20110921133658241.pdf05/10/85 WSS/naa ORDINANCE NO. 2494 AN ORDINANCE OF THE CITY OF EDMONDS, WASHINGTON, AMENDING THE OFFICIAL ZONING MAP OF THE CITY OF EDMONDS, WASHINGTON, BY CHANGING THE ZONING CLASSIFICATION OF CERTAIN PROPERTY SPECIFIED IN APPLICATION #RO41-®85 FROM RS -12 TO RS -8, AND FIXING A DATE WHEN THE SAME SHALL BE EFFECTIVE. WHEREAS, the Planning Board of the City of Edmonds, Washington, held a public hearing to consider rezoning a certain parcel of real property in the City of Edmonds from RS -12 to RS -8 and after said hearing, forwarded its recommendations to the City Council in Planning Board Decision #R--1-85, and WHEREAS, the City Council of the City of Edmonds, Washington, considered the Findings of Fact, Conclusions and Recommendations of the Planning Board as contained in its decision, public testimony at public hearing, and the report from the City staff, and WHEREAS, based on the foregoing, the City Council determined as follows: 1. That the Council finds the following facts and reaches the following conclusions of law based upon its review of the public testimony, the staff reports, and the recommendations of the Planning Commission that: A. The proposed rezone conforms with the Comprehensive Plan which designates the subject tract as low density residential. B. The proposed rezone is consistent with the purposes of the zoning ordinance as set forth in Chapter 16.10 of the Edmonds Community Development Code. C. The proposed rezone is in harmony with the existing land use and zoning of surrounding and nearby property, all surrounding property is zoned and in use as single family residential. The properties to the south, west and east are all zoned as RS -8 and in use as such. D. No significant changes have occurred in the surrounding neighborhood. E. Council specifically finds that the property is economically and physically suited for RS -8 zoning and residential use; and F. Council further finds that the relative gain to the public health, safety and welfare justifies the rezone, and there is no potential decrease in value threatened to the property of any person in the area of the rezone. 2. There are no significant adverse environmental impacts to the surrounding properties either within or without the jurisdiction of the City of Edmonds which will be affected by the proposed zoning classification of the property or the proposed uses, now, therefore, THE CITY COUNCIL OF THE CITY OF EDMONDS, WASHINGTON, DO ORDAIN AS FOLLOWS; Section 1. The official zoning map of the City of Edmonds, Washington, is hereby amended by changing the zoning classification from RS -12 to RS -8 of certain real property, all situate in the City of Edmonds, Snohomish County, Washington, and more particularly described on Exhibit "A", attached hereto and incorporated herein as if set forth in full. Section 2. The Planning Department Director is hereby instructed to effectuate the necessary amendments to the official zoning map of the City of Edmonds, Washington, consistent with this ordinance. - 2 - Section 3. This ordinance shall be in full force and effect five (5) days after passage and publication by posting as provided by law.
