Box 10 Eastsourid, WA 98245 SUBJECT: Minor Modification to Short Plat at 15709 9th Ave N Mr. Murray, City staff has reviewed the minor modification application you submitted for the 2 -lot short plat at 15709 9th Ave N, file number phn20070013. The minor modification requests deletion of or waiver of the requirement to construct curb, gutter and sidewalk along the frontage of the short plat property. City code requires sidewalks be constructed as a condition of development approval at the subject site. During preliminary review of the short plat the Engineering Division established a requirement to construct curb, gutter and sidewalk along the frontage of the property as a condition of short plat approval. The Plaiming Division decision of approval for short plat PLN20070013 was issued on July 26, 2007 and was never appealed. After further review of the minor modification application, it has been determined that a request for waiver from the requirement to construct sidewalks cal of be processed as a minor modification. As you were previously informed, the application fee will be refunded to you. On December 2, 2009 City staff members Rob English, Jen Machuga and myself met with you to discuss options for moving forward with the short plat development. We discussed the possibility of providing the City with a pedestrian easement for those portions of sidewalk that would extend onto private property should the sidewalk be constructed along the frontage of the subj ect property without rc -alignment of the road. A pedestrian easement would not affect setbacks or lot area as established with the preliminary short plat approval. You had asked about the possibility of volunteering to constntct, frontage improvements at an alternate location, possibly on the east side of 9"' Ave N near the intersection of Puget Way. After completing a preliminary review, it may be possible to build the sidewalk at this location. If you would like to pursue this option, a developer agreement would have to be drafted to address the teri s and conditions for building the sidewalk at • Incorporated August 11, 1890 Sister City - Hekinan, Japan a different location. You would be responsible for paying the City's administrative costs at a rate of $60 per hour as well as any associated legal fees for drafting this agreement. The proposed agreement would then be presented to Council for consideration and a public hearing held to receive public comment.
