The Applicant testified that because of extensive litigation involving the PRD the Applicant has been limited as to the amount of work to be performed on the subject property and on the PRD project. According to the Applicant this litigation held the project up for 14 months. 8. The Applicant testified that of the 24 months since approval of the PRD there have only been 7 months in which the Applicant was free to work without the threat of litigation or while he had building permits. 9. In submitting his application the Applicant submitted a narrative explaining the complex delays encountered by the Applicant in trying to .complete the project. The narrative was admitted to the hearing as exhibit 3 and is attached to these findings and by this reference is incorporated as part of these findings. 10. The Planning Department of the City of Edmonds testified that the Applicants have made no change in the original change of the design of the project. 11. The Planning Department of the City of Edmonds testified that there had been no changes in the physical aspects of the development and that the SEPA determination as originally granted for the subject property and project remain the same. 12. The Planning Department of the City of Edmonds has recommended that an extension be allowed for the PRD. In making their recommendation the Planning Department stated the following: "Section 20.35.110 allows extensions to final planned residential developments. Even though the units are .t ii1 attached, an extension to the original approval can be considered as the original request was filed prior to z: the expiration date of the PRD. 4 It is the recommendation of the staff that the PRD-4- S ' 77 be granted a 2 year extension to the final approval. No changes have occurred on the project; but there have a`.. been extenuating circumstances causing the delay in the tc st, construction as outlined in exhibit 3."
