An illegal discharge problem was brought to my attention on September 22, 2005. Dried
concrete slurry was found on both sides of the 95 tb Place West right-of-way; the origin of this
slurry was determined to be new concrete work recently performed on your property.
Fortunately, the concrete slurry did not reach the storm drainage system on this street, which
flows to Shell Creek. The system is intended for storm runoff only, and the water receives no
treatment downstream, which means that fish and wildlife habitat are impacted by any pollutant
discharges.
The discharge of untreated waste to waters of the State constitutes a violation of Edmonds City
Code 7.200 entitled Illegal Discharges to Storm Water System and Watercourses and could be
subject to enforcement actions. However, at this time we do not have conclusive evidence of
when the violation occurred or who was responsible for the infraction. We would only like to
solicit your assistance and cooperation in preventing the situation from reoccurring. I hope that
the enclosed public education inforination can be helpful in your understanding the impacts of
the pollutant discharge.
