During review of the subject submittal, it was found that the following information, corrections, or clarifications need to be addressed. Please respond to the following items, so that I can complete my review: th Setbacks 1.: The property located at 16917 76 Avenue West is considered a corner lot because the access easement south of the lot is meets the definition of a street (ECDC 21.90.140) since is serves more the five lots. Since the property is a corner lot, the setback from the access easement is the street setback for the RS-12 zone, which is 25ft pursuant to ECDC 16.20.030. The existing house currently sits within this setback area and would be considered a nonconforming building pursuant to ECDC 17.40.020.A. Pursuant to ECDC 17.40.020.D.2, nonconforming buildings may be maintained and expanded so long as any addition does not expand any nonconforming aspect of the building. The proposed second floor addition is within the street setback from the access easement and would be considered an expansion of the nonconforming building because it is adding living area within the required setback (ECDC Interpretation File No. 2003-2). As proposed, the addition is not compliant with the City of Edmonds zoning regulations and cannot be approved by the Planning Division. Please revise the plans so that any addition meets the current zoning setbacks for the property. Feel free to contact me if you have any questions.
