00774The hearing was opened to the public and Mr. Lovell spoke and stated they wished the plan to be approved as submitted, the Staff recommen- dations were welcomed with no -objections. With reference to the fill conditions he agreed it would be unwise to not have a proper test, however he asked if a covenant could be put on the plat requiring that prior to issuance of building permits on the lots that soil tests be done at that time. A member of the audience•then asked if the horse ` corral would be taken out or remain. Noelle Charleson said it is on City. property and no plans were evident of its removal at this time. Jerry Maddox , residing at 76th Ave. West, spoke on behalf of the developer as project manager, said he and his family use the horse �r corral and that most residents approved of the corral: He also said they had chosen this site because it requires no rezone and is a permitted use and they were aware of the turn -around driveway problem. Discussion followed on the soil conditions and Commissioner LaBelle �• inquired of Leif Larson if from an engineering standpoint, was it I practical to allow this plat and construction by permit per lot. I Leif Larson stated as there was a building envelope the subsurface ' conditions should substantiate this development,including the building envelope shown on the plan. Mr. Larson'.s concern was if the envelopes were on buildable sites. t; Commissioner Goodhope suggested they down -zone their residential area to 6,000 sq. ft.,.retaining Lot 5 in the BN zone. Commissioner Dickson ,F• suggested selling of the lots,if not tested would be rather difficult if left i up to the individual soil test permit per lot. Leif Larson said if there was settlement, then the utilities could also settle, including the sewer lines and he emphasized that proper drainage must be developed'. ST-10-77 Amendment to the Official Street Map to include streets in the area being annexed to the City, vicinity 180th Street S.W., between 72nd Avenue W.', rn and 76th Avenue. and AZ-3-77 Amendment to the Zoning Map to•establish RS-8 Zoning to the area being annexed to the City, vicinity 180th Street S.W., between 72nd Ave. W., = 'f and 76th Avenue W. =` Noelle Charleson introduced this item as being annexed and that both proposals pertained to.the same property. The proposal is to amend the Official Street Map to include these streets and change the zoning in the area. She stated that Leif Larson informed her that the Boundary Review Board just waived jurisdiction on these items and has been approved for annexation. The RS-8 Zoning proposal is for 8,000 sq. ft. lots and to adopt the street map as indicated, -Ms. Charleson continued, and that the county zoning was equal to that of RS-81, it was 8400, which is 400 sq. ft. over the City's RS-8. Also, most of the property was already developed. The site is just north of the Perrinville plat. After a brief discussion, the hearing was opened to the public, no one ! wished to speak and the public portion was closed.
