Due to the presence of a Landslide Hazard Area on/adjacent to the northwestern property line, the proposed residence is subject to the critical areas requirements of Edmonds Community Development Code (ECDC) Chapters 23.40 and 23.80. Please delineate the top of the steep slope on your site plan and provide the shortest distance from the top of the slope to the proposed residence. If you are proposing to locate the residence within 65’ (the standard required 50’ buffer plus 15’ critical areas setback) of the top of the slope, a report by a qualified geotechnical engineer meeting the requirements of ECDC 23.40 and 23.80 must be submitted. Setbacks: 2. The required side setbacks for the RS-20 zone are a minimum of 10’ per side, while both sides must add up to a total of 35’. The residence that was demolished from the site was nonconforming in that it did not meet the minimum required side setbacks for the RS-20 zone; therefore, it was subject to the nonconforming structure requirements of ECDC 17.40.020. ECDC 17.40.020.F states, “If a nonconforming building is destroyed or is damaged in an amount equal to 50 percent or more of its replacement cost at the time of destruction, said building shall not be reconstructed except in conformance with the provisions of the Edmonds Community Development Code.” Based on this code section, the new proposed residence must meet all required setbacks. Please modify your site plan and building plans so that the proposed residence meets the minimum required setbacks for the RS-20 zone. Additionally, due to the fact that the shape of the proposed residence will change in order to comply with setback requirements, please note that all height calculations, lot coverage calculations, impervious surface calculations, etc. will need to be updated as well. Please submit three copies of the updated site plan (at least one copy must be reduced in size) and only two copies of any affected sheets of the building plans. Please make all submittals to a Development Services Permit Coordinator, Monday through Friday, excluding Wednesdays, between 8:00 am and 4:30 pm.
