That variance only allowed the reduced rear setback for the work done in 1998 on the porch and roof. The proposed addition of a new second story must meet the setbacks as they exist today – 25’ for the rear property line setback. The Hearing Examiner’s decision in V-98-65 that you submitted lists three conditions of approval, the first of which states: All future expansions, additions, accessory structures must comply with standard zoning setbacks. From this language, it is clear that any additions, like that proposed in BLD-2008-0258, must comply with the standard 25’ rear property line setback for your parcel in the RS-20 zone. In order to continue with your project, please submit three copies of your updated site plan (one reduced size) and two sets of any updated pages of the building plans showing the relocation of the addition to comply with the 25’ rear setback requirement.Please make all submittals to a Development Services Permit Coordinator, Monday through Friday, 8:00 am to 4:30 pm, except on Wednesdays when we are closed for permit review.
