2.2 Along with the P.R.D. application, defendant David
Kinderfather filed an environmental checklist: for the project. On
Ht
ay 20,�1978, the City Planner issued a declaration of non -
significance. To the best of plaintiffs' knowledge, no draft.
D.N.S. was circulated to interested parties nor was there a period
of time available to interested parties to comment on the proposed
D.N.S.
2.3 -Prior to the filing of P.R.D. 2-78, another P.R.D.
application covering a portion of the same property (subject to
P.R..D.'2-78) was filed, evaluated and finally approved. The
applicant of that P.R.D.,filed as P.R.D. 4-77, sold his property to
the present defendant, David Kinderfather, who subsequently filed
a new application (P.R.D. 2-78) which covered the same property
subject to P.R.D. 4-77 and a smaller adjacent parcel to the north.
The first P.R.D..was for 16 units while the second was for 29 units
2.4 During the Planning Commission hearings on the first
application, some of the plaintiffs, residents of Lynnwood, were
rudely treated by certain members of the Edmonds Planning
Commission and discouraged from voicing their disapproval of the
P.R.D.
.2:5 During the review and approval procedure for the
second P.R.D. application, P.R.D. 2-78, plaintiffs were denied the
opportunity to fully be heard on their objections to the proposed
development. This denial was accomplished by numerous me(. -hods, not
the least- of which involved the defendant city's failure to ade-
quately notify -co ncerned residents of meetings where action was to
be taken by city officials.
2.6 From the record it is unclear whether the City fully
