Also enclosed are a copy of our state license and a copy of a projected daily schedule, indicating outdoor play times.. The state license includes the name of my sister, Deirdre Nicodemus, who is living with us at this time and will be help- ing with the daycare. She is not an owner of the property. Our fenced play area will be what we call a courtyard on the first level of the house. It is partially covered by one end of the upper level and by a walk way which leads to the main entrance to the upper level. There is a cement floored area and also an area with plantings. It is completely enclosed. There is room in the carport and outside of the carport, up by Oly.View Dr., and across the street by the trees on Blake Pl. for additional parking. FINDINGS OF FACT 1. The Applicant has requested a Conditional Use Permit to allow her to operate a home day care facility out of her residence at 18916 Olympic view Drive, Edmonds. 2. The subject property is zoned RS-123 as established by the Edmonds Community Development Code (ECDC). 3. The Comprehensive Policy Plan Map designates the subject property as Low Density Residential. 4. The subject property is developed with a single family residence. Staff Decision Cb•-.)6-86 Page rA S 5. The following are the review criteria for home day care facilities, as outlined in Chapter 20.19 of the ECDC. A. State Lincensing - The Applicant must obtain and comply with all State licensing requirements. B. Outdoor Play Times - Outdoor play times shall not be scheduled before 9:00 p.m. or after 8:00 p.m. Care shall be taken to minimize noise impacts on adjacent residences. C. Fenced Play Area - A completely fenced play area is required. No play area shall be allowed in the street setback. D. Parkina - Two on -street or off-street parking spaces must be provided. Off-street parking spaces must be reasonably accessible to the applicant's residence and available for public use under city ordinance. 6. The Applicant testified that she intends to care for up to six children, including her two children. 7. The Applicant testified that she has obtained a state license for a home day care facility to care for up to six children, under license no. 7`52-H-401277. 8. The Applicant that she intends to operate the day care from early morning to late afternoon (7:30 a.m. to 6:00 p.m.) 9. The outdoor play area is a covered courtyard that is completely fenced. 10. The Applicant testified that eventually the area to the west of the house will be fenced for outdoor play. 11. Witness Hoppe] testified in support of the application. He expressed a concern that the children have adequate play area away from Olympic View Drive. CONCLUSIONS 1. The application is for the approval of a conditional use permit for a home day care facility at 18916 Olympic View Drive, Edmonds. 2. The subject property is zoned RS-12 and is designated as Low Density Residential on the Comprehensive Policy Plan Map. 3. The Applicant has obtained obtained her state license to care for six full-time children. 4. The proposed use appears to be consistent with the Comprehensive Plan. ._ Staff Deci%ion CLI-j6>-86 Page 3 5. Home day care is an allowed use in the RS-12 zone with the grant of a conditional use permit. 6. The proposed day care, as conditioned, does not appear to pose any significant impact to the public or nearby private property or improvement. 7. The proposed day care complies with the review criteria of Chapter 20.19 of the ECDC, as outlined in the Findings of Fact. 8. No opposition testimony has been received regarding the proposed use. DECISION Using the above findings and conclusions as the basis for the decision of the Assistant City Planner, the application for a Conditional Use Permit for a home day care at 18916 Olympic View Drive is hereby granted, subject to the following conditions: 1. The Applicant is to comply with all State licensing requirements for a home day care facility. 2. The total number of children may not exceed six. } 3. The hours operation are to be no earlier than 6:00 a.m. or later than 6:30 p.m. 4. Outside play times shall be be between 9:00 a.m. and 6:00 p.m. 5. The Applicant must obtain a Business License from the City Clerk. This Conditional Use Permit is granted subject to the authority granted the Planning Staff as outlined in Chapter 20.95.060 of the ECDC.
