Mr. Murphy said the implements of planning is the passage of protective ordinances. It was then moved by Mr. Haines, seconded by Mr. Thompson, that preliminary plat No. P-7-66 be approved subject to the engineer's requirements in the check list as submitted. Mr. Propst determined that Frederick Place will be widened to take care of this plat. Motion carried. P-9-66, B.N.A. Investors, Preliminary ?lat of "MCUNT BAKER SEAVUE ESTATES" Affidavits of publication and poster were presented, with note of notice to adjacent property owners. Departmental reports and recommendations were read and made a part of the file. Mr. A. 0. Holte, representing petitioners for the plat, stated that all of the arguments had been advanced on the plat. All of the legal and planning facets are in favor of . granting the plat. Any rezone cannot have any effect on this plat that is being submitted at this time. Mr. Larson said that regular engineering requirements had been brought to the attention of the Planning Commission; that there is a 10' easement off the south side of Lot 41 for 300' which serves as a joint easement for the property to the south. Also, lots 4 through 9 would be required to connect to sewers only when they are put in; therefore, the west end of the plat could not be developed at this time. Due to filling in of the drainage area, a waiver of damages should be acquired from the adjoining property owners prior to filling. Mr. Leroy Middleton, engineer, said that on the matter of the 10' easement, it wasn't discovered until that day. It was a mutual easement with another 12' on the south side. They will have to take the 10' area off that end and make lots 10, 11, and 12 wider to meet minimum lot size requirements, since easements may not be included. Mr. Dysart said he would like the record to reflect that they entered the same objection to this plat as the other. It.was.then moved by Mr. Haines, seconded by Mr. Nordquist, that preliminary plat No. P-9-66 be approved subject to the requirements of the City Engineer as presented to the Planning Commission, with the adjustments to be made to meet minimum lot size requirements. Motion carried. P-8-66, Halo Homes, Inc., Preliminary Plat of "HALO HOLLOW" Affidavits of publication and poster presented, with note of notice to adjacent property owners. The reports and recommendations of the Engineering Department, the Health Department, the Fire Department, and the professional planner were read and made a part of the file. The report of the City Engineer noted that the property is presently acting as a drainage ponding area, and if filled, the drainage would be directed to the north and further aggravate the many drainage problems in the area. He recommended that until an adequate drainage system is installed for the Five Corners area as indicated in the Comprehensive Drainage Plan, the plat be disapproved. Mr. Middleton noted that there is a plat to the east fully developed. This is the only possible way to plat the property, he said. There is an existing sewer line with a 10' sewer easement that runs through it. As to drainage, Mr. Middleton said there is a drainage course !-:,at runs through the property, and the water does run in a drainage course northerly and ends in a draw in a dip in a lower road. This property now is a low area, and water stands there, and water runs through in a culvert to 206th. The developer is providing a 21" storm sewer from south and north. Some additional water from cul de sacs. It is true, he said, that ultimately the problem would have to be resolved with proper drainage. Mr. Larson said that this is a problem in many areas in the city and is causing property damage and gets down to the fact that the city by some means should be financing the improvements to our downstream structures. Filling this area would cause damage and lawsuits. After extensive discussion, Mr. Haines moved that the matter be continued to the meeting of December 21st. On second by Mr. Nordquist, the motion carried.
