We are currently in the process of drafting and finalizing the settlement documents. This was an extremely emotional case for us all. However, we believe we were able to secure the best possible settlement for the Dericksons under the circumstances. After many days of mediation and legal maneuverings, we were faced with threats of bankruptcy, lack of insurance coverage if we prevailed, a two year wait during the inevitable appeal and the very real costs of a four week trial. It has been a long haul but the end is finally in sight.. On behalf of the Dericksons, I would like to thank you for the time, expertise and support you provided during this litigation. We have finally been able to obtain a judge for the summary judgment motions that are outstanding in this case. We were recently assigned to Judge Krese but she cannot hear the summary judgments until March 31, 1995. Finally, there is a possibility that if Windermere loses the summary judgments, they may be more willing to settle this case.
