The original critical areas determination, issued July 13, 2000, indicates that a study is required. The site is adjacent to property along Sierra Place where known wetlands are located. Upon further visit to the site at 1142 Vista Place, it appears that in fact a stream exists, near and or on the property. If the stream is a Class 2 stream, the Edmonds Community Development Code requires that development be 40 feet from the stream. This includes a 25 -foot stream buffer and a 15 -foot building setback. It appear that the proposal is more that 65 -feet from the stream. As a result, the proposed single family house does not appear to impact the stream. Further study by a wetland biologist will not be required for the proposed building permit provided that the following conditions are met: 1. A Native Growth Protection Area Easement (NGPAE) must be established on the lot. It must include the easternmost 40 feet of the site. 2. The NGPAE must be recorded with Snohomish County. A copy of the recorded document must be provided to the City of Edmonds Planning & Development Services Department. 3. The NGPAE must be indicated on the plot plan. 4. No development will be allowed to occur within the NGPAE until which time a critical areas study is completed. Based on the study findings, the NGPAE may be revised or removed accordingly. Changes to the NGPAE must also be recorded with Snohomish County. This conditional waiver is specific to the single family house building permit submitted September 12, 2000. Any future development proposals must be individually reviewed to determine whether a critical area study is required. The following criteria was used in making the determination per ECDC Section 20.15B. 140(A)(2): 1. There will be no alteration of the critical area or its buffer. 2. The development proposal will not impact the critical areas in a manner contrary to the goals, purposes, objectives and requirements of this chapter. 3.
