Introduction The Harborgate Condominium Association (Harborgate) originally applied to the City of Edmonds to remove two existing sycamore trees because the trees were uplifting paved areas surrounding the trees and proposed replacing the trees with Japanese maples on September 15, 2008. (Attachment 1) The City requested some additional information on the application on October 7, 2008. Prior to submitting the requested additional information to the City and receiving approval for the removal of the trees, Harborgate had the sycamore trees removed. The City of Edmonds issued an Order to Correct to Harborgate on March 5, 2009 for the removal of the trees without required permits. Harborgate Condominium Association, through Mim Edelstein, contacted the City on March 12, 2009 regarding the tree removal. Ms. Edelstein indicated the original contact person for the application, Marc Creller, no longer represented Harborgate and the association thought they had received approval for the tree removal. Ms. Edelstein further stated Harborgate had the trees removed in part because they were planning to expand the garbage collection area. A revised landscape plan was submitted on April 23, 2009 depicting the proposed expansion to the garbage collection area, and replacement plantings for the removed sycamore trees. (Attachment 2) C. Findings and Conclusions 1. A Iandscape plan for the Harborgate Condominiums was originally approved by the City of Edmonds Architectural Design Board in 1989 under ADB -41-89. (Attachment 3) 2. Landscaping at the Harborgate Condominiums (prior to the removal of the sycamore trees) generally resembles the landscape plant approved under ADB -41-89. The original landscape plan proposed planting quaking aspens where the sycamore trees were eventually planted. Quaking aspens, as proposed on the original landscape plan, can grow to reach heights up to 60 feet. The sycamore trees located on the site can reach 30 to 80 feet in height. 4. Harborgate proposes to replace the removed sycamore trees with a Columnar Norway Maple (Acer platanoides) which is a tree from the City of Edmonds street plan and a rhododendron. Columnar Norway Maple can grow up to 50 to 60 feet in height with a spread of approximately 20 feet. 5. Expansion of the garbage collection area reduces the growing space available for trees, so Harborgate is proposing to replace the second sycamore with a rhododendron. 6. Replacing the two removed sycamore trees with one Columnar Norway Maple and a rhododendron is generally consistent with the originally landscape approved under ADB -41-89. F. Technical Review The Fire Department, Public Works Department, and Parks and Recreation Department have reviewed this application and none of these Departments/Divisions raised any concerns with the proposal. The Engineering Division has noted that some of the uplifted paved areas may be within the public right-of-way of the alley. Be advised that, if any repairs to the pavement are needed within the right-of-way, then a separate right-of-way construction permit would be required. G. Decision Based on the findings, conclusions, and attachments to this report, staff finds that the design review for file number ADB -2008-55 is APPROVED with the following conditions: 1. Planting shall be completed as indicated on the revised landscape plan submitted on April 24, 2009 (Attachment 2). 2. The Columnar Norway Maple shall have at Ieast a 3 inches caliper. 3. Planting shall be completed within one year. Notify the City of Edmonds once the planting has occurred. H. Attachments 1. Application 2. Reconsideration and Appeals Per 20.95.040, a permit applicant may request a reconsideration of this decision by either the original decisionmaker or the planning manager. if the applicant requests reconsideration by the planning manager and the planning manager is not available to render a decision with the time limits required by the ECDC, the planning manager shall designate a supervisor of the original staff decisionmaker to rule on the reconsideration. The request for reconsideration shall be filed in writing with the planning manager within 14 working days after the date of the decision. The requested decisionmaker for the reconsideration shall approve, conditionally approve, or deny the application. The decision shall be in writing, and shall be appealable to the hearing examiner under Chapter 20.105 ECDC. S. Edmonds, WA Hello, This letter is a formal request for a permit to cut down two trees at: Harborgate Condominiums 2233 rd Av. S. Edmonds, WA 98020 _ Information on the trees to be cut. Species of tree: Sycamore Diameter of trees: 10-12" DBH Reason for removal: The root structure of the trees is lifting curbing and paved areas negatively impacting the health of trees and creating problems with driving areas. This will probably cause stability and new root growth problems for the trees and make that portion of driving area affected to be unusable by cars and a walking hazard (according to master policy insurers). Replacement Trees: We propose to replace the two Sycamore trees with two Japanese Maple trees. Please note that included with this letter is a Landscape Site map showing where the Sycamores to be cut are presently located. Future location of the Japanese Maples has not yet been determined. have also presented the planning division with a processing check for the amount of $115.
