This puts the proposed pavers and possiblyplantersand water features within the right of way.Such itemsare not permitted within the right of waywithout a separate permit approval. The pavers would be considered a permanent structureand would require an encroachment permit.Planters and water features would be consideredtemporary or movable objectsandwould require aStreet Use permit. 3/27/14-That said,I have learned there is an encroachment permit for the existing deck. It may be possible that we can amend the existing encroachment permit to include the pavers within the right of way. Attached is the existing Encroachment Agreement as well as a handout for encroachment permit requirements. 3/27/14-1) Pleasefill out and submit the Encroachment permit applicationE-26, if you do intend to place these features within the right of way. Please revise the existing Encroachment Agreement so that it reflects the existing encroachments as well as the proposed encroachment (pavers)(Section 3 of agreement). Please make sure to reference previous recording number.You will also need to showthe encroachment within Exhibit “B”, site plan, similar in manner to existingencroachments. 6/3/14 –City Encroachment Permit Application received. Attached is the previously approved(City of Edmonds)/recorded(Snohomish County) encroachment with revisions (shown in blue) for the proposed encroachment. Please transfer the information provided on this attachment to a new Encroachment Agreement (attached pages8-16)and have notarizedbefore submitting. At the request of Snohomish County, the Encroachment Agreement should be filled out in black ink. (please make sure to include attached updatedsite plan, Exhibit”B”). Placement of water features and planters within the right of way willrequire a street use permit. Please see attached Street Use Agreement and Street Use Permit RequirementsE75. 6/3/14 –Street use Agreement received, though the Certificate of Liability Insurance needs some correction. Please see attached comments as well as Certificate of Liability Insurance example. 3/27/14-4). Please provide a site plan which accurately shows the right of way and the placement of pavers, planters and water features.
