This makes the existing deck nonconforming. Nonconforming structures may be kept and maintained per ECDC 17,40.020 but they may not be expanded unless that expansion meets current code requirements. As proposed, it appears a small portion of the deck extension would also be within the street setback area. Please verify the location of the proposed deck extension to ensure it meets the 25'street setback requirement. RESOLVED, thank you. 2. Critical Areas: If any deck expansion takes place, it will occur within identified critical areas pursuant to ECDC 23.40; specifically, the site contains or is adjacent to erosion and possible landslide hazards (CRA -2009-0056). As a result, please submit a geotechnical report describing the impact of the proposed deck extension on the western slope per ECDC 23.80. UNRESOLVED — Because of where the proposed deck expansion will be located relative to the adjacent critical area, I cannot continue review on the deck without an indication from a geotechnical engineer that it meets the criteria found in ECDC 23.40 and 23.80.
