For and in consideration of the mutual benefits derived herein and other good and
valuable consideration, receipt whereof is hereby acknowledged, the ,00llowinQ part

Charlotte Gardens, according to the plat recorded under Snohomish County Auditor's file
number 200510145249, hereby conveys and quit claims to the current and future owners,
successors and or assigns of said lot 5, of the above described property, a non-exclusive
easement for private drainage facilities, including the right of reasonable ingress and
egress to maintain and repair said drainage facilities over under and across the following
described land of said parties herein:
The northeasterly 25 feet of lot 6 and Tract 997, running parallel with the
southwest boundary of Tract 999, and lying southeasterly of the catch basin as currently
located and depicted within Tract 997, Charlotte Gardens, according to the plat thereof
recorded under Snohomish County Auditor's file number 200510145249, records of
Snohomish County Washington.
Tax Parcel: 010372-000-005-00; 010372-000-006-00; 010372-000-996-00
This easement is appurtenant to the following described land owned by said parties
herein and the easement and covenants contained herein shall run with and burden the
property described herein. Said parties herein their successors and or assigns shall have
the right to maintain and repair said drainage pipe line, provided however that the parties
and their successors shall use reasonable care to restore the surface of the land and to
replace the landscaping, plantings, lawn, personal property, and any other improvements,
to original or better condition.
The doctrine of merger shall not apply with regard to the extinguishing of said easement
herein.
