BLD -2007-0647 Dear Ms, Silver: It has recently come to our attention that the site plan submitted with your building permit application (File No. BLD -2007-0647) to replace your front porch and stairs at 18801 Soundview Place was inaccurate. The site plan submitted with your application shows your lot as being 140 feet deep plus the 10 -foot street dedication that was made to the City in 1984; however, it appears that your lot was reduced to 130 feet deep when the street dedication was made. Additionally, your site plan indicates that the proposed porch and stairs would be 27.5 feet from the property line adjacent to the street; however, you have indicated that following a recent conversation with a surveyor, the street dedication was not shown correctly on the site plan, and the porch and stairs would actually project into the minimum required 25 foot street setback by approximately 7 feet. City staff may only approve a permit application for a structure to project into the minimum required setbacks if a variance is first obtained or if the structure meets the nonconforming requirements of Edmonds Community Development Code (ECDC) 17.40.020. Pursuant to ECDC 17.40.020.17, "Damage less than 50 percent of replacement costs may be repaired, and the building returned to its former size, shape and lot location as existed before the damage occurred, if, but only if, such repair is initiated by the filing of an application for a building permit within one year of the date such damage occurred." (See Enclosed). Therefore, if it can be shown that the previous porch and stairs were nonconforming and that the storm that caused the damage occurred within one year of the date you applied for your building permit application, then the porch and stairs can be rebuilt within the setback as long as they are not altered or expanded in any way from the previous porch and stairs. If the previous porch and stairs are not found to meet the requirements of ECDC 17.40.020, then your building permit will need to be revised so that the proposed porch and stairs meet the minimum required 25 -foot street setback or a variance will need to be obtained. Please submit a revision to your previous building permit (File No. BLD -2007-0647) including an updated site plan indicating the location of the previous porch and stairs. Additionally, please submit a response in writing explaining when the damage occurred and how your proposal will meet the City's code requirements.
