20110921133029028.pdfWSS/naa 08/22/85;08/28/85 FINDINGS OF FACT AND CONCLUSIONS OF LAW OF THE EDMONDS CITY COUNCIL RE: Appeal of Planning Board Recommendations: Proposed Rezones R -2-85A and R -2-85B After notice given in accordance with law and ordinance, the Edmonds City Council conducted a public hearing on August 20, 1985, regarding an appeal of Planning Board Recommendations in Rezone Applications R -2-85A and R -2-85B. Based upon the public hearing and the record of that proceeding, the Edmonds City Council reaches the following Findings of Fact and Conclusions of Law: 1. The proposed rezones are described in exhibits attached to the City Planning Department's Report to the City Council in this matter, said exhibits being incorporated by this reference as fully as if herein set forth. 2. With respect to Rezone request R -2-85A the City Council adopts the Findings and Conclusions contained in the Edmonds Planning Board recommendations and makes the following additional Findings of Fact and Conclusions of Law: A. The Edmonds City Council finds that the comprehensive plan should be interpreted in such a manner that low density residential uses include the R-12 and R-20 zoning categories as contrasted against higher residential uses in the R-6 and R-8 categories. Based thereon, the City Council finds that the proposed rezone from a relatively low density zone (R-12) to a higher residential density zone (R-8) conflicts with the provisions of the comprehensive policy plan. B. The Edmonds City Council further finds that the general neighborhood and area effected by this rezone has been proposed for similar rezones in the past and turned down by prior City Councils. The City Council finds that this review has created a consistent City policy with regard to the area, favoring lower density residential uses. The City Council therefore finds that there has been no change in this consistent City policy such that this rezone should be granted. C. The City Council further finds that the only change in the area has been an expansion of institutional uses which tend to preserve large open areas, have a relatively low density and a concomitantly low demand on the provision of City services. D. The Edmonds City Council finds that the area proposed under R -2-85A is a small area, with irregular boundaries in which it would be difficult to appropriately administer the zoning regulations, would create citizen confusion and would not provide a proper transition between adjoining zoning categories. 3. With rspect to Rezone request R -2-85B, the City Council adopts the Findings of Fact and Conclusions of Law as set forth by the Planning Board Recommendation and includes its additional findings 2(A), 2(B) and 2(C) as above listed. 4. Based upon these Findings of Fact and Conclusions of Law, the City Council hereby denies the rezone request put forward in Applications No. R -2-85A and R -2-85B. ADOPTED this day of441a�-, 1985.
