UTILITY.EASEMENT

IN CONSIDERATION of benefits to accr.ue.to the grantors herein; the
undersigned, Lee and Karen Salazar, hereby grant to the CITY OF
EDMONDS, a Municipal Corporation;- a permanent easement for the
instal.lation, operation and maintenance of a storm drain pipeline,
across, through and below the following described property; and.the
further right to remove trees, bushes, undergrowth and other
obstructions interfering with the location, construction and
maintenance of said utility, together with the right of access to the
easement at any time for the stated purposes.
The easement hereby granted is located in the County of Snohomish,
State of Washington, and is more particularly described as follows:
A parcel of land 15.00 feet in width, being 7.50 feet on each side
of the following described centerline:
Commencing at the point of intersection of the Westerly
prolongation of the South line of Lot 1, Block 1, of the Plat of
Seahurst, as per plat recorded in volume 9 of plats, page 90,
records of Snohomish County, Washington, and the Easterly,
right-of-way margin of Olympic View Drive;
Thence South 15*50'03" West along the Easterly right-of-way margin
of Olympic View Drive, a distance of 24.00 feet to the Point of
Beginning of the centerline herein described.
Thence South 75*5014811 East 55.59 feet;
Thence South 19*52112" East 135.90 feet;
Thence South 32*3310711 East 40.53 feet;
Thence South-5*30133" East 41.45 feet, more or less, to a point.
which bears South 32*2812411 East 180.00 feet from the most
Westerly corner of Lot C of the City of Edmonds Short Plat
S-17-77, as recorded under Auditor's File No. 7706240288, records
of Snohomish County., and the terminus of said described centerline.
THE CITY agrees to restore to substantially the original condition
such improvements as are disturbed during the construction, maintenance
and repair of said utility or utilities; provided the grantors, their
heirs, or assigns shall not construct any permanent structure over,
upon, or within the permanent easement except for the following: The
area adjacent to the existing garage.. In this area, the existing
garage may be expanded within said easement with the provision that no
permanent structure be built within two feet of the pipeline. The City
also agrees to clear all shrubbery, trees, and undergrowth and install
fill in the area of the ravine adjacent to Olympic View Drive. The
existing driveway will also be relocated to the north approximately
fifteen (15) feet. At completion -of the project, the portion of the
driveway which runs the length,of the pipeline will be resurfaced with
asphalt concrete pavement. Finally, erosion control work using log
check dams upstream of the pipeline work will be performed by October
31, 1991.
