A building permit is required for structures that are over 30 inches above ground level at any point along with other requirements related to stairs, railings, etc. The City shows no record for a building permit for this construction. There is also a question of the required setback. The side yard setback in the RS-8 zone is 7 ½ feet. Decks under 30 inches in height are allowed to project into a setback by 1/3 or 4 feet, whichever is less. In this case 1/3 of the setback is 2 ½ feet which would leave a 5 foot setback still required. However, not knowing the measurements of the construction and which portions are over and under 30 inches, itÂ’s impossible to make a definitive conclusion at this point. Once the City is able to review your plans or construction, the setback and permit requirements would become apparent. Corrective actions required: Please contact me by July 30,2009 to respond to this letter and advise the City your strategy for · proceeding. If you prefer, I can meet you at the property to review the structure and provide you with more specific information prior to submitting your application. Please submit a complete application and fees for a building permit by August 12, 2009. If other · construction has been added, please include those additions/alterations in your application. It would be advisable to review your setbacks with the Planning staff prior to submitting your application. A handout is enclosed describing the permit submittal requirements for a deck. Or - please submit an application for a demolition permit to remove the structure. · nd A Permit Coordinator will accept your application at the 2 floor of City Hall.
