The subject property is zoned RS -12 and is designated by the Comprehensive Policy Plan map as low density residential. 3. The Applicant is in the process of obtaining her state license for daycare up to six children. 4. The proposed daycare appears consistent with the Comprehensive Plan of the City of Edmonds. 5. Home daycare for up to six children is allowed as a secondary use requiring a Conditional Use permit in the RS -12 zone. 6. The proposed daycare, as conditioned, does not appear to be detrimental to the health, safety and welfare of the community. DECISION Using the above findings and conclusions as the basis of the decision, the Planning staff hereby grants the Conditional Use permit request of Shirley DeWitte, 1323 11th Place North, Edmonds, WA, subject to the following conditions: 1. The Applicant is to obtain and comply with all state license requirements for home daycare operations. 2. The total number of children to be cared for is not to exceed six. 3. The hours of operation are to be from six a.m, to six p.m. 4. The outside play times shall be from 9:30 a.m. to 11 a.m, and 2:00 p.m. to 3:30 p.m. 5.
