GEOFFREY GIBBS August 23, 2013 VIA EMAIL: natricia(a)lighthouselawgroun.com Ms. Patricia Taraday 1100 Dexter Ave. N., Ste. 100 Seattle, WA 98109 Re: El Sharawy Dear Ms. Taraday, I understand you and/or the City. still had questions regarding Mr. El-Sharawy's ownership of a portion of what has been described as the "pedestrian access corridor'.', a strip of real property having its own Snohomish County Assessor's ID number and lying adjacent to and to,.1 believe, the east of Mr. El-Sharawy's property. The issue of ownership in this strip of real property was raised by the City as part of its concerns with the placement of some :of the decorative blocks along Mr. El-Sharawy's driveway. As I believe you are now aware, when the City initially raised the issue, we were able to locate Charles and Nina Burnett, the individuals that sold the property to Mr. E1=Sharawy. As I believe you are aware, the large parcel of real property upon which the home is built was assigned one tax ID number and the strip of property described as the pedestrian access corridor assigned a separate tax ID number. According to the County records, the Burnetts owned the strip of property/pedestrian access 'corridor. Both Charles and Nina Burnett (who were then divorced) agreed that their intention was to convey title to the strip of property. to Mr. El-Sharawy and both signed Quit Claim Deeds that were recorded with the Snohomish County Auditor's Office. Copies of the Quit Claim. Deeds are attached. After the. Deeds were accepted and recorded, the Assessor's Office contacted the Burnetts indicating that it had made a mistake and that the Burnetts were not, in fact, the owners of the pedestrian access corridor. At that point in time,, we filed an adverse possession/quiet title .lawsuit in that it was apparent to me and to anyone that inspected the property that Mr. El-Sharawy was "in possession" of the western half of the pedestrian access corridor in that an old wooden fence was actually built down the middle of the strip of property. I have attached a copy of a survey map I believe I obtained from Chicago Title Insurance Company, which depicts the lot owned by Mr. El-Sharawy, Tax ID No. 27031300101700 (Lot 1) and the separate strip of real property identified as the pedestrian access corridor, which I understand had Snohomish County Tax ID No. 27031300103100. GPC\ 1204 1 \001 9\00729674.V I Ms. Patricia Taraday August 23, 2013 Page 2 1 have also enclosed a conformed copy of the Agreed Order of Default, Decree to Quiet Title and Adverse Possession pleading filed with the Snohomish County Superior Court in October of 2012 and recorded with the Snohomish County Auditor's Office on October 24, 2012 under Snohomish County Auditor's File No. 201210240038. I understand that the City questions the legal description contained in the Agreed Order of Default and Quiet Title in that it is somewhat different than the legal description of the actual pedestrian access corridor (Snohomish County Parcel ID No. 27031300103100). As indicated, when we filed the adverse possession/quiet title action, it was apparent to me that Mr. El- Sharawy and/or his predecessors in interest occupied only approximately one-half of this strip of real property. Attached is a map prepared by Michael Bell, an individual who I understand surveyed the property for Mr. El-Sharawy. This survey depicts the pedestrian access corridor and depicts the monuments which relate to the wooden fence that had been built basically down the middle of the strip. of property. Again, we requested to quiet title in only the western half of this strip of real property, namely the western half which was or is approximately 14.31 feet in width. This I believe is the legal description (half) of the strip of real property that is included in our Agreed Decree'Quieting Title. This would be the reason why the legal description is not the same as the legal description of the strip of real property identified by the Snohomish County Assessor's Office as Tax Parcel ID No. 27031300103100. It is my understanding, based both upon numerous conversations with Mr. El-Sharawy and Mr. Steven Gray, as well as my site visits, that the placement of the concrete blocks are restricted to the western half of this pedestrian access corridor. I believe everybody would agree that the blocks lie to the west of the old wooden fence running down the middle of the strip of property. This would be, I believe, readily apparent to anyone from the City who actually visited and inspected the site. Hopefully this will answer at least that question. In order to prepare this letter, we have visited the site on two separate occasions. This has allowed us to observe the existing conditions in the areas of both the eastern modular walls and the critical areas. A short rockery existed through the central portion of the eastern property line prior to the 2009 construction of the modular walls. It is obvious that this rockery is older than the modular walls, and was likely constructed at least as long ago as the residence itself. This rockery appears to retain some fill. To the south of the rockery, two short modular walls were built in 2009 to create more level space alongside the driveway. These walls have an exposed height of approximately 3 feet each, and they are set back 3 to 4 feet from each other. We understand that the modular walls were constructed in front of an old short rockery that was pre-existing at this location. At the time of our first visit in February 2014, there were pavers located behind the old rockery in the central portion of the eastern property line. This allowed the potential for vehicles to be parked close to, and create a surcharge on, the rockery. At the time of our May 7, 2014 visit, we observed that the pavers had been removed. qnd the area within at least 8 feet of the backside of the rockery had been covered with landscape b9'rk. Also, a short fence had been erected along the driveway. These measures will prevent the area behind the old rockery from being used as parking. There is a hedge alongside the driveway through the area of the modular walls, preventing vehicles from driving off the driveway -to park on the area behind the modular walls. Based on our observations, neither the pre-existing rockery nor the modular block walls can be subjected to surcharges from vehicles getting close to them. The eastern portion of the property that is occupied by the residence, yard, driveway, and eastern walls slopes gently toward the northeast. On the western portion of the lot there is a tall, very steep bluff extending down to the BNSF railroad tracks that were installed alongside the Puget Sound. This bluff continues to the north and south for quite a distance. Due to the inclination of the bluff it would definitely meet the City of Edmond's criteria for both a landslide and erosion hazard area. This bluff is prone to periodic landslides that are most often naturally occurring "skin" slides that GEOTECH CONSULTANTS, INC. E/ Sharaway JN 14062 May 9, 2014 Page 2 affect the near -surface few feet of soil that loosens over time due to weathering. These slides typically occur during periods of heavy rainfall, and result in mudflows that can, at times, reach the BNSF tracks. The risk of this type of slope movement exists for all of the nearby lots. The eastern modular walls are located on the opposite side of the residence from the steep bluff. They are over 100 feet from the crest of the bluff. Work associated with the walls did not disturb the bluff itself, or the area within at least 100 feet of the bluff. Considering the extensive distance from the bluff, and the very limited fill that was placed behind the modular walls, they in no way decreased the stability of the bluff. Additionally, because the bluff and the area behind it were not disturbed by the construction of the walls, they have not increased the potential for soil erosion on the bluff. In our professional opinion, the minimum 100-foot buffer maintained between the modular walls and the steep bluff was sufficient to prevent adverse impacts to the critical area on the site or the surrounding lots. The walls have not increased the amount of surface water or sediment being discharged to surrounding lots. In fact, the placement of vegetation and gravel on the ground behind the modular walls has decreased the potential for erosion and sediment transport for any surface runoff that would naturally travel toward the northeast with the slope of the ground. The investigation was conducted by HEMPHILL CONSULTING ENGINEERS at the request of Bruce O'Neill of Design Works Construction.' INVESTIGATION Dale C. Hemphill of HEMPHILL CONSULTING ENGINEERS conducted a geotechnical investigation of the site and determined that the entire site is underlain by glacial till overlain by a sand outwash. The investigation was conducted by a visual study, and by observing excavations for utilities. HEMPHILL measured the adjacent slope to the northwest to be as shown in Figure 1, and estimated that the worst condition that would occur within the lifetime of the house would be that the slope would erode from weathering to within 17 feet from the existing top of slope. CONCLUSIONS The investigation and calculations indicate that the risk of instability (a massive landslide) is minimal, and that the loss of soil from weathering will not encroach upon the proposed structure. Control of stormwater runoff will be essential to protect the slope from surface erosion. The proposed drainage shown on the plans should be sufficient.
