Dear Mr. Ostrow, GARY HAAKENSON MAYOR The City is in receipt of your request for Alternative Materials and Methods of Construction Equivalency (letter received July 18, 2008) in accordance with section 301.2 of the Uniform. Plumbing Code (UPC) for a Rainwater Harvesting System at PCC Market. The request states that the rainwater will be used to supply non -potable water closets, urinals, and the landscape irrigation system. Should there be insufficient rainwater for the system to function, the system is designed to switch automatically to supply water from the public water system. The public water system is protected from contamination from the rainwater harvesting system with a reduced pressure backflow assembly device and will be tested at minimum on an annual basis by a Certified Backflow Assembly Tester and report submitted to the City of Edmonds and Olympic View Sewer and Water District. We propose to install and operate a rainwater harvesting system to provide a portion of the domestic supply and irrigation water. Our submittal has been prepared in accordance with the City of Edmonds Rainwater Harvesting System Plumbing Policy & Permit Procedures, dated 25 February 2008. Our purpose in installing the rainwater harvesting system is to practice and promote sustainable building practices using the U.S. Green Building Council's LEED program. Specifically, we are following the LEED guidelines for Sustainable Sites and for Water Efficiency in order to earn credits towards LEED certification of this project. The rainwater harvesting system is intended to supply 100% of the irrigation water and 67% of the water required to flush interior water closets and urinals, for a combined total of approximately 100,000 gallons of annual potable water savings. Additionally, we will install signs and offer tours to educate store customers and the general public about the rainwater harvesting system. As shown in the engineering drawings and calculations in our permit submittal, the rainwater harvesting system is intended to provide fresh water in sufficient quantity and at suitable pressure to operate the plumbing fixtures and irrigation system. It should be noted that the rainwater harvesting system will not be providing water that is treated to potable standards. However, potable water is not required for flushing water closets and urinals, nor for irrigating landscape plants. All pipe, pipe fittings, traps, fixtures, material, and devices used in a plumbing system shall be listed or labeled (third -party certified) by a listing agency (accredited conformity assessment body) and shall conform to approved applicable recognized standards referenced in this code, and shall be free from defects. Unless otherwise provided for in this code, all materials, fixtures, or devices used or entering into the construction of plumbing systems, or parts thereof, shall be submitted to the Authority Having Jurisdiction for approval. 301.1.2 Marking. Each length of pipe and each pipe fitting, trap, fixture; material, and device used in a plumbing.�'system shall have cast, stamped, or indelibly- marked on it the manufacturer's mark or name, which shall readily identify the manufacturer to the end user of the product when such marking is required by the approved standard that applies. When required by the approved standard that applies, the product shall be marked with the weight and the quality of the product. All materials and devices used or entering into the construction of plumbing and drainage systems, or parts thereof, shall be marked and identified in a manner satisfactory to the Authority Having Jurisdiction. All such marking shall be done by the manufacturer. Field marking shall notbe acceptable. 301.1.3 Standards. Standards listed or referred to in this chapter or other chapters cover materials that will conform to the requirements of this code, when used in accordance with the limitations imposed in this or other chapters' thereof and their listing. Where a standard ' covers materials of various grades, weights, quality, or configurations, there may be only a portion of the listed standard that is applicable. Design and materials for special conditions or materials not provided for herein may be used only by special permission of the Authority Having Jurisdiction after the Authority Having Jurisdiction has been satisfied. as to their adequacy. A list of accepted plumbing materials standards is included in Table 14-1. All I.APMO Installation Standards are included in Appendix I for the convenience of the users of this code. They are not considered as a part of this code unless formally adopted as such by the Authority Having Jurisdiction. 301.1.4, Existing Buildings. In existing buildings or premises in which plumbing installations are to be altered, repaired, or renovated, the Authority Having Jurisdiction has discretionary powers to permit deviation from the provisions of this code, :provided that such a proposal to deviate is first submitted for proper determi- nation in order that health and safety require- ments, as they pertain to plumbing, shall be observed. 301.2 Alternate Materials and Methods of Construction Equivalency. Nothing in this code is intended to prevent the use of systems, methods, or devices of equivalent or superior quality, strength,' fire resistance, effectiveness, durability, and safety over those prescribed by this code. Technical documentation shall be submitted to the Authority Having Jurisdiction to demonstrate equivalency. The Authority Having Jurisdiction shall approve the system method or device when determined to be equivalent or superior. However, the exercise of this discretionary approval by the Authority Having Jurisdiction shall have no effect beyond the jurisdictional boundaries of said Authority Having Jurisdiction. Any alternate material or method of construction so approved shall _ not be considered as conforming to the requirements and/or intent of this code for any purpose other than that granted by.the Authority Having Jurisdiction I when the submitted data does not prove equivalency. 301.2.1 Testing. The Authority Having Jurisdic- tion shall have the authority to require tests, as I proof of equivalency. 301.2.1.1 Tests shall be made in accordance with approved standards, by an approved testing agency at the expense of the applicant.' In the absence of such standards, the Authority Having Jurisdiction shall have the I authority specify the test procedure. 301.2.1.2 The Authority Having Jurisdiction shall have the authority to require tests to be made or repeated if, at any time, there is reason to believe that any material or device no longer conforms to the requirements on which its approval was based. The Rainwater Harvesting System and back flow protection system installed by PCC on the premises shall at all times be maintained in accordance with the policies and procedures of the plumbing code of the city of Edmonds; and, 3_ PCC shall not abandon nor remove the Rainwater Harvesting System from the Premises without the approval of the City of Edmonds and issuance of the requisite permits. 4. PC.0 shall not relinquish its right to occupancy of the Premises without first removing the Rainwater Harvesting System from the Premises in accordance with Paragraph 3 above or alternatively contractually requiring the next occupant to be bound by all of the terms of this Notice and Covenant. 5. Should PCC abandon or remove the Rainwater Harvesting System from the Premises without the approval of the City of Edmonds or issuance of the requisite permits, or relinquish its right to occupancy of the Premises without first removing the Rainwater Harvesting System from the Premises in accordance with Paragraph 3 above or alternatively without contractually requiring the next occupant to be bound by all of the terms of this Notice and Covenant, PCC shall pay the City of Edmonds One Hundred Dollars ($100.00) per full or partial day commencing on the 31" day after receipt by PCC of written notice of the deficiency and an opportunity to cure, that the Rainwater Harvesting System is not removed from the Premises with the approval of the City of Edmonds and requisite permits as reimbursement for the City of Edmonds' administrative expenses of pursuing compliance with Paragraphs 3 and/or 4 of this agreement. The aforementioned One Hundred Dollar per day payment by PCC to the City of Edmonds for breaching the terms of Paragraph 3 and/or 4 shall be in addition to, not in lieu of, any and all other compensatory damages that the City of Edmonds may be entitled to under the law.
