Facts: i 1) Size: The subject property is approximately 18,245 square feet and is z shaped like a rectangle that has had a comer cut off by Olympic View Drive (see Exhibit A, Attachment 4). 2) Land Use: The subject property is currently developed with a detached single-family residence. 3) Zoning: The subject property is located in a Single -Family Residential (RS-12) zone (see Exhibit A, Attachment 1). 4) Terrain and Vegetation: The site slopes rather steeply down from the house to Olympic View Drive. The site is relatively level where the house and pool are, then slopes steeply up to the property behind. It is landscaped with ground cover, shrubs and trees. 2. Neighboring Development And Zoning: a. Facts: r? { 1) The properties to the north, south, and west are zoned Single-Familyt Y> Residential (RS-12) .and are developed with single-family. homes (see Exhibit A, Attachment 1). z 2) The property to the east is in the City of Lynnwood, and is developed �a with single-family homes (see Exhibit A, Attachment 1). Fact: Variances granted based on special circumstances are exempt from SEPA review (WAC 197-11-800(6)(b) and ECDC 20.15A.080). C. EDMONDS COMMUNITY DEVELOPMENT CODE (ECDC) COMPLIANCE 1. Critical Areas Compliance a) Eamck• This proposal is subject to review under.ECDC Chapter 20.15.13 (Critical Areas Ordinance). The applicant has submitted a Critical Areas Checklist (CA-97-113) and a waiver was granted to the critical areas study requirement. b) Conclusion: The applicant has met the requirements of the Critical Areas Ordinance. 2. Compliance with RS-12 Zoning Standards a. Facts: 1) The fundamental site development standards pertaining to residential development in the RS-12 zone is set forth in Chapter- 16.20.030. These include the following for locating structures: Street Setback: 25 feet Rear Setback: 25 feet (5 feet for detached accessory structures covering less than 600 square feet, and less than 15 feet tall) Side Setbacks: 10 feet Maximum Height: 25 feet (15 feet for detached accessory structures) Lot Coverage: 35% b. Conclusion: The proposal complies with the requirements of the RS-12 zoning standards except for the requested variances. 3. Compliance with Requirements for a Variance a. Facts: 1) Chapter 20.85 of the ECDC sets forth the mechanism whereby a provision of the Code. may be varied on a case -by -case basis if the application of the provision would result in an unusual and unreasonable hardship. The criteria are as follows: (a) Special Circumstances: That because of special circumstances relating to the property such as size, shape, topography, location or surroundings of the property, strict enforcement Of the zoning ordinance would deprive the owner of use righits,pd, privileges permitted to other properties in the vicinity with the same zoning. Special circumstances should not be predicate . d':' Hearing Examiner Decision Case No. V, 97-114 Page 4 upon any factor personal, to the owner such as age or disability, extra expense, which may be necessary to comply with the zoning ordinance, the ability to secure a scenic view, the ability to make more profitable use of the property, nor any factor resulting from the action of the owner or any past owner of the same property. (b) Special Privilege: That the approval of the variance would not be a grant of special privilege to the property in comparison with, the limitations upon other properties in the vicinity with the same zoning. (c) Comprehensive Plan and Zoning Ordinance: That the approval of the variance will be consistent with the intent of the comprehensive plani the zoning ordinance, and the zoning district in which the property is located. (d) Not Detrimental: That the variance, as approved or conditionally approved, will not be significantly detrimental to the public health, safety and welfare or injurious to the property or improvements in the vicinity and the same zone. (e) Minimum Variance: That the approved variance is the minimum necessary to allow the owner rights enjoyed by other properties in the vicinity with the same zoning. 2) The applicants have submitted declarations with their submittal which address the decisional criteria as follows (see Exhibit A, Attachment t 3): (a) The applicants state that due to the topography and not having any commoneasementsallowing access to the rear of the property, the proposed location is the only acceptable location for the garage. (b) The applicants believe that the structures belonging to the I neighbor to the north are , Clos L er to the Street than their proposed garage, so approval of the variance would not a grant of special privilege. The applicants do not think that there will be any loss of scenic views, and believe the garage will raise the value of their property. (e) The applicants feel that this location is the only location on the site which can accommodate the garage without exorbitant costs. They add that a 20-foot by 24-foot two -car garage would be an alternative, but would not serve them as well as a 24-foot by 24-foot garage. z P` 3) The neighbor who appears closest to the road from the map in Exhibit o A, Attachment 5 is the one at the corner of 174th Street SW and Olympic View Drive, with an address of:6728 - 174th Street SW. In N' researching the setbacks, staff indicated that it appears the house was o a constructed in 1968, and according to the as -built septic system plans, LU ui a 25-foot setback to Olympic View Drive was maintained. A site visit h� by the Examiner leads the Examiner to concur with the applicant in - �;. that the garage visually appears to be closer to the Olympic View di I Drive than is indicated on the as built drawings. z ~ 4) In a check of the city's data base of planning permits by staff, no variances were found to have been approved for Olympic View Drive in this block, but three variances have been approved on nearby 174th Street SW. 174`h Street SW also has lots along it with steep areas adjoining the road. 5) A letter has been received from T.A. Reynolds, who Iives at 17520 - 66th Avenue W., expressing concern about the closeness of the garage to the right of way, given the need for turning lanes as part of the City a of Lynnwood's proposed road widening project (see Exhibit A, O Attachment 7). Staff indicated in Exhibit A that the notice was confusing and apparently led Mr. Reynolds to believe that both the front and side yards were being reduced to 5 feet, when actually the front setback is proposed to be 17 feet. 6) A letter has also been received from Jeffrey Elekes, Project Manager for City of Lynnwood's Public Works Department regarding the acquisition needs for the Olympic View Drive widening project (see . Exhibit A, Attachment 5). This is discussed further under Technical Review, Section D.2 below. The map attached to Exhibit A indicates that the driveways for the subject house and the house to the south jointly share one access point on Olympic View Drive. '•1 hf%.^Lt.3> Z Hearing Examiner Decision Case No. V 97-114 Page 6 b. Conclusions: 1) The applicants' site is rather challenging, due to the slope constraints. Even the proposed location of the garage will provide plenty of construction challenges.Due to the steep drop to Olympic View Drive, unless the access travels across the front of the site, it is hard to reach the elevation of the house. If the applicant were required to travel the opposite direction across the slope, access to the south side of the house would require the elimination of many trees which could reduce the stability of the slope. It would also increase the number of points along Olympic View Drive where driveways enter, thereby decreasing safety. The limited space appears to make it impossible for the driveway to start where it does and do a hairpin curve to reach the south side of the house so that the garage could be located there. The proposed location does appear to be the only realistic location for the garage, given the circumstances of the topography of the lot and access to it. 2) The applicants have pointed out that a neighbor's structure is within the street setback. It appears that the house was legally constructed to meet the setbacks at the time. It was unclear from staff research if the right of way on Olympic View Drive has been widened since the house was constructed, or why it now appears to be closer than 25 feet from the road. However, it appears that other lots in the vicinity have been granted variances due to the steep topography. 3) The proposed use is an accessory use to a residential use, which is in conformance with the comprehensive plan (see also Section E below). The application meets the intent of the zoning ordinance. 4) The proposed variances will not be significantly detrimental to the public health, safety and welfare or injurious to the property or improvement in the vicinity. Because of the proposed street widening project along Olympic View Drive, the proposed garage should stay back from the road. However, it appears that a 24 foot wide garage would be no closer to the right-of-way than the house which exists to the north. In order for a car to be able to drive into the garage, the garage cannot be located any further to the west (see Exhibit A, Attachment 4). 5) The applicants state that there is no other site that would be suitable, and they could accept a narrower garage, down to a 20-foot by 24-foot garage, although they would much prefer a 24 foot wide garage. After conducting a site visit and after reviewing the file, the Examiner believes a 24 foot wide garage is reasonable and the resultant 17 foot setback will still allow the future improvements to be made to Olympic View Drive. The side setback would not change, and the 5-foot setback appears to be the minimum setback required. C. TECHNICAL COMMITTEE 1. Mr. Elekes sent a response stating that according 5 to the latest plans, a retaining wall will be constructed between 174th o Street SW and 175th Place SW on the west side of Olympic View z Drive, which may require the acquisition of 2 to 5 feet of right of way from the applicant's street frontage. Those 'number are preliminary: final plans will not be available until May 1998 (see Exhibit A, Attachment 5). 3) For streets within the City of Edmonds, if the Official Street Map ' shows that additional right of way width is needed, the street lot line is taken from the edge of the proposed right of way. Facts: The Comprehensive Plan, Residential Development section, identifies goals and policies which relate to "Residential Development" in the City. Specific goals and policies are discussed in detail below. 1) Section B states as a goal of the City that: "High quality residential j development which is appropriate to the diverse lifestyle of Edmonds residents should be maintained and promoted...: . 2) Policy B.3 states "Minimize encroachment on view of existing homes by new construction or additions to existing structures." b. Conclusion: The proposed garage is above street level and will partially hidden in trees, so no views should be encroached upon. The proposed variances are consistent with the above adopted goals and policies of the City. DECISION Based upon the foregoing findings and conclusions, the request for a variance is approved, subject to the following conditions: 1. The north side setback of the proposed garage shall be no less than 5 feet, as shown on the site plan (see Exhibit A, Attachment 4). 2. The street setback of the proposed garage shall be no less than 17 feet, which will require the proposed garage to be no larger than 24-feet by 24-feet, as shown on the site plan (see Exhibit A, Attachment 4). 3. This application is subject to the applicable requirements contained in the Edmonds Community Development Code. It is the responsibility of the applicant to ensure compliance with the various provisions contained in these ordinances. 4. The applicant must obtain a building permit prior to any construction. 5. The applicant must construct an on -site turnaround for the driveway as a condition of the building permit for the proposed garage. 6. The applicant will need to comply with all the terms of any future permits. 7. Ron McConnell Hearing Examiner RECONSIDERATIONS ,AND APPEALS The following is a summary of the deadlines and procedures for filing reconsideration's and appeals. Any person wishing to file or respond to a recommendation or appeal should contact the Planning Department for further procedural information. REQUEST FOR RECONSIDERATION Section 20.100.010.E allows for the Hearing Examiner to reconsider his decision or recommendation if a written request is filed within ten (10) working days of the date of the initial decision by any person who attends the public hearing and signs the attendance register and/or presents testimony or by any person holding an ownership interest in a tract of land which is the subject of such decision or recommendation. The reconsideration request must cite specific references to the findings and/or the criteria contained in the ordinances governing the type of application being reviewed. Section 20.105.020.A & B describe how appeals of a Hearing Examiner decision or recommendation shall be made. The appeal shall be made in writing, and shall include the decision being appealed along with the name of the project and the date of the decision, the name of the individual or group appealing the decision, their interest in the matter, and reasons why the appellant believes the decision to be wrong. The appeal must be filed with the Community Development Director within ten (10) working days after the date of the decision being appealed. LAPSE OF APPROVAL Section 20.05.020.0 states 'Unless the owner obtains a building permit, or if no building is required, substantially commences the use allowed within one year from the date of approval, the conditional use permit shall expire and be null and I void, unless the owner files an application for an extension of the time before the expiration date.' Because of the proposed street "widening project along Olympic View Drive, the proposed garage should stay back as far as possible, from the road. However, in order for a car to be able to drive into the garage, it cannot slide any further to the west (see Attachment 4). Review b L Public Works Y City of Lynnwood Y ;Department # a) Facts• (1) The right of way of Olympic View Drive, in the vicinity of the subject site, is"in'the s city of Lynnwood's jurisdiction. i (2) Upon being notified by a neighbor that this site was in the middle. of the Olympic View Drive widening project, staff notified Jeff Elekes, Project Manager for City of Lynnwood's Public Works Department, about the prop6sal. He sent.a response a stating that according to the latest plans, a retaining wail will be constructed between 174th Street SW and 175th Place SW on the west side of Olympic View Drive, which may require the acquisition of 2 to 5 feet of right of way from the applicant's l street frontage. Those number are preliminary: final plans will not be available until" May 1998 (see Attachment 5). (3) For streets within the city of Edmonds, if the Official Street Map .shows that f additional right of way width is needed, the street lot line is taken from the edge of the proposed right of way. For streets outside of, Edmond's jurisdiction, any 1 proposed acquisition does not show up on the Official Street Map, so the street lot 3 line remains at the property line. b) Conclusion: For purposes of this application, the street, lot line is the property line. Because of the proposed acquisition of property along Olympic View Drive, if the garage was approved at the 17-foot setback to the street, after the road widening project the garage would be 12 to 15 feet or perhaps less than that to the "right of way. Therefore; the street setback variance should be reduced to the minimum necessary to allow a garage-, E. Comprehensive Flan (ECDC) 1. Comprehensive Plan Designation co !fir ER The following is a summary of the deadlines and procedures for filing reconsideration's and appeals. Any person wishing to file or respond to a recommendation or appeal should contact the Planning Department for further procedural information. A. Request for Reconsideration Section 20.100.010.E allows for the Hearing Examiner to reconsider; his decision or recommendation if a written request is filed within ten (10) working days of the date of the initial decision by any person who attends the public hearing and signs the; attendance register and/or . presents testimony or by any person holding an ownership interest in a tract of land which.is'the subject of such decision or recommendation. The reconsideration request must cite specific references to the findings and/or the criteria contained in the ordinances governing the type of application being reviewed. B. Appeals Section 20.105.020.A & B describe how appeals of a Hearing Examiner decision or, recommendation, shall be made. The appeal shall be made in writing, and shall include the decision being appealed along with the name of the project applicant and.the date of the decision, the name and address of the individual or group appealing the decision, their interest in the matter, and reasons why the appellant believes the decision to be wrong. The appeal must be filed with the Community Development Director within fourteen (14) calendar days after the date of the decision being appealed. IV. According to the Z information now available we will likely construct a retaining wall on the west side of sc Olympic View Drive between 175th PL. S.W. and 174th Street S.W. This may still r require 2 to 5 feet of right of way, depending on the design of the wall. This only an approximation.
