ProjectProposal: ProjectProposal: The proposal is for the design review of artwork provided by the Max Foundation to be installed on the Landing Building (Arnie’s Restaurant Building). DesignReviewProcess: DesignReviewProcess: The subject site is in Commercial Waterfront (CW) Site zone, and any exterior changes require design review. In this case, General Design Review is conducted by staff, because the project remains under the State Environmental Policy Act (SEPA) threshold. Projects that remain under the SEPA threshold are reviewed by staff and the design review is considered an administrative Staff Decision subject to the requirements of ECDC 20.11 (General Design Review), 20.95 (Staff Decision), 16.55 (Commercial Waterfront), and the Comprehensive Plan. The applicant has submitted a Land Use Application (Attachment 1), a letter related to the scope of work (Attachment 2), and a rendering (Attachment 3) for review. 2. The improvements are proposed on property with a Commercial Waterfront (CW) zoning designation. 3. Review under the State Environmental Policy Act (SEPA) is not required for this project pursuant to WAC 197-11-800 (no changes are proposed on site – only the addition of artwork upon one wall). 4. ECDC 20.11.010 states that design review by the Architectural Design Board is required for any project that requires a threshold determination under the State Environmental Policy Act (SEPA). Projects not triggering the SEPA threshold can be reviewed by staff as a staff decision. 5. The existing building was constructed in 1985, according to the Snohomish County Assessor’s records. 6. The use of the site will not change. 7. The art piece is approximately 5’ x 6’ and was is titled “Biyaya Ng Lupa” or “Blessings of the Land” by Edsel Hermoso Moscoso, a Filipino artist and leukemia survivor (Attachment 3). 8. The Building Division has confirmed that a building permit is not required for this proposal. 9. The proposal would not affect the existing/required development standards for the zone (setbacks, number of parking spaces, floor area, or height). 10. The site fronts on Admiral Way, which is considered a “Local Street.” 11. The applicant has submitted the “Port of Edmonds Art Policy” (Attachment 4), which encourages the incorporation of art into projects. 12. The Comprehensive Plan designation for this site is “Master Plan Development” and it is located within the “Downtown/Waterfront Activity Center.” 13. There are several Comprehensive Plan goals and policies for commercial development, including: a. Downtown Design Objectives are found on pages 38-42 and are intended to encourage high quality, well designed projects to be developed in the downtown waterfront area that reflects the values of the citizens of Edmonds. b. “Improve pedestrian access and way-finding by providing a variety in building forms, color, materials and individuality of buildings” (page 39). c. “Art should be integrated into the design of both public and private developments, with incentives provided to encourage these elements” (page 40). d. “Public art and amenities such as mini parks, flower baskets, street furniture, etc., should be provided as a normal part of the public streetscape. Whenever possible, these elements should be continued in the portion of the private streetscape that adjoins the public streetscape” (page 40). B.Conclusions: 1. The addition of artwork upon the building is an appropriate fit for the site and neighborhood. 2. The project will not affect any of the required site development standards for the Commercial Waterfront (CW) zone, nor will it affect any of the off-street parking requirements for the site. 3. This project meets the design guidelines found in the Comprehensive Plan and the design review chapter of the Edmonds Community Development Code (ECDC) 20.11. The art will add variety to the building and site. 4. A building permit for the proposal will not be required. No building permit was required by the Building Official. PublicComments: PublicComments: The City has not received any comment letters for this project. Decision: Decision Based on the facts, conclusions, and attachments to this report, staff finds that the design review for this project, file ADB-2008-51APPROVEDCONDITION: is with the following 1. Pursuant to ECDC 20.11.050.A, the applicant shall substantially commence with the proposal within 18 months from the date of approval (unless a fully completed application for an extension of time prior to the expiration date has been filed). Port of Edmonds Art Policy AppealsandExpiration: AppealsandExpiration: The following is a summary – any person wishing to file an appeal or extension should contact the Planning Division immediately at 425.771.0220 for further procedural information. Section 20.11.050.A describes the time limits for design review approval: Unless the owner submits a fully completed building permit application necessary to bring about the approved alterations, or, if no building permit application is required, substantially commences the use allowed within 18 months from the date of approval, ADB or hearing examiner approval shall expire and be null and void, unless the owner files a fully completed application for an extension of time prior to the expiration date. For the purposes of this section the date of approval shall be the date on which the ADB's or hearing examiner's minutes or other method of conveying the final written decision of the ADB or hearing examiner as adopted are mailed to the applicant. In the event of appeal, the date of approval shall be the date on which a final decision is entered by the city council or court of competent jurisdiction. Page 3 of 3
