ADB -2009-17: The applicant proposes to remove one Douglas fir tree planted at the 4 -unit
condominium complex located at 23601 79"' Avenue West and replace it with a
smaller native conifer better suited to its location.

B. Introduction
The applicant is proposing to remove a
Douglas fir tree that was likely retained
during the development of the Willow
Wood Condominiums in 1971. The tree
located within the condominium's
common area adjacent to the western
driveway onto 79h Avenue West. Whil
trees on individual lots are regulated
through ECDC 15.45, changes to
landscape plans are subject to design
review. The subject application does nc
trigger SEPA review because it is an
amendment to an existing plan; therefor
the proposal may be approved by staff a
an Administrative Staff Decision, subje(
to the requirements of ECDC 20.95.040
C. Findings and Conclusions
1. The tree in question is located in the
open space area maintained by the
Willow Wood Condominiums. The
parcel is zoned RM -2.4.

2. There are a number of medium and larger conifers on the site along with mature landscaping.
Three of the firs sit on the western side of the parcel with two evenly spaced north of the
western driveway and one to the south.
According to the arborist's report, the Douglas fir in question splits into two co -dominant
trunks and the joint shows a weak branch union which would be more likely to fail during a
storm.
4. Landscaping on multifamily parcels must be the requirements of ECDC 20.13.
Given the presence of the other conifers and mature Iandscaping at the site, the overall
landscaping of the site will not be dramatically altered by this proposal as long as the Douglas
fir removed is replaced with a native species of conifer that meets the requirements of ECDC
20.13.
F. Technical Review
The Engineering Division, Fire Department, Public Works Department, and Parks and Recreation
Department have reviewed this application. The Engineering Division noted that since the tree
proposed to be removed is near the street right-of-way and sidewalk, closure will be required
during removal. As a result, a right-of-way construction permit shall be obtained by the applicant
prior to doing any work.
G. Decision
Based on the findings, conclusions, and attachments to this report, staff finds that the design
review for file number ADB -2009-17 is APPROVED with the following conditions:
1. The Douglas fir may be removed and the stump either flush cut or ground out.
2. Per ECDC 20.13.015.B, a six foot native evergreen tree (Western red cedar was proposed)
shall be installed at the location of the removed fir.
3. Ground disturbed during the removal of the fir shall be replanted to match the existing
condition surrounding the replacement.
4. The applicant shall obtain a right-of-way construction permit prior to work.

1. Reconsideration and Appeals
Per 20.95.040, a permit applicant may request a reconsideration of a decision by either the
original decisionmaker or the planning manager. If the applicant requests reconsideration by the
planning manager and the planning manager is not available to render a decision with the time
limits required by the ECDC, the planning manager shall designate a supervisor of the original
staff decisionmaker to rule on the reconsideration. The request for reconsideration shall be filed
in writing with the planning manager within 14 working days after the date of the decision being
appealed. The requested decisionmaker for the reconsideration shall approve, conditionally
approve, or deny the application. The decision shall be in writing, and shall be appealable to the
hearing examiner under Chapter 20.105 ECDC.

Engineering has reviewed and approved the subject application with the following condition
to be noted in the staff report.
The tree subject to removal is located very near 79th Ave W street right-of-way. It is apparent
that vehicles and equipment will need to stage within the street right-of-way and a sidewalk
closure will be required during removal. Prior to beginning tree removal operations, the
owner shall obtain a right-of-way construction permit from the City of Edmonds.
