01966V-73-77 i has been discussed at great length by the governing bodies of the City. Both the Planning Commission and the City Council have debated these. In the summer of 1977, the potential use of bonus density was eliminated. This is 17% short for develop- ment of a seven -unit apartment building,.which is well over the lOX allowance which has been used as a rule ofthumb. The staff recommended denial of this application. Chairman Bailey opened the public portion of the meeting. The applicant had nothing to add. Ken Hovde noted that one bonus for the applicant was that he bought the property in 1961 so there would be good profit in selling in 1978. Bill Leraas asked if Mr. Davis has his plans drawn up. Mr..Davis responded that he hadn't. Mr. Hovde asked Mr. Davis how high the building would be. .Approximately thirty- three feet was the response. Mr. Hovde noted to Mr. Davis that if he had the complex under design and'had five apartments basic- ally alike that the sixth one could be double in size. He also told Mr. Davis that he could make it work well and stay within the code requirements. He pointed out that Edmonds was a bed- room area and the City was trying to keep it top notch and not dilute what the City has. A 110TION WAS HADE BY KEN HOVDE. SECONDED BY HAROLD HATZENBUHLER, THAT BECAUSE THE APPLICATION DID NOT MEET THE CRITERIA OF THE ZONING CODE, THAT V-72-77 BE DENIED. NOTION CARRIED. MONOGRAM LUMBER COMPANY - Variance of 5' from required 10' set- back buffer at 22800 76th Avenue West (CG) It was noted by Mrs. Block that this variance by Monogram Lumber Company, located at 22800 76th Ave. 14., isbecause of the rela- tion it has to a multiple -family residential zone. This is not a rezone. There is a change in topography that is not generally applicable to other lands in this district. The buffering re- quirement is not generally applicable to the CG zone, only when abutting a.residentially classified zone. These conditions do not result from the actions of the applicant. It is not prac- tical to require the 10 foot buffer, a turning area is required in the center of the site. Granting of a variance will not be detrimental to the health, safety, or welfare of property owners in the vicinity. In reviewing this application the staff thought that a variance of three feet would enable the applicant to align the new building with the existing building. This would be in harmony with the zoning code because it would create a buffer. The staff recommended that the variance be .three feet instead of the requested five feet. This recommendation is also expressed by the Fire Department. Slides were shown of the existing fence, the warehouse and arhere the building would go. Mr. Hovde said*he thought everybody would be better off if the property owner could use this property. Mr. Robinson stated that in this parti- cular case it negated the need for a buffer. 1•1r. Hatzenbuhler commented that it would be better to have the new and old build- ing line up. Mrs. Block said that was the staff recommendation. but the applicant would still need approximately a*. 3 foot. va.riangp.:.:;. With this variance. they could be even with the existing strut ture. A MOTION WAS MADE BY HAROLD HATZENBUHLER. SECONDED BY KEN HOVDE THAT V-73-77 BE APPROVED WITH A 3 FOOT VARIANCE SO THAT THE 4E:1 STRUCTURE MAY BE ALIGNED WITH THE PRESENT STRUCTURE AND BECAUSE THE -VARIANCE REQUESTED MET ALL CRITERIA. MOTION CARRIED. 44077 THOMAS.-,FISHER - Variance of 5' from required 20' front yard setback at 1047 Bell Street (RS-6) firs. Block told the Board that this variance of 5' from the re- quired 20' front yard setback was to allow the applicant to con- struct a garage. This is not a rezone and there are not condi- tions generally applicable to other lands in the same neighbor- hood. Strict enforcement of the code would not deprive the appli- cant of rights enjoyed by other properties. There is.no special condition that resulted from the action of the applicant.
