Description of Proposal The applicants are the owners of a large lot that has the potential to be subdivided, therefore, a Conditional Use Permit is required to remove trees and brush from the property. Currently the entire lot is undeveloped and covered with trees and brush and the purpose of the tree removal is to prepare the site for construction of one single family dwelling (see Attachments 2 & 3). C. Decision Based on statements of Fact, Conclusions, and Attachments in this report, the application for a Conditional Use Permit for tree removal is approved subject to the following conditions: 1. Prior to any tree or brush removal, an erosion control plan must, be submitted to the Engineering Division. This plan may be submitted as part of the building permit for the proposed house or completed ahead of time as a stand alone permit with the Engineering Department. II. FINDINIGS OF FACT AND CONCLUSIONS A. Site Description 1. Site Development, Neighboring Development, and Zoning: a) Facts. (1) Size: The subject property is irregular in shape, with approximately 27,000 square feet of lot area (see Attachment 3). (2) Land Use: The subject property is currently undeveloped. (3) Subject Property Zoning: The zoning of the subject property is RS-12, a single family zone requiring a minimum lot size of 12,000 sq. ft. (see Attachment 1). (4) Terrain and Vegetation: The lot slopes down from south to north towards South County Park and is covered in blackberries, bushes, and saplings (see Attachment 3). (5) Surrounding Development and Zoning: Surrounding properties on the east, west and south side of the property are zoned and developed with the same RS-12 zoning designation. The Park to the north is zoned Public (P) (see Attachment 1). B. Edmonds Community Development Code (ECDC) Compliance 1. Compliance with ECDC Chapter 18.45 (Land Clearing and Tree Cutting) a) Facts: (1) ECDC Chapter 18.45 states that single family zoned properties which are undeveloped and may be subdivided must obtain a Land Clearing and Tree Cutting Permit to remove trees and or vegetation, (2) Some of the purposes of ECDC Section 18.45.000.A-M state a desire to: A. To promote the public health, safety, and general wetfare of the citizens of Edmonds by preserving the physical and aesthetic character of the City through the prevention of indiscriminate removal or destruction of trees and ground cover on undeveloped or partially, developed property; 4296_ 107MOC / October 4, 1996 / Staff Report r i Z z 1.2 LU!. To implement and further the goals and policies of the City's Comprehensive Plan in regard to the environment, open space, wildlife habitat, vegetation, resources, surface drainage, watershed, and economics; D. To ensure prompt development, restoration and replanting and effective erosion control of propeny during and after land clearing; E. To promote land development practices that result in a minimal adverse disturbance to existing vegetation and soils within the City, F. To minimize surface water and groundwater runoff and diversion; G. To aid in the stabilization of soil, and to minimize erosion and sedimentation; H. To minimize the need for additional storm drainage facilities caused by the destabilization of soils; J. To acknowledge that trees and ground cover reduce air pollution by producing pure oxygen from carbon dioxide; L. To promote building and site planning practices that are consistent with the City, s natural topographic and vegetation features while recognizing that certain factors such as condition (e.g. disease, danger of fatting, etc. proximity to existing and proposed structures and improvement, interference with utility services' and the realization of a reasonable enjoyment of property may require the removal of certain trees and ground cover; M. To promote the reasonable development of land in the City of Edmonds. (3) The following are included as a part of this proposal: (a) All the vegetation proposed to be removed is located where the proposed new home will be constructed (see Attachments 2 and 3). (b) The 11 trees to be removed are alders with a diameter of 7" or less (see Attachments 2 and 3). (c) Although the property slopes fairly sharply down from the south property line to the middle third of the lot, the area where the trees and brush are to be removed and the house is to be located is rather gently sloped. (d) Work is not scheduled to begin until all permits for the proposed house have been granted. b) Conclusions: (1) The proposed clearing permit would be consistent with the purposes of ECDC Chapter 18.45. (2) Any exposed soil should be revegitated. C. Comprehensive Plan Compliance 1. Comprehensive Plan Policies a) Fact: Section Soils and Topography C.3.a - Temporary measures shall be taken to reduce © erosion during construction. b) Conclusion: Erosion Control measures must be implemented. 2. Comprehensive Plan Designation a) Fact: The Comprehensive Plan designates the subject property Low Density Residential. . C ® b) Conclusion: The conditioned project is consistent with the Low Density Residential designation in the Comprehensive Plan. D. Technical Committee 1.
