Your zoning enforcement violation has been assigned to case file #ZE-98-122. After my inspection, I was able to confirm that this violation existed. According to Section 16.20 of the Edmonds Community Development Code all structures located within a residential zone must meet any necessary setbacks. When a retaining wall exceeds 3 feet in height it must meet the required setbacks for its zone. In this case you are located in the RS-12 zone. This means that the structure needs to meet the required sideyard setback of 10 feet. If you intend to keep the structure in its current location, then you must first receive an approved variance allowing the current setback encroachment to remain. To comply with the Code, you will need to take action by November 13, 1998to remove the violation. Ultimately, if action is not taken fines of $100 daily will be assessed against the property owner(s) until the violation has been corrected.
