The current owners of the property and structure located at 16330 7511' Place West have applied for a permit to replace a second -story deck that is non -conforming because it encroaches into the north sideyard setback. The owners and applicant removed the deck and had begun replacement work when a stop work order was issued for the project, at which time permit procedures were begun by the applicant under Plan Check 04-201. The applicant states that they want to and are proposing to replace the deck in the exact dimensions of the original deck that was there when they bought the house and do not propose to extend the deck beyond what was existing prior to removal of the deck. It is difficult for the City to verify what the exact dimensions of the non -conforming deck where at the time of its removal. Examination of historical records and permits, and examination of the remaining. portions of the deck including location of joists, footings, etc. are the best means available. Documents obtained from the Snohomish County Assessor indicate that the decks dimensions were 15' (north -south) by 14' (east -west). The applicant's plans and the proposed replacement deck indicate that the deck was slightly larger and has different dimensions, which are 16' (north -south) by 14' (east -west). The permit application plans move the deck one -foot towards the house and one -foot south along the house. The replacement deck is not proposed to extend any further to the north and is proposed to be rebuilt aligned with the hand rail from the original deck, which establishes the northernmost part of the original deck. The issue at hand is whether the replacement deck will expand the non -conformity of the deck by extending further to the north than the original deck did, and the answer is no, it will not. The discrepancy between the measurements of the deck in the historical documents and in the current permit application for the deck replacement are moot since the non -conformity will not be increased. Please see the attached photographs that document the site and the location of the handrail, which establishes the northernmost section of the original deck and the point which any replacement deck may not extend beyond. We are not reviewing the deck application with I' respect to the complete list of submittal and geotechnical report requirements in the ECDC. We generally concur with the statements made in the HWA Geosciences report regarding the site conditions and suitability for the new deck. However, the soil conditions are described as medium dense to dense based only on shallow hand probing. In contrast, boring logs from adjacent properties show soils 1 that are loose to medium dense in the zone of the planned deck foundations, and portions of the planned Z O deck area may be in areas of historically placed fill. Recommendations for new deck foundations in the m' HWA Geosciences report included a requirement to compact soil to dense/hard condition. This requirement may not have been practical with the soil conditions at the site. L =4 -n i SUMMARY Site development. in the Meadowdale Earth Subsidence and Landslide Hazard Area requires an explicit statement of the stability of property and its development, including site improvements. The HWA Geosciences report identities the project location within the Meadowdale Landslide Complex and concludes that the proposed construction will not reduce the stability of the site or adjacent sites, but does not contain a more detailed discussion of risk as called for in ECDC 19.05. It is Landau Associates' opinion that the Dent deck submittal does not need to satisfy all of the detailed requirements for site development stated in the ECDC 19.05, and the geotechnical report provided for this project adequately addresses the stability issue, given the nature of the new construction.
