I have reviewed the above building permit application for the Planning Division and it was found that the following information,corrections, or clarifications will need to be addressed before the Planning Division review can continue. 1.Geotechnical Report: The deck is proposed at the top of a steep slope. Please provide assurance from a geotechnical engineer confirming that the proposal will not adversely impact the critical area and that the project (including the weight of the hot tub) will meet the critical areas ordinance. With my review, I need to make sure that the following criteria in ECDC 23.40.160 can be met: ECDC 23.40.160 Review criteria. A.Any alteration to a critical area, unless otherwise provided for in this title, shall be reviewed and approved, approved with conditions, or denied based on the proposal’s ability to comply with all of the following criteria: 1.Theproposal minimizes the impact on critical areas in accordance with ECDC 23.40.120, Mitigation sequencing; 2.The proposal does not pose an unreasonable threat to the public health, safety, or welfare on or off the development proposal site; 3.The proposal is consistent with the general purposes of this title and the public interest; 4.Any alterations permitted to the critical area are mitigated in accordance with ECDC23.40.110, Mitigation requirements; 5.The proposal protects the critical area functions and values consistent with the best available science and results in no netloss of critical area functions and values; and 6.The proposal is consistent with other applicable regulations and standards. 2.Setbacks: Please revise the project so that it meets the required setbacks for the zone. The deck needs to be at least 15’ from the south property line. The patio may be as close as 11’ from the south property line, per ECDC 16.20.040.C. Please show these measurements on the site plan. 3.Hot Tub: Please revise the scope of workto include the proposed hot tub.If the hot tub is over 3’ in height, then it will need to meet setbacks (it will need to be located at least 15’ from the south property line). Please provide the height of the hot tub. This may mean designing the proposal so that the hot tub is below grade (under 3’) and therefore not considered a “structure.” : Please submit a written response to the above, along with any revised plans to your Permit CoordinatorMarie Harrison.
