The purpose of the Checklist is to enable City staff to determine whether any potential Critical Areas are or may be present on the subject property. The information needed to complete the Checklist should be easily available from observations of the site or data available at City Hall (Critical Areas inventories, maps, or soil surveys). An applicant, or his/her representative, must fill out the checklist, sign and date it, and submit it to the City. With a signed copy of this form, the applicant should also submit a vicinity map or plot plan for individual lots of the parcel with enough detail that City staff can find and identify the subject parcel(s). A review of aerial photography of the vicinity indicates 50% slopes with greater than 20 feet of vertical elevation change. Since a slope of 40% or steeper with a vertical elevation change of more than 20 feet is a critical area, it is determined that there is potentially a critical area on or adjacent to the site. Therefore a Critical Areas Study is required to delineate the boundaries of this potential critical areas, the buffers and setbacks. A licensed land surveyor must prepare a map which delineates areas with slopes of 40% or steeper with a vertical elevation change of more than 20 feet. The surveyor must also indicate the boundaries of the critical area(s), buffers and setbacks. All work required by this determination must be performed through a three party contract and all studies must be conducted according to section 20.1513 of the Edmonds Community Development Code. If the property owner wishes to apply for a specific development permit which they feel would not impact the Critical Areas located on the site, they may submit their proposal to the Planning Department for review. The ECDC does not allow for any development or. alteration of Steep Slope Hazard Areas unless an exemption has been granted. The procedure fo_abtang a: Steep Slope Exemption involves the preparation of a geotechnical analysis of the site by a:State licensed Geotechnical Engineer. This analysis must demonstrate that the site will be stable and the proposed development will not decrease the stability of any adjacent sites. This applicant has provided such an analysis. Decision Based on statements of Fact, Conclusions, and Attachments in this report the -Steep Slope Hazard Areas Exemption request meets all of the exemption criteria and is therefore APPROVED subject to. the following conditions: 1. Any retaining structures on steep slopes shall be engineered structures conforming to the State Building Code. 2. The applicant must comply with the following recommended conditions of the peer review by Zipper Zeman Associates, Inc., dated January 31, 2002: a) The applicant shall provide a supplemental geotechnical analysis concerning seismic slope stability. Should the revised analysis indicate a factor of safety of less than 1.1 for a seismically -induced landslide, the applicant shall redesign the project to provide an adequate factor of safety, or alter the proposed building layout to reflect adequate setbacks and buffers from areas subject to disturbance during the seismic event; b) A temporary erosion control and sedimentation control plan should be prepared; c) Supplemental geotechnical design and construction criteria shall be submitted should the existing timber retaining wall south of the existing dwelling be removed or replaced; d) The applicant shall provide for on -site geotechnical testing and observation during site grading and during wall and foundation construction. Records of the geotechnical observation and testing shall be provided to the City of Edmonds on no less than a weekly basis. 3. The applicant must have a Geotechnical Engineer flag the top of the slope and provide a survey showing the location of the steep slope hazard areas and associatted buffer in order to complete the requirements of the required Critical Areas Study for the site. 4. The Steep Slope Hazard Area and associated buffer must be called out as a separate tract or easement and designated as a Critical Areas Tract. The Critical Areas Easement must be recorded with Snohomish County, in a form approved by the Planning Division that provides notice of the Critical Areas Tract on the property and the limitations on actions in or affecting the easement.
