Before I can sign off on the permit, however, the following information needs to be clarified in a written response: 1. Rear setback: The existing deck being replaced encroaches into the required 15' rear setback. This means the structure nonconforming according to ECDC 17.40. The proposed 2 -foot expansion of the existing deck would further encroach into this rear setback area. According to ECDC 17.40.020.13, "[a] nonconforming building or structure may be maintained and continued, unless required to be abated elsewhere in this chapter or section, but it may not be changed or altered in any manner which increases the degree of nonconformity of the building except as expressly provided in subsections (C) through (I) of this section. " As the code indicates, a nonconforming structure may continue and be maintained provided it is not expanded and unless the another portion of the code requires it to be abated. The City of Edmonds does not have record that a building permit was issued for the existing deck. As a result, the existing deck is considered to be an illegal structure and must be removed unless the owner can produce a copy of an approved building permit for the deck. If a replacement deck is desired, please note that it must meet the setbacks required by the zone (RS -6) where the street setback is 20', the side setbacks are 5', and the rear setback is 15'. For this particular lot, the rear setback is taken from the eastern property line and the side setbacks are measured from the north and south property lines. Please submit three copies of your updated site plan and two sets of any updated sheets of the building plans.
