During review of the subject submittal, it was found that the following information, corrections, or clarifications need to be addressed. Please respond to the following items, so that the review can be completed: Setbacks: 1. The subject property is zoned RS-8 (Single-family residential). Setbacks for RS-12 zoned property is outlined in ECDC 16.20.030 and are as follows: Zone Minimum Street Minimum Side Minimum SetbackSetbackRear Setback RS-8 25 feet 7.5 feet 15 feet The plans submitted for the addition show the southeast corner of the existing residence being 6.89 feet from the property line. This would make the existing residence nonconforming with respect to the side setback. While the existing residence may be a nonconforming building, pursuant to ECDC 17.40.020.D.2 alterations to nonconforming structures cannot expand the nonconformity. It appears from the site plan that the addition in the rear of the house lines up with the existing residence, which would place it in the side setback, and thus expand the nonconformity (more house in the setback). The addition must meet the current zoning setbacks, which pursuant to ECDC 16.20.030 is 7.5 feet for side setbacks in the RS-8 zone. Please revise the plans so that the addition meets the required zoning setbacks as identified above. Feel free to give me a call if you have any questions.
