Staff concludes that the work proposed under Building Permit bile No. BLD -2007-1022
is allowed pursuant to ECDC 17.40.020(D)(2) and (3), as the following have been
concluded:
• The proposed improvements show the second story addition and garage enclosure
complying with minimum required setbacks, and
• The required work for the five-foot nonconforming portion of the building
requires an augmented foundation which necessitated the removal of the walls to
comply with building codes.
