According to ECDC 18.45.045.C, [a]ny permit granted under the provisions of this section shall expire one year from the date of issuance." The permit was therefore due to expire on February 11, 2010. However, ECDC 18.45.045.0 also indicates that "[u]pon receipt of a written request, a permit may be extended for six months." On February 8, 2010, Mr. Richard Kirschner (an original agent on your behalf regarding the permit along with Mr. Ron DenAdel as part of S&K Joint Venture) submitted a request to extend the approval of the subject permit. Since the request was filed in a timely manner, CU -2008-0040 was extended by six months and set to expire on August 11, 2010. At our meeting on June 14, 2010 with the parties of record to the permit, we discussed extending the permit timeline again in order to allow sufficient time to produce the required plans, review and approve them, and complete site work by the start of the rainy season. On June 23, 2010, you submitted a request to extend the subject permit as we had discussed. Because you are the landowner for the permit and since you filed a letter requesting additional extension prior to the expiration of the subject permit, the conditional approval of CU -2008-0040 is therefore extended and shall now expire on November 1, 2010. In your letter you also stated that Mr. Kirschner and Mr. DenAdel will no longer be your agents handling the permit. This is noted and all future correspondence will be directed to you as the property owner of the subject site at 17035 76`x' Avenue West. Per ECDC 20.05.020.D, an application for extension of time of a conditional use permit is a Type II decision. A party of record may submit a written appeal of a Type II decision within 14 days of the date of issuance of the decision. The appeal will be heard at an open record public hearing before the Hearing Examiner according to the requirements of ECDC Chapter 20.06 and Section 20.07.004.
