Edmonds, WA. 98026 Case: # COD2019-0138 Subject Property: 22805 75th Ave. W, Edmonds, WA. 98026 Dear Mr. Scott The City has received a complaint regarding the quantity and condition of vehicles parked outside at the property listed above. A recent inspection of the property noted five vehicles. One of the vehicles did not have current registration and is thereby considered a junk vehicle by City ordinance Vehicles in residential zones are regulated as follows: Nuisances are described as follows: 6.20.041 Aesthetic nuisances. The following nuisances are aesthetic in nature and can negatively impact neighborhood property values and foster blight. The following actions and/or conditions shall be a public nuisance when located in any front, side or rear yard or vacant lot: A. Any junk, trash, or litter. B. Salvage materials or lumber not neatly stacked. C. Any broken, soiled or discarded furniture, household equipment or furnishings. D. Any junk vehicle, vehicle parts or other articles of personal property which are stored, discarded or left in a state of partial construction or repair. G. Exceptions. The nuisances enumerated in subsections (A) through (D) of this section shall not apply to items or materials when: 1. Wholly enclosed within a building; or 2. Located in a rear yard and screened from adjacent properties and the public right-of-way by a five-foot opaque fence or by a vegetative barrier that is between five feet and eight feet in height and provides a visual barrier equivalent to an opaque fence. Corner lots and flag lots which have no rear yard may establish a screening area which qualifies for this exemption in a side yard. [Ord. 3741 § 1, 2009; Ord. 3720 § 4, 2008]. 6.20.043 Protective coverings. Except as otherwise expressly provided by applicable city ordinance or a valid regulatory permit, any condition enumerated in ECC 6.20.040 shall constitute a public nuisance irrespective of whether such condition is covered in whole or in part by a tarpaulin, vapor barrier, canvas or plastic sheeting, or other temporary covering. [Ord. 3720 § 4, 2008]. Vehicles are limited as follows: 17.60.040 Vehicles in residential zones. A. No more than four motor vehicles shall be parked outdoors in the front yard of a residential lot. Each motor vehicle must be currently licensed and operable. 1. Exemptions. a. This regulation does not apply to: i. Motor vehicles when parked in a completely enclosed building or carport, or in a rear yard and screened from adjacent properties and the public right-of-way by a five-foot opaque fence or by a vegetative barrier that is between five feet and eight feet in height and provides a visual barrier equivalent to an opaque fence. Corner lots and flag lots which have no rear yard may establish a screening area which qualifies for this exemption in a side yard;. C. Except for property specifically zoned for and licensed by the city of Edmonds for vehicle use, vehicle storage, repair, or sales, the operating of a vehicle-oriented business is prohibited. D. An intact, appropriately licensed and operable vehicle may be parked or stored outside a structure in the manner provided below: 1. In a front yard, up to four motor vehicles, provided that the vehicle is on a driveway or other improved parking surface. The improved surface in the front yard shall not exceed 50 percent of the required front yard area and the driveway for a two-car garage shall not be wider than 24 feet and for a three-car garage shall not be wider than 30 feet, unless otherwise approved by the city engineer for public safety purposes. 2. In a side yard or rear yard; provided all vehicle parts and accessories, including but not limited to containers of oils and fluids, shall be stored in a completely enclosed building and in compliance with all health regulations and provisions of state and federal law. 17.60.005 Definitions. For the purposes of this chapter, the following definitions apply: “Improved surface” means the outdoor area covered by a permanent hard surface, including concrete, asphalt, or pavers, whether pervious or impervious, which may be designed or used for driving or parking motor vehicles on any parcel of land, excluding public right-of-way. “Required front yard” means the entire lot area between the street lot line and the minimum street setback distance as identified in ECDC 16.20.030. [Ord. 4016 § 2, 2016]. Corrective actions required by November 22, 2019. Please limit the outside motor vehicles to a maximum of four. Each must be currently licensed and operable. Please demonstrate that all front yard vehicles, watercraft and trailers are currently licensed. Compliance will be achieved when there are only four licensed motor vehicles outside in the front, any watercraft or trailers are licensed, all motor vehicles parked in the current driveway and registered to the tenant/resident at this location.
