Staff has attempted to find permits for these decks and has found nothing conclusive. The house was built in 1955. A building permit was approved and finaled in 1972, file BP- 720393 that was for "2"d floor deck roof." No site plan has been found for this permit, and no mention is made on the permit of setbacks (see attached). The neighbors at 18911 Olympic View Drive have filed an affidavit that "there has always been a deck on the house" and they purchased their home in 1974. The applicants have submitted a picture which they say was taken in the 1990s and shows a deck extending approximately 8 feet to the west of the house, that is obviously in line with the southern edge of the house, and appears to extend the length of the house. Note that this photograph also shows a concrete patio, which is also shown on the attached site plan. Staff has determined that a deck the width of the western side of the house that extends out approximately 8 feet was approved by the city in 1972 and can be maintained in that same configuration. The additional portion placed to the south has not been found in any site plans. It would have required a permit to add, and the portion within the 25 foot street setback to Olympic View Drive could not have been allowed. The deck to the south of the house does not have legal nonconforming status. This determination was made based on the following information and documentation: Building permit BP- 720393, affidavit from Selma M. Dublin of 18911 Olympic View Drive, and Photo of the house with the deck. This determination shall be null and void if any activity, action, or omission as listed in ECDC Chapter 17.40 occurs which would terminate the nonconforming status.
