S Dear Mr. Baily: I have reviewedthe above building permit applicationfor the Planning Division,and it was found that the following information, corrections, or clarifications will need to be addressedbefore review can continue: Critical Areas Determination: 1.A critical areadetermination is required for the subject proposal. Please submit a critical areas checklist(Handout #P20)and associated $100fee. Fence Height: 2.According to ECDC 17.30.000.C,“Unless a variance is first obtained, no fence shall be more than six feetin height as measured from the top of the fence to the lowest original grade.” Additionally, ECDC 17.30.000.D specifies, “When a retaining wall three feet in height or greater is contiguous to and below a proposed fence, the proposed fence may be constructed for the purposes of safety not greater than four feet above the top of the retaining wall or the finished grade, whichever is less, without the necessity for a variance.”Therefore, the proposed fence around the garden center must be reduced in height. If the fence is shifted so that it is not located on top of the retaining wall, it may be a maximum of six feet in height. If it remains on top of the retaining wall, then the height must comply with the above provisions. Garden Area: 3.SheetA-2.1indicatesthat a portion of the outdoor garden area will be covered with pre- fabricated structure.Please provide details and elevation views of this structure. Also, clearly indicate on the plans which portions of the garden area will be covered and which portions will be uncovered. Operating Restrictions: 4.ECDC 16.43.040.A states that all uses within the BD zones shall be carried on entirely within a completely enclosed building with a few exceptions including plant nurseries. Please confirm that the use of the outdoor garden area will be consistent with this exception. Design Review: 5.Design review is required for the proposed improvements.In order to meet the applicable design review requirements, please respond to the following: a.Please note that an administrative design reviewfee of $250is required for staff’s review of the proposal. This fee will be added to the total due for the building permit application. b.Provide color elevationviews of the outdoorgarden center including the fence and cover. Please submit twocopies of allrevised plan sheets to a DevelopmentServices Permit Coordinator.
