The site is on or adjacent to both a geologically hazardous area and a stream (Perrinville Creek). I have attached a map that shows the approximate location of 2-foot contours taken from our LIDAR map, and also shows where the stream channel may be located. When sites contain or are adjacent to critical areas, studies are required to ensure that the critical area and its buffer will be protected from the project, and the report may also include mitigation for potential impacts. Because the project is proposing to replace an existing rockery with a new retaining wall, we could consider reviewing the project without requiring full studies. Please submit the following so we can be assured that there will be no adverse impacts to the critical areas: Geologically Hazardous Area: a. Thank you for submitting a geotechnical report for construction of the retaining wall. The Critical Areas chapter that addresses geologically hazardous areas (ECDC 23.80) basically says that geologically hazardous areas can be altered, but we just need to make sure that the project will not have any impacts to the stream below. Please have the qualified geotechnical engineer submit a statement on the following items (#1-3): ECDC 23.80.060.A Alterations of geologically hazardous areas or associated buffers may only occur for activities that: 1. Will not increase the threat of the geological hazard to adjacent properties beyond predevelopment conditions; 2. Will not adversely impact other critical areas; 3. Are designed so that the hazard to the project is eliminated or mitigated to a level equal to or less than predevelopment conditions; and 4. Are certified as safe as designed and under anticipated conditions by a qualified engineer or geologist, licensed in the state of Washington. Perrinville Creek: b. Perrinville Creek is on/adjacent to the property. Normally, we would require the applicant to hire a qualified biologist to flag/survey and classify the stream so that we know exactly where it is and what size buffer to apply. For this project, we may require less from the applicant because the scope of work is to replace the existing rockery with a new retaining wall. I have attached a list of the qualified professionals for your convenience. These are agencies that the City has already reviewed their qualifications according to ECDC 23.40 and has determined that they are qualified professionals – you are not required to choose from the list, it is just intended to make things easier for you because it may reduce the chance of requiring a third party review. If you would like to hire someone who is not on the list, we may require a statement on his or her qualifications, pursuant to ECDC 23.40. Please have a qualified stream consultant review your proposal and submit a statement that addresses the following code section, taken from ECDC 23.90 (Fish & Wildlife Habitat Conservation Areas): ECDC 23.90.040.B.1 b. The activity is designed so that it will not degrade the functions or values of the fish habitat or other critical areas; e. Any impacts to the functions or values of the fish and wildlife habitat conservation area are mitigated in accordance with an approved critical areas report. Thank you for your cooperation.
