S LOCATED AT 1024 – 5 Dear Mr. Healey: I have reviewed the above building permit application for the Planning Division, and it was found that the following information, corrections, or clarifications will need to be addressed before review can continue: Height 1.: At the time the existing structure was constructed, the maximum allowed height was 35 feet; however, since that time, the height limit applicable to the subject site has been reduced. Pursuant to Edmonds Community Development Code (ECDC) 16.30.030, the maximum allowed height for the RM-1.5 zone is currently 25 feet. The roof only may extend up to five feet above the stated height limit if all portions of the roof above the stated height limit have a slope of 4 inches in 12 inches or greater. The existing building is considered nonconforming in respect to height because it was permitted at a maximum of 35 feet, but does not comply with current height regulations. Thus, the building is subject to the nonconforming requirements of ECDC 17.40.020. As such, ordinary maintenance and repair of the building is permitted, but alterations that would increase the degree of nonconformity are not permitted. Therefore, the proposed third floor roof cannot be approved unless it can be shown that this roof will comply with the current height limits of the RM-1.5 zone. Please either remove the proposed roof from the plans or provide height calculations and building elevations indicating the height of the proposed roof and showing that it will comply with the height regulations of the RM-1.5 zone. All submittals should be made to a Development Services Permit Coordinator, Monday through Friday, between 8:00 am and 4:30 pm.
